However, learned<br \/>\n\tAsst. Government Pleader states that the matter may be remanded to<br \/>\n\tthe Deputy Collector as if the appeal is allowed, and Deputy<br \/>\n\tCollector shall decide the matter afresh. He only submitted that the<br \/>\n\tpetitioner may appear before the Deputy Collector within two weeks<br \/>\n\tfrom today.\n<\/p>\n<p>In<br \/>\n\tview of the above declaration made on behalf of the State<br \/>\n\tGovernment, the impugned order passed by the Deputy Collector for<br \/>\n\tassessment of the stamp duty as well as the order of Appellate<br \/>\n\tAuthority rejecting the appeal and thereby confirming the order of<br \/>\n\tthe Deputy Collector is quashed and set aside with the direction<br \/>\n\tthat the matter shall stand restored to the Deputy Collector.\n<\/p>\n<p>The<br \/>\n\tpetitioner shall appear before the Deputy Collector within two weeks<br \/>\n\tfrom today. The Deputy Collector shall decide the matter in<br \/>\n\taccordance with law after giving opportunity of hearing to the<br \/>\n\tpetitioner and shall pass the order.\n<\/p>\n<p>It<br \/>\n\tis hardly required to be clarified that when the order is quashed,<br \/>\n\tthere shall not be any recovery until afresh order is passed by the<br \/>\n\tDeputy Collector. In the event, if the petitioner is aggrieved by<br \/>\n\tafresh order, which may be passed by the Deputy Collector, the<br \/>\n\tpetitioner may resort to remedy as may be permissible in law.\n<\/p>\n<p>The<br \/>\n\tpetition is allowed to the aforesaid extent. Rule made absolute<br \/>\n\taccordingly.
