Heard the learned counsel for the parties and perused\nthe counter affidavit filed on behalf of the respondents.\n                       With the consent of the learned counsel for the parties,\nthis application is taken up for disposal at the stage of admission itself.\n                       The petitioner in this application has prayed for\nissuance of a direction to the respondents to admit the petitioner to the\nJunior Research Fellowship ( JRF) scheme of Ph. D. Programme 2008 in the\nFaculty of Management Studies under the respondent Indian School of\nMines University ( ISMU) and also for an order quashing the letter dated\n18.8.2008<\/pre>\n<p>(annexure 6) and the letter dated 21.8.2008 (annexure-7) whereby<br \/>\nthe petitioner&#8217;s application seeking his admission has been rejected by the<br \/>\nrespondent no.4.\n<\/p>\n<p>2.              The facts of the petitioner&#8217;s case is as follows :\n<\/p>\n<p>                (i) An advertisement was issued by the respondents inviting<br \/>\napplications by the respondent ISMU from                 eligible candidates for<br \/>\nadmission to Research Fellowship in Ph. D. Programme 2008. The<br \/>\nadvertisement had stipulated categorically that for the Industrial<br \/>\nEngineering           &amp; Management Discipline, the minimum qualification<br \/>\nprescribed is M. Tech\/B.Tech. in any branch of Engineering. It also<br \/>\ncategorically mentioned that the Management Studies is a Management<br \/>\nDiscipline      for     which    minimum        qualification    prescribed   was<br \/>\nMBA\/M.Tech\/ Industrial Engineering Management \/M. Com\/M.A.<br \/>\nEconomics.\n<\/p>\n<p>                (ii) The petitioner had applied for Management Studies in<br \/>\nmanagement Discipline declaring that he possessed MBA diploma.\n<\/p>\n<p><span class=\"hidden_text\">                                        2<\/span><\/p>\n<p>             (iii) in the results of the Entrance Examination at which the<br \/>\npetitioner had appeared, he was assessed as selected, though placed           at<br \/>\nserial no. 7 in the wait list. Such candidates in the wait list could have their<br \/>\nchance of admission\/absorption if the selected candidate of the main list<br \/>\ndoes not accept the offer of admission.\n<\/p>\n<p>              (iv) One candidate, namely Akbar Khan, who had applied in<br \/>\nthe Discipline of Industrial Engineering &amp; Management and was selected,<br \/>\ndid not take his admission and consequently, the seat offered to him in<br \/>\nthe Industrial Engineering &amp; Management Discipline, remained vacant .\n<\/p>\n<p>3.           The petitioner has sought for his admission against the vacant<br \/>\nseat which has been refused by the respondents by the impugned letters.<br \/>\n4            The petitioner would refuse to accept the contention of the<br \/>\nrespondents that there are two branches or disciplines under the<br \/>\ndepartment of Management Studies, since, according to him, both the<br \/>\ndisciplines were emerged together to constitute a common department<br \/>\nunder the name of Management Studies.\n<\/p>\n<p>5            As explained by the respondents, decision was taken at the<br \/>\nExecutive Board level of the respondent ISMU to rename and restructure<br \/>\nthe Department of Industrial Engineering &amp; Management Discipline and<br \/>\npursuant thereto, the Department was renamed as the Department of<br \/>\nManagement Studies. However, it cannot be said that on such renaming,<br \/>\nthe various disciplines under the Management Studies have been merged.<br \/>\nThis is indicative from the fact that each of various disciplines prescribes<br \/>\nspecific educational qualification as the eligibility criteria for admission<br \/>\nand it has also been reflected in the Advertisement ( Annexure A) issued<br \/>\nby the respondents inviting applications from eligible candidates.<br \/>\n6            As observed above, for students opting for Industrial<br \/>\nEngineering &amp; Management Discipline, the minimum qualification<br \/>\nstipulated is shown in the Advertisement itself i.e. 1st class M. Tech\/B.Tech<br \/>\nin any branch of engineering. On the other hand, minimum qualification<br \/>\nfor the Management Discipline does not insist upon a candidate<br \/>\npossessing M.Tech\/B.Tech degree in any branch of Engineering. It is not<br \/>\ndisputed that the selected candidate namely Akbar Ahmad Khan who<br \/>\npossessed degree in Engineering Branch had sought for his admission to<br \/>\nResearch Programme in the discipline of Industrial Engineering &amp;<br \/>\n<span class=\"hidden_text\">                                        3<\/span><\/p>\n<p>Management and since he did not take admission, a vacancy has been<br \/>\ncreated. Yet, such vacancy can be filled up only by such candidate of the<br \/>\nwait list who had opted for the same discipline and who possessed the<br \/>\nrequisite qualification of the said discipline.\n<\/p>\n<p>7            In response to the advertisement which had specifically<br \/>\ninvited separate applications from candidates in respect of the two<br \/>\ndisciplines, the petitioner had opted for the discipline of Management<br \/>\nScience on the ground of his possessing the requisite qualification of MBA<br \/>\ndegree. It is on this ground that the respondents have refused to fill up the<br \/>\nvacancy created in the discipline of Industrial Engineering &amp; Management<br \/>\nby accepting the petitioner&#8217;s candidature. The decision of the respondents<br \/>\nfor the reasons assigned in the impugned letters, in my opinion, cannot be<br \/>\ntermed irrational or arbitrary.\n<\/p>\n<p>8            Even otherwise, admittedly, the petitioner&#8217;s position in the<br \/>\nwait list is at serial no..7 and there are quite a number of candidates above<br \/>\nhim in the wait list who could stake their claim for absorption against the<br \/>\nvacancy on the basis of their fulfilling the eligibility criteria. The mere fact<br \/>\nthat the petitioner&#8217;s name finds place in the wait list does not create any<br \/>\nright in his favour for his admission to the course offered by the<br \/>\nrespondents.\n<\/p>\n<p>             For the aforesaid reasons, I do not find any merit in this writ<br \/>\npetition. Accordingly, this writ petition is dismissed at the stage of<br \/>\nadmission itself.\n<\/p>\n<pre>Ambastha\/-                                           (D.G.R.
