Respondents\n                                                  -----------\n<\/pre>\n<p>4       28.03.2011                     The present writ petition was filed by the petitioner,<\/p>\n<p>                         who retired with effect from 30.4.2003, from the post of Head<\/p>\n<p>                         Assistant, Department of P.G., L.S. College, Muzaffarpur, with a<\/p>\n<p>                         prayer to direct the respondents to make payment of all the retiral<\/p>\n<p>                         dues with statutory interest.\n<\/p>\n<p>                                       The present writ petition was filed on 20.7.2006, after<\/p>\n<p>                         serving a copy on learned counsel appearing on behalf of<\/p>\n<p>                         respondents\/ B.R.A. Bihar University, Muzaffarpur.<\/p>\n<p>                                       Earlier no counter affidavit was filed on behalf of the<\/p>\n<p>                         University.\n<\/p>\n<p>                                       On 13.02.2007, the respondent University was directed<\/p>\n<p>                         to ensure payment of the retiral dues of the petitioner and file<\/p>\n<p>                         counter affidavit, if possible. Despite judicial order of this court<\/p>\n<p>                         same was not complied with. Recently, on 25th March, 2011, a<\/p>\n<p>                         vague counter affidavit has been filed with several &#8216;ifs&#8217; and &#8216;buts&#8217;.<br \/>\n<span class=\"hidden_text\">                             2<\/span><\/p>\n<p>         It is necessary to quote statement made in paragraph no. 6 of the<\/p>\n<p>         counter affidavit which is as follows:\n<\/p>\n<p>                     &#8220;That for getting those documents the University<\/p>\n<p>         has already written to the petitioner and states before the<\/p>\n<p>         Hon&#8217;ble Court that as soon as those papers are received in the<\/p>\n<p>         University within the fortnight of receiving the same they will<\/p>\n<p>         be sent to the auditors and payments will be made to the<\/p>\n<p>         petitioner within a month from the date of return of the<\/p>\n<p>         documents from the office of the auditors.&#8221;<\/p>\n<p>                     Sri Ajay Bihari Sinha, learned counsel appearing on<\/p>\n<p>         behalf of University submits that University is taking all steps to<\/p>\n<p>         clear all the retiral dues.\n<\/p>\n<p>                     The writ petition stands allowed with direction to the<\/p>\n<p>         respondents, particularly, respondent no. 1\/Vice Chancellor,<\/p>\n<p>         B.R.A.
