Raman Doulagar\t\t\t\t\t\n\nDATE OF JUDGMENT: 09\/11\/2006\n\nBENCH:\nARIJIT PASAYAT &amp; LOKESHWAR SINGH PANTA\n\nJUDGMENT:\n<\/pre>\n<p>J U D G M E N T<\/p>\n<p>ARIJIT PASAYAT, J.\n<\/p>\n<p>\tThis petition for transfer has been filed under Article<br \/>\n139-A (2) of the Constitution of India, 1950 (in short the<br \/>\n&#8216;Constitution&#8217;). It has been filed by the Indian Airlines Limited<br \/>\nseeking transfer of Writ Petition (Civil) No. 3992 of 2006  titled<br \/>\n&#8220;Captain Raman Doulagar v. Indian Airlines Limited&#8221; pending<br \/>\nbefore the Madras High Court to the Delhi High Court.  Prayer<br \/>\nhas been made primarily on the ground that several other writ<br \/>\npetitions involving identical issues are pending before the<br \/>\nDelhi High Court.\n<\/p>\n<p>\tLearned counsel for the respondent on the other<br \/>\nsubmitted that the prayer has been made mainly on the<br \/>\nground that in the event there are conflicting decisions, it<br \/>\nwould not be in the interest of the parties.  It is submitted that<br \/>\nthere is no scope for conflicting views being expressed by the<br \/>\ntwo High Courts, as the controversy involved is settled by a<br \/>\ndecision of this Court in <a href=\"\/doc\/944668\/\">Regional Provident Fund<br \/>\nCommissioner, Mangalore v. Central Arecanut &amp; Coca<br \/>\nMarketing and Processing Coop. Ltd., Mangalore<\/a> [2006(2) SCC<br \/>\n381].  A reference is made to Paragraphs 13 and 14 of the<br \/>\njudgment. It is also submitted that in the writ petition,<br \/>\npending before the Madras High Court, certain additional<br \/>\nissues are also involved.\n<\/p>\n<p>The prayers made in the Writ Petitions before the Madras<br \/>\nHigh Court and the Delhi High Court needs to be examined.<br \/>\nIn the Madras High Court the prayers inter-alia are as follows:\n<\/p>\n<p>&#8220;For all the aforesaid reasons, it is prayed<br \/>\nthat this Hon&#8217;ble Court may be pleased to<br \/>\nissue a Writ of Certiorari or Mandamus or any<br \/>\nother appropriate Writ, Order or Direction<br \/>\ncalling for the records of the respondent<br \/>\nrelating to the impugned Seniority List<br \/>\ncirculated vide letter no. HPDO1\/O-2601 dated<br \/>\n14.7.2004 and quash the same and<br \/>\nconsequently direct the respondent to fix the<br \/>\nseniority of the petitioner herein above<br \/>\n50th,51th    and 52nd  batches of Trainee-Pilots<br \/>\nand pass such further or other orders as may<br \/>\nbe deemed fit and proper in the facts and<br \/>\ncircumstances of the case and thus render<br \/>\njustice.\n<\/p>\n<p>It is, therefore, further prayed that this<br \/>\nHon&#8217;ble Court may be pleased to direct the<br \/>\nrespondent to send the petitioner herein<br \/>\nforthwith for Pilot-in-Command (P.I.C.)<br \/>\nTraining in consonance with the policy laid<br \/>\ndown for the petitioners-batch (STP-1),<br \/>\npending disposal of the above Writ Petition,<br \/>\nand pass such further or other orders as may<br \/>\nbe deemed fit and proper in the facts and<br \/>\ncircumstances of the case and thus render<br \/>\njustice.&#8221;\n<\/p>\n<p>Before the Delhi High Court the basic prayers are as<br \/>\nfollows:\n<\/p>\n<p>&#8220;a writ, order or direction in the nature of<br \/>\nmandamus or any other writ of like nature<br \/>\nquashing the impugned Draft Seniority List of<br \/>\nFirst officers, dated 14 July, 2004 and<br \/>\ndirecting the respondent to treat STP-O1<br \/>\nbatch, including the petitioner, separate and<br \/>\nindependent from their counterparts of the<br \/>\nTrainee Pilot lineage for all purposes including<br \/>\npromotion to the rank of Commander on the<br \/>\nbasis of one eligibility.\n<\/p>\n<p>A writ, order or direction in the nature of<br \/>\nmandamus quashing the impugned Draft<br \/>\nSeniority List of First Officers, dated 14 July,<br \/>\n2004 and directing the respondents to place<br \/>\nhis batch, including the petitioner, above all<br \/>\nthose of Trainee Pilots lineage, including 50th,<br \/>\n51st and 52nd batches of Trainee Pilots that<br \/>\ncompleted their training and absorbed as a<br \/>\nbatch in the regular cadre of Pilots of Indian<br \/>\nAirlines after the publication of their<br \/>\nnotification in press on 13th August, 2001<br \/>\nadopting the Scheme of Sr. Trainee Pilots<br \/>\nagainst which the petitioner was enrolled as a<br \/>\nSr. Trainee Pilot and to give consequential<br \/>\nbenefits to the petitioner.&#8221;\n<\/p>\n<p>On a perusal of the primary stands as culled out from the<br \/>\nprayers made it is clear that they are conceptually identical.<br \/>\nWhether the decision in Regional Provident Fund<br \/>\nCommissioner&#8217;s case (supra) has any relevance can be<br \/>\nconsidered by the High Court where all the petitions can be<br \/>\ntaken up.  Therefore, we consider it to be a fit case where the<br \/>\nWrit Petition No.3992 of 2006 pending before the Madras High<br \/>\nCourt is to be transferred to the Delhi High Court to be taken<br \/>\nup along with Writ Petition (Civil) Nos.311 of 2005, 957 of<br \/>\n2005 and 958 of 2005.\n<\/p>\n<p> The transfer petition is accordingly allowed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Indian Airlines Limited vs Capt.
