Venkataswami, J.\n<\/p>\n<p>Civil Appeal No. 13391\/86:\n<\/p>\n<p>     Aggrieved\tby  the\t dismissal  of\this  appeal  at\t the<br \/>\nadmission  stage,   the\t appellant,  who  sustained  serious<br \/>\ninjuries in a motor accident that took place on 10.8.84, has<br \/>\npreferred this appeal.\n<\/p>\n<p>     The  appellant  along  with  his  mother,\tbrother\t and<br \/>\nsister-in-law were  travelling in  a taxi  from Nagarcoil to<br \/>\nTrivandrum on  10.8.84. A  bus, belonging to the respondent-<br \/>\nCorporation  coming  from  the\topposite  direction,  dashed<br \/>\nagainst the  taxi while\t trying to  overtake a bullock cart,<br \/>\nresulting in  the death\t of the\t Driver and  the appellant&#8217;s<br \/>\nmother.\t The   other  occupants\t  including  the   appellant<br \/>\nsustained injuries.  The appellant  moved the Motor Accident<br \/>\nClaims Tribunal, Trivandrum, Claiming a sum of Rs.5,06,091\/-<br \/>\nas compensation.  At the time of accident, he was aged about<br \/>\n25 years  and after  practising as  a Lawyer  for some time,<br \/>\napplied for  and secured a seat in the Madras University for<br \/>\npursuing his M.L. course. He sustained in all seven injuries<br \/>\nincluding dislocation  of right\t hip, head injury and injury<br \/>\nto the\tleft eye  and ear. Initially, he was admitted to the<br \/>\nMedical college\t Hospital,  Trivandrum,\t for  treatment\t and<br \/>\nafter discharged  therefrom, he\t was admitted  again to\t the<br \/>\nMadras General\tHospital for  further treatment.  It was the<br \/>\nclaim of  the appellant\t that he  was to  be treated for the<br \/>\nleft carotid  cavernous fistula;  a condition which required<br \/>\nthe treatment  of balloon  embolisation.  According  to\t the<br \/>\nappellant, the said treatment was not available in India and<br \/>\nhis brother, who was a practising Doctor at New York, United<br \/>\nStates, asked  the appellant to go over there for treatment.<br \/>\nAccordingly, he\t went to  the  United  States  and  had\t his<br \/>\ntreatment there.  The Head of the Neurosurgery Department of<br \/>\nTrivandrum  Medical   College  Hospital\t gave  a  Disability<br \/>\nCertificate assessing loss of 60% vision in the left eye and<br \/>\n50% hearing in the left ear. He also opined that dislocation<br \/>\nof the\tright hip  was permanent. Bringing all these factors<br \/>\nin his claim petition, he made a claim of Rs.5,06,091\/-.\n<\/p>\n<p>     The Tribunal was of the view that the claim towards the<br \/>\ntravelling expenses  to New York and Medical expenses in the<br \/>\nHospital at New York and medical expenses in the Hospital at<br \/>\nNew York  and Medical  expenses in the Hospital at New York,<br \/>\ncannot be  allowed as  there was  no record to show that the<br \/>\nfacilities were\t not available\tin India for such treatment.<br \/>\nThe Tribunal  after referring  to the Disability Certificate<br \/>\ngiven by  the Head  of the Neurosurgery Department and other<br \/>\nfactors, awarded the compensation in a sum of Rs.1,76,000\/-.\n<\/p>\n<p>     Aggrieved by  the meager amount of compensation awarded<br \/>\nby the\tTribunal, the  appellant preferred  an appeal to the<br \/>\nKerala High  Court in  M.F.A. No. 712\/90. Unfortunately, the<br \/>\nappellant&#8217;s appeal  came up  for admission  along  with\t the<br \/>\nappeals filed by the other injured occupants of the taxi and<br \/>\nthe legal representatives of the deceased person. A Division<br \/>\nBench of  the Kerala  High Court summarily dismissed all the<br \/>\nappeals at  the\t admission  stage.  Hence,  this  appeal  by<br \/>\nspecial leave.\n<\/p>\n<p>     Learned senior  counsel appearing\tfor  the  appellant,<br \/>\nplacing reliance on the disability Certificate issued by the<br \/>\nHead of\t the Neurosurgery  Department and the letter written<br \/>\nby a  Doctor in\t New York to the U.S. Consulate at Madras to<br \/>\nenable the appellant to get necessary visa for his treatment<br \/>\nat United  States and the oral evidence given by the Doctor,<br \/>\nwho gave  the Disability  Certificate,\tsubmitted  that\t the<br \/>\nfindings of the Division Bench cannot be supported According<br \/>\nto the\tlearned senior counsel, the appellant has discharged<br \/>\nthe burden  to prove  his case\tthat the treatment he had in<br \/>\nNew York  was not  available in India at that time and there<br \/>\nis no  iota of\tevidence on  the side  of the respondents to<br \/>\ndemolish the  claim of\tthe appellant in this regard. In any<br \/>\nevent, according  to the  learned senior counsel, it was not<br \/>\nfor the\t respondent to\tsuggest what  type of  treatment the<br \/>\ninjured has  to\t undergo.  It  was  further  contended\tthat<br \/>\nneither the  Tribunal nor the High Court had any material to<br \/>\ndisbelieve the\tevidence produced  by the  appellant. In the<br \/>\nabsence of  any\t positive  evidence  from  he  side  of\t the<br \/>\nrespondent-Corporation, it was the contention of the learned<br \/>\nsenior counsel\tfor the appellant that the High Court should<br \/>\nhave allowed the compensation as claimed by the appellant.\n<\/p>\n<p>     Contending\t  contrary,    learned\t counsel   for\t the<br \/>\nrespondent-corporation submitted  that the  High  Court\t has<br \/>\ncorrectly appreciated  the evidence  and the  High Court has<br \/>\nfactually found\t that the Award of Rs. 1,76,000\/- was on the<br \/>\nhigher side.  He also  invited our  attention  to  the\toral<br \/>\nevidence of the Doctor, who gave the Disability Certificate.\n<\/p>\n<p>     After going  through the  Award of the Tribunal and the<br \/>\njudgment of  the High  Court, we  are of  the view  that the<br \/>\nappellant was  not given  the just compensation on the facts<br \/>\nof the\tcase, to  which he  was entitled  to. The Disability<br \/>\nCertificate was\t not totally accepted by the High Court only<br \/>\non the ground that the Doctor, who gave the Certificate, has<br \/>\nno authority  to  give\tsuch  a\t Disability  Certificate  in<br \/>\nrespect of vision in the left eye and loss of hearing in the<br \/>\nleft ear.  We have  perused he\tevidence of  the Doctor, who<br \/>\ngave the  Disability Certificate, and he has asserted in the<br \/>\nevidence as follows:-\n<\/p>\n<blockquote><p>     &#8221; Before  I issued this certificate<br \/>\n     Ext.  A22\t I  saw\t the  report  of<br \/>\n     neurologist  of   the  M.C.H.   The<br \/>\n     respective\t departments  will  send<br \/>\n     their  reports.   I  referred   the<br \/>\n     patient to\t opthalmic hospital  and<br \/>\n     ENT specialist, M.C.H., Trivandrum.<\/p><\/blockquote>\n<blockquote><p>     ENT must  have seen  it. Audeometry<br \/>\n     was done  to him. I did not examine<br \/>\n     his     vision.\t Ophthalmologist<br \/>\n     examined his  vision. He had lot of<br \/>\n     problem. Mainly Deplopia. Regarding<br \/>\n     the nature\t of  deplopea  only  the<br \/>\n     Ophthalmic\t surgeon   can\t explain<br \/>\n     Audiometry was  done and  a  report<br \/>\n     was given by ENT department. when I<br \/>\n     treat a patient, I alone will issue<br \/>\n     a\tdisability   certificate.  Other<br \/>\n     departments  will\t issue\t reports<br \/>\n     about the treatment made by them. I<br \/>\n     have  not\t seen\tany   disability<br \/>\n     certificate  issued  by  the  other<br \/>\n     departments. As head to he treating<br \/>\n     unit  the\t Neurologist  can  issue<br \/>\n     disability certificate. There is in<br \/>\n     60% loss  of hearing  in  one  ear.<br \/>\n     With respect  to vision also I have<br \/>\n     seen  the\t report.  Your\t ar  not<br \/>\n     competent\tto  issue  a  disability<br \/>\n     certificate regarding  eye and  ear<br \/>\n     (Q) Not  correct (ANs.) Orthopaedic<br \/>\n     surgeons  are  competent  to  issue<br \/>\n     disability certificate  in\t respect<br \/>\n     of every  system of the body on the<br \/>\n     basis of  the MC  brid  scale.  His<br \/>\n     left hip  is  affected.  He  had  a<br \/>\n     damage to optical nerve of the left<br \/>\n     side. I mean the 2nd cranial nerve.<br \/>\n     That was  not mentioned in the loss<br \/>\n     certificate. when\tthere is a total<br \/>\n     loss, each\t of the reasons need not<br \/>\n     be mentioned.  I say  you have  not<br \/>\n     mentioned the reasons for assessing<br \/>\n     50% disability  (Q). I  have stated<br \/>\n     in the  certificate the  reasons. I<br \/>\n     say without  getting  reports  from<br \/>\n     the  other\t  departments  you  have<br \/>\n     issued  the   certificate\t(Q)   No<br \/>\n     (Anser).<\/p><\/blockquote>\n<p>     On a  fair reading\t of the evidence, we are of the view<br \/>\nthat the  High Court  was  not\tjustified  in  doubting\t the<br \/>\ncorrectness of the Disability Certificate. Further, it is on<br \/>\nrecord that  the treatment  by balloon\tembolisation of\t the<br \/>\nfistual was not available in India.\n<\/p>\n<p>     The Assistant Professor Clinical Neurosurgery, New York<br \/>\nUniversity School  of Medicine,\t in his\t letter addressed to<br \/>\nthe U.S. Consulate, Madras, has stated thus:-\n<\/p>\n<blockquote><p>     &#8221; Mr. Muthaiah Sekhar is a 27-year-<br \/>\n     old  Asian\t  Indian  male\twho  was<br \/>\n     involved  in   a  major  automobile<br \/>\n     accident in  India in August, 1984.<br \/>\n     His  mother   was\tkilled\tin  this<br \/>\n     accident and  Mr.\tMuthaiah  Sekhar<br \/>\n     himself\t sustained\tmultiple<br \/>\n     injuries.\tHe   presented\tto   the<br \/>\n     Government\t General   Hospital   in<br \/>\n     Madras with  head injury, decreased<br \/>\n     vision and\t bulging  of  left  eye,<br \/>\n     Examination    revealed\tmarkedly<br \/>\n     decreased visual  acuity, pulsating<br \/>\n     proptosis and  a bruit  in the left<br \/>\n     eye. A  cerebral angiogram\t clearly<br \/>\n     showed the\t presence of a carotico-<br \/>\n     cavernous fistula.\n<\/p><\/blockquote>\n<blockquote><p>     The  modern   treatment  for   this<br \/>\n     condition is intra-arterial balloon<br \/>\n     embolization   of\t  the\tfistual,<br \/>\n     sparing the  carotid  artery.  This<br \/>\n     procedure\tis   not  available   in<br \/>\n     India.  the   only\t procedure  they<br \/>\n     could offer  him in  Madras  was  a<br \/>\n     carotid ligation,\twhich apart from<br \/>\n     not being\tcurative,  is  dangerous<br \/>\n     and    can\t    cause     disastrous<br \/>\n     complications such as stroke.<br \/>\n     I have  reviewed  all  his\t medical<br \/>\n     records and  angiograms from madras<br \/>\n     and strongly  feel that  he  should<br \/>\n     come to  the United  States to have<br \/>\n     the  balloon  embolization.  I  can<br \/>\n     make all  the arrangements for this<br \/>\n     procedure to  be done  at New  York<br \/>\n     University\t Medical   Center.   The<br \/>\n     patient&#8217;s\tbrother,   Dr.\tMuthaiah<br \/>\n     Sukumaran,\t   is\t a    practicing<br \/>\n     physician\tin   New  York\t and  is<br \/>\n     willing to bear all expenses.<\/p><\/blockquote>\n<blockquote><p>     I would like to request that a visa<br \/>\n     be\t issued\t  to  him   as\tsoon  as<br \/>\n     possible\tbefore\t  the\t patient<br \/>\n     develops\t   an\t    irreversible<br \/>\n     complication  such\t  as  blindness,<br \/>\n     stroke, cerebral hemorrhage or even<br \/>\n     death.&#8221;<\/p><\/blockquote>\n<p>     This was  not given  the due  importance  both  by\t the<br \/>\ntribunal and by the High Court in rejecting the claim of the<br \/>\nappellant for  travelling to  New York and expenses incurred<br \/>\nfor his treatment at New York. As rightly pointed out by the<br \/>\nlearned senior\tcounsel for  the appellant,  no attempt\t was<br \/>\nmade by\t the Respondent-Corporation to produce evidence oral<br \/>\nor documentary to the effect that the facility was available<br \/>\nin India.  Even otherwise,  the view taken by the High Court<br \/>\nthat the  appellant never  informed the respondent about his<br \/>\ngoing to  New York  for treatment  and he  cannot burden the<br \/>\nCorporation with  the  expenses\t for  treatment\t in  foreign<br \/>\ncountry, is  not  correct.  Nothing  prevented\tthe  injured<br \/>\nperson from  taking the best available medical facilities to<br \/>\nrecover from  the disabilities\tcaused by the tortfeasor. We<br \/>\nhave already noticed that the appellant was 25 years old and<br \/>\nwas a student of M.L. Course at the time of the accident and<br \/>\nhe could  not  complete\t the  M.L.  Course  because  of\t the<br \/>\naccident and  permanent disability  he has  sustained in the<br \/>\naccident. The  Tribunal has  found that he would have earned<br \/>\nat least  Rs. 1,000\/-  a month as a practioner in law at the<br \/>\nbeginning stage.\n<\/p>\n<p>     We can  usefully  refer  at  this\tstage  to  a  recent<br \/>\njudgment of this Court in Shashendra Lahri Vs. UNICEF &amp; Ors.<br \/>\n[(1197) 11  SCC 446].  In that case, a 17 year old boy and a<br \/>\nstudent of  B. Com.,  suffered multiple\t injuries in a motor<br \/>\naccident which\toccurred on  6.1.77. He\t suffered  permanent<br \/>\ndisability of  shortening his  right leg by three inches. It<br \/>\nwas also  noticed that\tthe injured thereafter continued his<br \/>\neducation and  has a  good academic  career. The Tribunal in<br \/>\nthat case  awarded a sum of Rs. 33,000\/- only as against the<br \/>\nclaim of  Rs. 6,  00,000\/-  .  On  appeal,  the\t High  Court<br \/>\nenhanced the amount to Rs. 58, 000\/-. This Court, on further<br \/>\nappeal, was of the view that having regard to the age of the<br \/>\nappellant at  the time of accident and the prospects in view<br \/>\nof his\tgood academic  career, the  adverse  effect  of\t his<br \/>\npermanent disability  as a  result of  the motor accident on<br \/>\nhis future prospects, is much more than that assessed by the<br \/>\nHigh Court.  On that  basis, this court awarded\t further sum<br \/>\nof Rs.\t4 lakhs\t in addition  to that  awarded by  the\tHigh<br \/>\nCourt.\n<\/p>\n<p>\t\t    [Emphasis supplied]<br \/>\n     Applying the above principle to the facts of this case,<br \/>\nwe find\t no difficulty\tin awarding  a sum of Rs. 3 lakhs in<br \/>\naddition to  that awarded  by the  Tribunal confirmed by the<br \/>\nHigh Court.  This enhanced  amount of compensation will bear<br \/>\ninterest at  the rate of 12% p.a. from the date of the claim<br \/>\npetition till the date of payment.\n<\/p>\n<p>     The appeal is accordingly allowed. No costs.<br \/>\n     Civil Appeal No. 13385\/96:\n<\/p>\n<p>     This appeal  is preferred\tagainst the  order in Review<br \/>\nPetition in  M.F.A. No.\t 712\/90. In  view of the disposal of<br \/>\nthe appeal  against the\t M.F.A.
