Justice K.HEMA\n\n Dated :02\/01\/2009\n\n O R D E R\n                            K.HEMA, J.\n                     ------------------------------\n                     B.A. No.7600 OF 2008\n                     ------------------------------\n             Dated this the 2nd day of January, 2009\n\n\n                             O R D E R\n<\/pre>\n<p>      This petition is for anticipatory bail.<\/p>\n<p>      2. The alleged offence is under Section 55(a) of Abkari<\/p>\n<p>Act. According to prosecution, 2 persons were found<\/p>\n<p>consuming liquor in public place and a case was also<\/p>\n<p>registered against them under Section 15C of Abkari Act.<\/p>\n<p>Thereafter on their information, a search was conducted in a<\/p>\n<p>bar hotel and some liquor was seized from the premises of the<\/p>\n<p>bar and as per the allegations, those were intended to be kept<\/p>\n<p>in the bar room and not outside. Therefore the petitioners<\/p>\n<p>committed offence under Section 55(a), being the licensee and<\/p>\n<p>Manager of the bar.\n<\/p>\n<p>      3. Learned counsel for petitioners submitted that the<\/p>\n<p>petitioners have not committed any offence. The petitioners<\/p>\n<p>are entitled to sell liquor inside the bar room and also in the<\/p>\n<p>roof garden and the restaurant for which they are paying<\/p>\n<p>licence fee. The petitioners are implicated in the offence under<\/p>\n<p>Section 55(a) without any basis. It is also submitted that if at<\/p>\n<p>B.A.No.7600 of 2008<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>all the entire allegations are accepted, the allegations will<\/p>\n<p>amount only to an offence under Section 56(b) of the Abkari<\/p>\n<p>Act, which is a bailable offence. If the petitioners surrender<\/p>\n<p>before the court or they are arrested, it is likely that they will<\/p>\n<p>be remanded, considering the offence as one falling under<\/p>\n<p>Section 55(a) of Abkari Act. Therefore, anticipatory bail may<\/p>\n<p>be granted, it is submitted.\n<\/p>\n<p>       4. It is also pointed out that same arguments were<\/p>\n<p>advanced before learned Sessions Court and the court, as per<\/p>\n<p>the order while dismissing the anticipatory bail application it<\/p>\n<p>was held thus :\n<\/p>\n<blockquote><p>          &#8220;So as per the evidence collected by the<\/p>\n<p>          investigating machinery as revealed from the case<\/p>\n<p>          diary and also from the report appended with the<\/p>\n<p>          case diary, the offence made out can only be one<\/p>\n<p>          u\/s.56(b) of Abkari Act which is a bailable one. So,<\/p>\n<p>          the provisions of Sec.438 Cr.P.C. cannot be<\/p>\n<p>          invoked.&#8221;<\/p><\/blockquote>\n<p>       5. Now the only request made by the learned counsel for<\/p>\n<p>petitioners is, having found that the offence involved is only<\/p>\n<p>under Section 56(b), it may be made clear that further purpose<\/p>\n<p>of bail, the offence is to be treated as one under Section 56(b)<\/p>\n<p>B.A.No.7600 of 2008<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>of Abkari Act and some observations to that effect may be<\/p>\n<p>made.\n<\/p>\n<p>       On hearing both sides and on going through the order of<\/p>\n<p>the learned Sessions Judge, having found that offence involved<\/p>\n<p>is only under Section 56(b) of Abkari Act, I find that some<\/p>\n<p>observations have to be made, failing which petitioners will be<\/p>\n<p>put to irreparable injury and loss. Hence it is made clear that<\/p>\n<p>for purpose of bail, the offence involved in this case will be<\/p>\n<p>treated as one falling under Section 56(b) of Abkari Act and<\/p>\n<p>that this observation is made only for the purpose of bail.<\/p>\n<p>         Petitioners are directed to surrender before the<\/p>\n<p>         Investigating Officer or the Magistrate court<\/p>\n<p>         concerned within 7 days from today in which<\/p>\n<p>         event, offence will be treated as one falling under<\/p>\n<p>         Section 56(b) of Abkari Act for the purpose of<\/p>\n<p>         bail.\n<\/p>\n<p>       With this observation, the petition is disposed of.<\/p>\n<p>                                        K.HEMA, JUDGE<\/p>\n<p>pac<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court T.P.Narayanan vs State Of Kerala Represented By on 2 January, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 7600 of 2008() 1.
