The disciplinaiy authority on an\n\nH H \"  indepencient assessment of the facts and circumstances\n\n i:;he':&lt;:ase and the evidence on record, held the charge\n\nVi  &quot; proved and as the past record of the service of the\n\n petitioner did not disclose any mitigating\n\n\n\n-3-\n\ncircumstances, having suffered minor &#039;die:\n\n59 cases of nondssue of tickets, by   \n\n14.2.2003 dismissed the   \n\nthe Corporation. In the premise of\nthe pleading  the Labour Court framed\n\nissues including&quot; &#039;a pteiiminary issue over the validity of\n\n   enquiry, which was answered in the\n\n  dated 1.4.2006 in other words the\n\n &#039;enquiry was set aside and permitted the\n\n V&#039;  i&#039;p&#039;aztt:ieve&#039; to lead evidence a\ufb01esh. For the respondent-<\/pre>\n<p>A\ufb01ofporation one Witness was examined as MW1 and<\/p>\n<p>&#8216;V Wfour documents marked as Exs.M1 to M4 while the<\/p>\n<p>petitioner tenderm evidence as WW1. The Labour<\/p>\n<p><span class=\"hidden_text\">-4-<\/span><\/p>\n<p>Court: having considered the material on    <\/p>\n<p>evidence both oral and   V&#8217;<\/p>\n<p>explajxation o\ufb01ered by the pe\ufb01tienei;. thetTT  <\/p>\n<p>passengers were empleyeeepoif  of <\/p>\n<p>passes. The Labour  held&#8221;  \ufb02eere was<br \/>\nno mitigating    extraneeus<br \/>\ncircumstances . conduct of<br \/>\nservices,   with minor<br \/>\npunis11:1x1e11:&#8221;.&#8217;V.V.\u00a7:\u00a7;ve.  &#8221; accordingly by the<br \/>\naward   dismissed the<br \/>\napphea\ufb01oe. &#8221;    petition.\n<\/p>\n<p>   petition is \ufb01led on 16.12.2008 calling in<\/p>\n<p>q.;\u00a2-sm.1:   dated 2.3.2007. In the first place,<\/p>\n<p>V -Vthe  deiay in f\ufb02ing the Writ petition is not<\/p>\n<p>H K   In the absence of even a plausible<\/p>\n<p>&#8212;-.T.&#8217;.~e:}A&#8217;qj&gt;I.&gt;a\u00a5.:&#8217;iat:io;:1 for the delay the petition deserves to be<\/p>\n<p>  &#8216; A &#8220;&#8221;:,VVV6.iemissed at the threshold, for delay and latches:<\/p>\n<p>g<\/p>\n<p>..5..\n<\/p>\n<p>*9<\/p>\n<p>3. Having had a glimpse at the awazfd<\/p>\n<p>that the petitioner was employed and he1.{i?&#8217;:t..&#8217;~?i:e  K  <\/p>\n<p>of trust whose honesty and i\u00a7\u00a7}t6g_i&#8217;ii&#8217;._'[ <\/p>\n<p>requirements, the very fact; that  aillowiedi  -&#8216;<\/p>\n<p>two passengers to travei in<br \/>\nfaxes, discloses his    &#8217;employer<br \/>\nwould have to s_L_1\ufb01&#8217;er   action of the<br \/>\nchecking  \u00e9  &#8221; petitioner is not<br \/>\na matter tiiat Vtvith leniency. On<br \/>\nthe other   &#8220;such nature deserves to<br \/>\nbe dealt Witt;   View of mind is<br \/>\nst}_pported\u00a7gt)uy&#8217;it.he  the Apex Court in Regional<\/p>\n<p>  Hotilai 2003(3) SOC 605, and<\/p>\n<p> *  host of-other deeisiens.\n<\/p>\n<p>&#8220;4,   award impugned in my considered<\/p>\n<p> isive\ufb02 merited fully justified and does not call<\/p>\n<p>   &#8216;intetference. The reasons, \ufb01ndings and conclusions<\/p>\n<p> at by the Labour Court is not shown to have<\/p>\n<p>, J<br \/>\n5 ,<br \/>\n<span class=\"hidden_text\">1 <\/span><\/p>\n<p>,6.\n<\/p>\n<p>occasioned gave injustice to the petitioner  .<\/p>\n<p>intcrferenoe.
