DEWDHA,\n                       JAYNAGAR\n                                        ...RESPONDENTS\n                                          -----------\n<\/pre>\n<p>02.   11.04.2011              Heard counsel for the parties.<\/p>\n<p>                              Petitioner claims to be privileged tenant under the<\/p>\n<p>                   Bihar Privileged Homestead Tenancy Act (hereinafter referred to<\/p>\n<p>                   as the &#8216;Act&#8217;). Purcha(s) under the aforesaid Act in respect of<\/p>\n<p>                   three and odd dhurs of land appertaining to khata no.279 (new),<\/p>\n<p>                   khesra no.1271(new) of village Inarwa Goth, Anchal Jaynagar in<\/p>\n<p>                   the district of Madhubani was\/were settled by Annexure-1.<\/p>\n<p>                              It is the stand of the petitioner that while<\/p>\n<p>                   constructing   a road under the Mukhya Mantri Gram Sadak<\/p>\n<p>                   Yojna, part of the land measuring about two kathas are being<\/p>\n<p>                   encroached upon by respondents 6 and 7 who are the executing<\/p>\n<p>                   agents of the said road. The petitioner moved the Respondent-<\/p>\n<p>                   D.C.L.R. Jaynagar raising the aforesaid grievance which was<\/p>\n<p>                   treated as case no. 03\/10-11 wherein by a communication dated<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>     20.08.2010 (Annexure-8)            report was called for from the<\/p>\n<p>     Respondent-Anchal Adhikari, Jaynagar and till               further<\/p>\n<p>     consideration status quo in respect of the said land was directed<\/p>\n<p>     to be maintained. It is the stand of the petitioner that the said<\/p>\n<p>     matter is still pending before the said authority inasmuch as the<\/p>\n<p>     petitioner had to again file a fresh application (Annexure-9) in<\/p>\n<p>     the said proceeding.\n<\/p>\n<p>                    Learned counsel for the petitioner submits that he<\/p>\n<p>     would be satisfied if respondent no.3 be directed to dispose of<\/p>\n<p>     the said proceeding in accordance with law within a reasonable<\/p>\n<p>     time.\n<\/p>\n<p>                    Learned A.C. to G.P.II, in view of aforesaid stand<\/p>\n<p>     taken by the petitioner, does not object.<\/p>\n<p>                    Having heard the parties and after going through the<\/p>\n<p>     materials on record, this application is disposed of by the<\/p>\n<p>     following order:\n<\/p>\n<p>                       Let the petitioner approach the Respondent-<br \/>\n        Deputy Collector, Land Reforms, Jaynagar and file            an<br \/>\n        application attaching therewith copy of the present order<br \/>\n        within three weeks whereafter the said authority shall dispose<br \/>\n        of the pending        eviction case no. 03\/10-11(Rudra Narain<br \/>\n        Yadav vs. Vishambhar Purvey &amp; Ors.) in accordance with<br \/>\n        law       expeditiously    preferably   within 05 weeks of   its<br \/>\n        filing.\n<\/p>\n<\/p>\n<p>                                  ( Kishore K.
