Rathod for the petitioner-Palanpur<br \/>\nNagarpalika. The case of the respondent-workman before the Court was<br \/>\nthat he had joined the services of the petitioner- Nagarpalika since<br \/>\n2nd November 1998 and worked upto 9th April<br \/>\n2000,  and on 10th April 2000 his services were terminated<br \/>\nwithout any order in writing, without any notice pay or retrenchment<br \/>\ncompensation.\n<\/p>\n<p>2.\tLearned<br \/>\nadvocate Mr.Mehul Rathod vehemently submitted that the<br \/>\npetitioner-Nagarpalika had produced relevant record, viz. from<br \/>\n02.11.1998 to 06.06.1999, the period for which according to  the<br \/>\npetitioner-Nagarpalika, the respondent-workman was in service.<br \/>\nSimilarly, for second spell when he was in service in the month of<br \/>\nApril 2000, record was also produced. The learned advocate for the<br \/>\npetitioner-Nagarpalika submitted that the learned Judge has held that<br \/>\n the Nagarpalika did not produce the entire record for the period<br \/>\nwhich the respondent- workman contended to be in service, viz., 2nd<br \/>\nNovember 1998 to 9th April 2000.  In absence of the record<br \/>\nfrom June 1999 to 1st April 2000, the learned Judge has<br \/>\ndrawn adverse inference and accepted the case of the respondent-<br \/>\nworkman.\n<\/p>\n<p>3.\tIt<br \/>\nis a settled position of law that a person, who is in possession of<br \/>\nthe record has to produce the same, if he does not want the Court to<br \/>\ndraw an adverse inference against him.\n<\/p>\n<p>4.\tIn<br \/>\nthe present case, the fact remains that the petitioner- Nagarpalika<br \/>\nhas produced record for the period only from November 1998 to June<br \/>\n1999 and for the month of April 2000.  For the intervening period<br \/>\nrecord is not produced. Therefore, the learned Judge has drawn<br \/>\nadverse inference.\n<\/p>\n<p>5.\tDespite<br \/>\nhis strenuous efforts, the learned advocate could not convince this<br \/>\nCourt that the court below has committed any error.   The petition is<br \/>\nfound without any substance. The same is dismissed.\n<\/p>\n<p>(RAVI<br \/>\nR.
