The PIO was not able to<br \/>\nprovide any information to the Appellant after the order of FAA. Though he is showing a<br \/>\ncovering letter of 22\/10\/2009 which no information appears to have been enclosed. The<br \/>\nRespondent states that the persons responsible for not providing the information after the<br \/>\nFAA&#8217;s order are Mr Dilip Singh (PIO\/Assistant Commissioner) &amp; Mr V R Bansal (SE-I<br \/>\n&amp; PIO).\n<\/p>\n<p>Decision:\n<\/p>\n<p>The appeal is allowed.\n<\/p>\n<p>The PIO is directed to provide the complete information to the Appellant before 20<br \/>\nFebruary 2010<br \/>\n From the facts before the Commission it is apparent that the PIOs Mr Surinder Singh<br \/>\n(deemed PIO\/SS) &amp; Mr V R Bansal (SE-I &amp; PIO) are guilty of not furnishing<br \/>\ninformation within the time ordered by the FAA.\n<\/p>\n<p>It appears that the deemed PIOs actions attract the penal provisions of Section 20 (1). A<br \/>\nshowcause notice is being issued to them, and they are directed give their reasons to the<br \/>\nCommission to show cause why penalty should not be levied on them. They had further<br \/>\nrefused to obey the orders of their superior officer, which raises a reasonable doubt that<br \/>\nthe denial of information may also be malafide. The First Appellate Authority has clearly<br \/>\nordered the information to be given.\n<\/p>\n<p>They will present themselves before the Commission at the above address on 10 March<br \/>\n2010 at 10.00 am along with their written submissions showing cause why penalty should<br \/>\nnot be imposed on them as mandated under Section 20 (1).
