RAMKUMAR, J.\n                       ................................\n                       B.A. No.8244 of 2010\n                   ..........................................\n          Dated this the 21st day of December, 2010\n\n                                  ORDER\n<\/pre>\n<p>      Petitioners, who are accused Nos.2 and 5 in Crime<\/p>\n<p>No.385\/2009 of Vellarada Police Station for offences punishable<\/p>\n<p>under Sections 143, 147, 148, 149, 341, 323, 324, 308 and 379<\/p>\n<p>I.P.C., seek anticipatory bail.\n<\/p>\n<p>      2.    The learned Public Prosecutor opposed the application.<\/p>\n<p>      3.    After evaluating the factors and parameters               which<\/p>\n<p>are to be taken into consideration in the light of paragraph 122<\/p>\n<p>of the verdict     dated       2-12-2010          of the Apex Court      in<\/p>\n<p><a href=\"\/doc\/1108032\/\">Siddharam Satlingappa Mhetre v. State of Maharashtra and<\/p>\n<p>Others<\/a>       (2010(4) KLT 930), I am of                       the view that<\/p>\n<p>anticipatory bail cannot be granted in a case of this nature, since<\/p>\n<p>the investigating officer         has not had              the advantage of<\/p>\n<p>interrogating the petitioners.            But at the same time,       I am<\/p>\n<p>inclined to permit the petitioners to surrender before the<\/p>\n<p>Investigating Officer for the purpose of interrogation and then to<\/p>\n<p>have their application for bail considered by the Magistrate or<\/p>\n<p><span class=\"hidden_text\">B.A.No.8244\/2010               2<\/span><\/p>\n<p>the Court having jurisdiction.   Accordingly, the petitioners shall<\/p>\n<p>surrender before the investigating officer on 30.12.2010 or on<\/p>\n<p>31.12.2010 for the purpose of interrogation and recovery of<\/p>\n<p>incriminating material, if any. In case the investigating officer is<\/p>\n<p>of the view that having regard to the facts of the case arrest of<\/p>\n<p>the petitioners is imperative he shall record his reasons for the<\/p>\n<p>arrest in the case-diary as insisted in paragraph 129            of<\/p>\n<p>Siddharam Satlingappa Mhetre&#8217;s case (supra).                   The<\/p>\n<p>petitioners shall thereafter be produced before the Magistrate or<\/p>\n<p>the Court concerned and permitted to file an application for<\/p>\n<p>regular bail.     In case the interrogation of the petitioners are<\/p>\n<p>without arresting them, the petitioners shall thereafter appear<\/p>\n<p>before the Magistrate or the Court concerned       and apply for<\/p>\n<p>regular bail. The Magistrate or the Court on being satisfied that<\/p>\n<p>the petitioners have been interrogated by the police shall, after<\/p>\n<p>hearing the prosecution as well,      consider and dispose of<\/p>\n<p>their application for regular bail preferably on the same<\/p>\n<p>date on which it is filed.\n<\/p>\n<p>      In case   the petitioners   while surrendering before the<\/p>\n<p><span class=\"hidden_text\">B.A.No.8244\/2010                 3<\/span><\/p>\n<p>Investigating Officer have deprived       the investigating officer<\/p>\n<p>sufficient time for interrogation, the officer shall complete the<\/p>\n<p>interrogation   even if it is beyond the time limit fixed as above<\/p>\n<p>and submit a report to that effect        to the Magistrate or the<\/p>\n<p>Court concerned.
