Fenhara, District-East Champaran.\n                                                   ------------Respondents\n\n                                             -----------\n<\/pre>\n<p>                 For the Petitioners :-    Mr. Yogesh Chandra Verma, Sr. Adv.<br \/>\n                 For Respondent No. 6:- Mr. Dilip Kumar Tiwari, Adv.\n<\/p>\n<p>                                           Mr. Amit Kumar Tiwari, Adv.\n<\/p>\n<pre>                 For the State:-           SC-I\n                                        ----------------\n\n4.   20.7.2010                   Petitioners   challenge    the    order    dated\n\n<\/pre>\n<p>                     23.1.2010 of the District Teachers Appointment Appellate,<\/p>\n<p>                     Tribunal East Champaran in Case No. 564 of 2009 where<\/p>\n<p>                     her appointment as Shiksha Mitra as made in 2005 has<\/p>\n<p>                     been set aside.\n<\/p>\n<p>                                 Heard the parties.\n<\/p>\n<p>                                 The private respondent no. 6 has appeared<\/p>\n<p>                     and filed an application vide I.A. No. 3568 of 2010 for<\/p>\n<p>                     vacating the interim order of stay. In my view there is no<\/p>\n<p>                     need for keeping the writ petition pending with consent of<\/p>\n<p>                     parties it is heard for disposal at this stage itself.<br \/>\n<span class=\"hidden_text\">                  2<\/span><\/p>\n<p>Petitioners were selected as a Shiksha Mitra in the year<\/p>\n<p>2005.\n<\/p>\n<p>           Learned Senior Counsel, Mr. Yogesh Chandra<\/p>\n<p>Verma appearing for the petitioners submit that the<\/p>\n<p>tribunal was moved for the first time in the year 2009 by<\/p>\n<p>respondent no. 6. Thus his initial appointment was not<\/p>\n<p>challenged within 30 days in view of the judgment of this<\/p>\n<p>Court in the case of Alok Kumar &amp; Ors. Vs. The State of<\/p>\n<p>Bihar &amp; Ors. reported in 2009 (2) PLJR 929, this Court<\/p>\n<p>should hold that the tribunal acted without jurisdiction to<\/p>\n<p>entertain a complaint.\n<\/p>\n<p>            I regret that the said decision is not applicable<\/p>\n<p>in the facts of the case.    It is not in dispute that on<\/p>\n<p>petitioners&#8217; selection respondent no. 6 had immediately<\/p>\n<p>protested before the Block Development Officer who was<\/p>\n<p>the competent authority to entertain the complaint. When<\/p>\n<p>the Block Development Officer did not take any action, the<\/p>\n<p>petitioner immediately moved the Collector who directed<\/p>\n<p>enquiry by the Block Development Officer.         The Block<\/p>\n<p>Development    Officer   enquired   into   the   matter   and<\/p>\n<p>submitted report that selection of petitioners were wrong<\/p>\n<p>and further that respondent no. 6 was wrongly left out.<\/p>\n<p>The Block Development Officer then became the statutory<\/p>\n<p>authority in terms of Rule 18 of the Bihar Primary<\/p>\n<p>Panchyat Teachers (Service Condition and Appointment)<br \/>\n<span class=\"hidden_text\">                                  3<\/span><\/p>\n<p>            Rules, 2006. He was then asked to take action himself<\/p>\n<p>            but before he could take action Rule 18 was amended and<\/p>\n<p>            the power was given to the Bihar Teachers Appointment<\/p>\n<p>            Appellate Tribunal. As a consequence of which the matter<\/p>\n<p>            reached the tribunal in the year 2009. The tribunal has<\/p>\n<p>            concurred with the findings of the Block Development<\/p>\n<p>            Officer.\n<\/p>\n<p>                          Having perused the order, I have no reason to<\/p>\n<p>            take a different view of the matter. Admittedly in<\/p>\n<p>            appointment of petitioners, the roster was not adhered to<\/p>\n<p>            and ignoring the same rest of the appointments were<\/p>\n<p>            made. If rules would have been adhered to it would be<\/p>\n<p>            respondent no. 6 who would have been appointed. Thus,<\/p>\n<p>            clearly the appointment of petitioners were wrong and<\/p>\n<p>            illegal.   But merely because that was done without<\/p>\n<p>            adhering to the roster clearance etc. the respondent no.<\/p>\n<p>            6 cannot be made to join at this late stage after five years.<\/p>\n<p>            The    post   must       be   re-advertised   and   filled   up   in<\/p>\n<p>            accordance with law as now vacancy arises. This should<\/p>\n<p>            be done within two months.\n<\/p>\n<p>                          The writ application stands disposed of.<\/p>\n<p>Anand Kr.
