The   petitioner   who   is   working   as   Scavenger   in   the<\/p>\n<p>Medical   College   Hospital,   Kottayam   since   2002,   apprehends<\/p>\n<p>that   he   will   not   be   considered   for   selection   to   regular<\/p>\n<p>vacancies   in   the   same   post   for   the   reason   that   he   is   now<\/p>\n<p>working   in   the   establishment   on   daily   wages.     The   stand<\/p>\n<p>taken   by   the   respondents   in   a   similar   writ   petition   was<\/p>\n<p>that   appointments   can   be   made   only   from   the   list   of<\/p>\n<p>candidates   forwarded   by   the   Employment   Exchange   and   since<\/p>\n<p>the   petitioner   is   already   employed,   his   name   cannot   be<\/p>\n<p>included   in   the   list   to   be   furnished   by   the   Employment<\/p>\n<p>Exchange.     After   considering   the   above   contention   also,<\/p>\n<p>this   Court   in   the   judgment   dated   20.11.2003   in   W.PC)No:\n<\/p>\n<p>35446\/2003(Ext.P4),           directed         that         as         and         when         the<\/p>\n<p>respondents   consider   steps   for   the   regular   selection   of<\/p>\n<p>part-time   workers   as   Scavenging   Workers,   the   petitioners<\/p>\n<p>therein,   who   had   registered   their   names   in   the   Employment<\/p>\n<p>Exchange,   will   also   be   entitled   to   participate   in   the<\/p>\n<p>selection.\n<\/p>\n<p>      3.     The   petitioner   is   similarly   situated   like   the<\/p>\n<p>petitioners   in   Ext.P4.     It   is   submitted   that   they   had<\/p>\n<p><span class=\"hidden_text\">WPC 3266\/2007                           2<\/span><\/p>\n<p>registered their names in the Employment Exchange.   If that<\/p>\n<p>is  so,   the   petitioner   also   will   be   entitled   to   the   benefit<\/p>\n<p>granted   to   the   petitioners   in   Ext.P4   judgment.     It   is<\/p>\n<p>hereby   ordered   that   the   petitioner   shall   be   permitted   to<\/p>\n<p>participate   along   with   other   candidates   sponsored   by   the<\/p>\n<p>Employment   Exchange   provided   he   has   got   registration<\/p>\n<p>through Employment Exchange.\n<\/p>\n<p>          4.    The petitioner has  got a  case  that he is  a person<\/p>\n<p>with disability and is entitled to be considered against 3%<\/p>\n<p>quota   reserved   for   such   categories   of   candidates.     It   is<\/p>\n<p>not   understood   whether   the   respondent   has   earmarked<\/p>\n<p>vacancies for such categories.\n<\/p>\n<p>          5.
