Against the judgment delivered by the learned Single<br \/>\n     Judge in Special Civil Application No. 1062 of 1996 on<br \/>\n     2nd May, 1996, dismissing the Special Civil Application,<br \/>\n     the original petitioner has preferred this appeal.\n<\/p>\n<p>     #.    Learned counsel for the appellant contended that<br \/>\n     there is no question of suppression of material facts.<br \/>\n     He further contended that under Section 37 of the Bombay<br \/>\n     Land Revenue Code, 1879, an inquiry ought to have been<br \/>\n     held.    The learned Single Judge while disposing of the<br \/>\n     petition also specifically observed that the petitioner<br \/>\n     should move the competent Civil Court for voicing its<br \/>\n     grievance by means of      an   appropriate  proceedings<br \/>\n     including filing of separate suit by seeking appropriate<br \/>\n     amendment in the suit which may be pending at the<br \/>\n     relevant time.\n<\/p>\n<p>     #. There are concurrent findings of fact recorded by the<br \/>\n     authorities below.   There are disputed questions of fact<br \/>\n     and therefore, it would not be proper for this Court to<br \/>\n examine the same. In our opinion therefore, it would be<br \/>\njust and proper for the party concerned to approach the<br \/>\nCivil Court for appropriate remedy, if so advised. The<br \/>\nappeal is disposed of accordingly.   Consequently, Civil<br \/>\nApplication stands rejected.\n<\/p>\n<p>[B.C.
