Justice ANTONY DOMINIC\n\n Dated :02\/04\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n                ---------------------\n                 W.P.(C).No.7828 OF 2009\n              ------------------------\n             Dated this the 2nd day of April, 2009.\n\n                          JUDGMENT\n<\/pre>\n<p>      Petitioner submits that he has availed of a business<\/p>\n<p>loan of Rs.1 lakh from the 2nd respondent and also a chitty<\/p>\n<p>loan     of Rs.50,000\/-. According to the petitioner both<\/p>\n<p>these loans were secured by mortgaging his         properties<\/p>\n<p>comprised      in     R.S.No.41\/2-1     and     41\/2-2     of<\/p>\n<p>Ottashekharamangalam Village having an extent of 40<\/p>\n<p>cents. It is stated that the petitioner had settled the<\/p>\n<p>liabilities under    both these loans and requested for<\/p>\n<p>releasing the mortgaged property. But however the<\/p>\n<p>respondents have not released           the same. Reasons<\/p>\n<p>according to the petitioner is that he has availed of other<\/p>\n<p>loans as well.\n<\/p>\n<p>        However, the petitioner submits that the aforesaid<\/p>\n<p>properties cannot be made liable for the other loans for<\/p>\n<p>the reason that for all those loans separate properties have<\/p>\n<p><span class=\"hidden_text\">WP(c).No.7828\/09                2<\/span><\/p>\n<p>been given as security, apart from individual sureties. It is<\/p>\n<p>stated that since those loans are fully secured by the<\/p>\n<p>properties given as securities and the sureties offered, the<\/p>\n<p>property referred to above should be released. Counsel also<\/p>\n<p>placed reliance on the judgment rendered by this court in <a href=\"\/doc\/1513606\/\">D.<\/p>\n<p>Vijayalakshmi V. The Kerala State Financial Enterprises<\/a>(ILR<\/p>\n<p>2005(2)Kerala 257).\n<\/p>\n<p>      If as stated by the petitioner, the remaining outstanding<\/p>\n<p>loans are fully secured, prima facie I do not find any reason for<\/p>\n<p>not releasing     the properties.
