The  Police \ufb01led charge sheet against the<\/p>\n<p>  eeenees punishable under Sections 326 and 506<\/p>\n<p> -epic,inteeeiee%%elieging that on 2.4.1998 at Jernboor village. when the<\/p>\n<p>corn&#8217;pieineiniel?W.1-P.N.Mohen was supplying water to his<\/p>\n<p>  V&#8221;vegeta5le_.i\u00a7erden, the accused cerne there in a Tractor and asked<\/p>\n<p>  T:&#8221;&#8216;ine.,coinplainant to allow him to take his Tractor on the pa\ufb02iway te<\/p>\n<p>&#8216; V&#8217;  Haitihole to load sand. At that time, the complainant replied<\/p>\n<p> mat the accused cannot take his Tractor on his pathway as there is<\/p>\n<p>a stay order from the High Court and the case is pending before the<\/p>\n<p>\ufb01e<\/p>\n<p>i  <\/p>\n<p>High Court. At that time, me accused being enraged by the<\/p>\n<p>statement of the complainant, got down from the Tractor, rernoved<\/p>\n<p>the gate across the pathway and took out an iron rod  <\/p>\n<p>Tractor and assaulted the complainant on his left foot;&#8221;&#8216;le\ufb01   K H &#8221; <\/p>\n<p>also on the left cheek causing grievou.ehu&#8217;rt <\/p>\n<p>the complainant with dire consequences: * . __lrrirnAediatelyi,Athe  .,<\/p>\n<p>complainant was taken to the local &#8216;-hcepital.and &#8216;twat-3 Q&#8217;<\/p>\n<p>taken to the District Hoepitel.   e We &#8216;in me District<br \/>\nHospital showed fracture ol&#8217;4&#8243;&#8216;_e_  T hereafter. PW.1<br \/>\nlodged a compiaintihefore   based on which<\/p>\n<p>are Police   Afteivgvinyee\ufb01gation, charge sheet<br \/>\ncame      l&#8221;\n<\/p>\n<p>5 -3.   of-surnmons, the accused appeared before<\/p>\n<p> ,.r_gieV&#8221;:olearhed &#8220;Magistrete&#8221;&#8216;and pleaded not guilty for the charges<\/p>\n<p> o.&#8217;__le&#8217;ve&#8221;_ile&#8212;.1  for the offences punishable under Sections 326<\/p>\n<p>ahd Soe 19\u00a2.&#8217; he claimed to be tried.\n<\/p>\n<p>&#8221;    4. During trial, the prosecution examined the complainant as<\/p>\n<p>l   an eyewihwess-Rudrappa as PW.2. seizure mahazar witness<\/p>\n<p>was PWs.3 and 4, the brother of the complainant who was also<\/p>\n<p>stated to be an eyewitness as PW5. two Police Omcers as PWs.6<\/p>\n<p>and 7 and the Doctor who treated the compiainant as PW.8,&#8230;__&#8217;ihe<\/p>\n<p>prosecution also got marked l&#8217;:&#8217;.xs.P.1 to P.5 and M.0.1. ;  i<\/p>\n<p>5. The learned Session Judge alter<\/p>\n<p>A Q&#8221; hearing both sides, by his judgment under revision dismissed the<\/p>\n<p>AV&#8217;    saidiappeal and upheld the judgement of the learned Magistrate.<\/p>\n<p>&amp;<\/p>\n<p>?. Questioning the legality and correctness of these<\/p>\n<p>judgments, the accused has presented \ufb01nis Revision Petitian.<\/p>\n<p>interalie on the ground that the judgments of the Couns~.belo&#8217;uE4 <\/p>\n<p>erroneous and contrary to the evidence on record,__ &#8216;as tltef\ufb02otrrts _ <\/p>\n<p>below have not properly appreciated themevidence  <\/p>\n<p>prosecution in its proper perspective a\ufb01ndithat ai\u00e9pcaums <\/p>\n<p>have failed to note that the lngredientsiof sectsqns.  of &#8216; A<\/p>\n<p>PC have not been estai)!iashed\u00e9.ra&#8217;nd.p\/ghe iudgrnents of the<br \/>\nCourts below suffer from  are liable to be set<\/p>\n<p>aside.\n<\/p>\n<p> l have &#8216;iieardiithe-learned counsel for the petitioner as weli<\/p>\n<p>as the learned  the State.\n<\/p>\n<p>he learnedicouvnsel for the petitioner contended that the<\/p>\n<p> .__ei:idence&#8221;\u00ab..gn~ mead ciearly indicates that there was some civil<\/p>\n<p>dispute in  of the pathway and order of injunction granted<\/p>\n<p>&#8216;&lt;._by  had been vacated. He further contended that having regard to<\/p>\n<p>*  theiinehzre es weii as the gravity of the offences for which the<\/p>\n<p>T &#8221; &#8220;accused has been found guilt. the sentence of imprisonment for<\/p>\n<p>U three months itself is on me lower side, therefore, there are no<\/p>\n<p>grounds to interfere even with the order of sentence passed by the<\/p>\n<p>gag\/,,-\n<\/p>\n<p>Coors beiow. At that<\/p>\n<p>  accused came there in his Tractor and tried to pass<\/p>\n<p>T  through me pathway by the side of the garden land of the<\/p>\n<p>d it complainant. At that time, the complainant proeeeted and told the<\/p>\n<p>accused that there is a stay order issued by the High Court in<br \/>\nreepectof\ufb011esaidpa&#8221;thway.eseuohnoonecanpessttwoughthe<\/p>\n<p>said pathway. F&#8217;W.1 has further mted. inspllle of the same. the<br \/>\naccused tried to take his Tractor thmugh the pathway and <\/p>\n<p>protested again, the accused with a rod found in<\/p>\n<p>assaulted him (PW.1) on his left leg and left \ufb021igil,__}is..::s   M&#8217; <\/p>\n<p>fell down, immediately, be was shifted ts&#8217;   <\/p>\n<p>5. In the cross-\u00abexamination ofTPW.1k;&#8217;it   <\/p>\n<p>civil suit is filed by his mum: PVlI.5.l:&#8217;\u00a7c\u00a7insth me Gaul l _  the &#8216; %<\/p>\n<p>Court of Civil Judge, sr.on.__ancl   is \ufb01ll-pemilng. It is<br \/>\nfunher elicited from l=vv.1 ih\u00e9 issued by the<br \/>\nCivil Judge. Sr. has  .:o.m at Madiketi.\n<\/p>\n<p>Court Ame; said&#8217; &#8216;lzflspuia.-&#8216; lt is further elicited from PW.1<br \/>\nthat in me  glvil  \ufb01led an af\ufb01davit stating that<br \/>\nthe J  5 sumac road. PW.5-Ponnappa has<\/p>\n<p>.  ewtlencw &#8220;&#8221;&#8221;  of P&#8217;W.1. with regard to the incident&#8217; of<\/p>\n<p>     ed. In the cross~examination of PW.5 it is<\/p>\n<p>elicited tj:asf_fll:aAV.has \ufb01led suit in 05 No.1a&#8217;me94 agairm one<\/p>\n<p>  -Ggargesli  the file of me clvll Judge (Sr.Dn.). ll is further elicited<\/p>\n<p>&#8216;    that me said suitwas filed since Ganah the defendant in<\/p>\n<p>&#8216;    \ufb01aid suit was kansporting sand through that pathway. He has<br \/>\n admlmw that in the said civil suit. the mused has time: an af\ufb01davit<\/p>\n<p>stating that the pathway is a public road. He ms ple\ufb01 his<br \/>\nignorance to rim suggestion mat the accused has a lissnselpemlit<\/p>\n<p>:1<br \/>\nfacts. Under these circumsterrces. in die light of evidence of PW.2.<br \/>\nthere is no dimculty in accepting evidence of F&#8217;Ws. 1 and 5  the<\/p>\n<p>accused came near the scene of occurrence in the Tractor&#8217;erjd<\/p>\n<p>the presenw of me accused at the place of  <\/p>\n<p>Learned counsel for the accused has not crose4e*xarii&#8217;ined::  &#8221; &#8216;V it<\/p>\n<p>Therefore. there is no difficulty in   <\/p>\n<p>widi regard to the presence   <\/p>\n<p>with regard to the actuai incident&#8217;Vi&#8217;io\u00a2t_V&#8217;Vvatr-tsreuitl  accused on<br \/>\nPW.1 . the oral testimony    :5.\n<\/p>\n<p>the same. There are no   B031 the<br \/>\nCourts below praczgtgierelianceeri thefevse\u00e9ncelor PWs.1.2 and 5<\/p>\n<p>have   -that the prosecution has proved<br \/>\nthe inciderrtot   accused on F&#8217;W.1 beyond alt<br \/>\nreaeenabte doubt&#8230; do not see any error committed by the Coum<\/p>\n<p>  tltewsaid \ufb01nding. There are no reason: for<\/p>\n<p> :.tte:r\u00a7r:nege eaid \ufb01nding.\n<\/p>\n<p>14.__A&#8217;3&#8242;:&#8217;-&#8216;rem the facts of the case. the imident of assault<\/p>\n<p>A 4&#8217;    to have miter: place in a heat of passion. As no\ufb01ced<br \/>\n.   though there was no order of injunction in raped of the<br \/>\n said pathway and the injunction came to have been granted bythe<\/p>\n<p>Civil Court had been vacated. the complainant appears to have<br \/>\npreventedtheacousedfrorn prooeedingorittrepathwaytoream<\/p>\n<p>Hattihoie for loading sand. The<br \/>\ncircumstaneaealso  accused was not armed with<\/p>\n<p>weapon no accozdingto  prosecution witnesses, he took out the<\/p>\n<p>i it &#8220;:odiioI:najAin&#8217;i*ae  The incident has occurred on 2.4.1993.<\/p>\n<p>  eiapsed from the date of the incident.\n<\/p>\n<p> these circumstances. the question is as to<\/p>\n<p>whetha:  this length of time. the accused shouid be sent to Jail.<\/p>\n<p>V&#8217; ~TAhe&#8221;Hon&#8217;t&gt;Ie Supreme Court in Naib Singhis case referred to supra,<\/p>\n<p>&#8216;  aiftet aitering the offence for which the accused therein had been<\/p>\n<p>&#8221; &#8220;convicted to one under Sutton 326 has sentermd the accused<\/p>\n<p>therein to undergo imprisonment till the raising of the Court and to<\/p>\n<p>pay a \ufb01ne of Rs.5,000l-. The Hon&#8217;ble Supreme Court while<br \/>\nimposing sentence, in para-&#8216;?, has observed em they were inclined<\/p>\n<p>to take a lenient View having regard to the fact that the <\/p>\n<p>therein was a Teacher in a school and the    <\/p>\n<p>prosecution showed that \ufb01lm incident  place  <\/p>\n<p>the moment. The Supreme   of   ~.\n<\/p>\n<p>incident had occurred about lame basin pruned; \u00abea. c<\/p>\n<p>Lordships observed that did,not iiginkfagiessrabee resend the<br \/>\nappellant back to Jail. in   their Lordships<br \/>\nreduced sentengej\u00e9g. fieaone year awarded<br \/>\nby the High o\u00a2en\u00ab.2olls~e.irm;;nsenrnen\u00a7 an   of the Court.<\/p>\n<p>16.&#8217; Ash&#8217;   facts and circumstancw of he<\/p>\n<p>case. hand aisohrdicavies that this is not a tit mse to send the<\/p>\n<p>VZ&#8217;pee&amp;onerlite_%:Jaii having regard to the fact that the incident has<\/p>\n<p> ago. The evidence on record shows that me<\/p>\n<p>acc&#8217;used.._has.lAected in the heat of moment as he was obw-acted on<\/p>\n<p>dround from proceeding through the pathway to reach<\/p>\n<p>A    for loading sand. in View of the above discussion, I am of<\/p>\n<p>    considered View that the observation of the Horfbie Supreme<\/p>\n<p> Court in die aforesaid decision would squarely apply to the case<\/p>\n<p>and even this is a \ufb01t case vmere the accused should be sentenced<br \/>\nto undergo imprisonment till the raising of the Court and also to pay<\/p>\n<p>gig<\/p>\n<p>fine of Rs.5,000l-. Bom the Courts below have completely<br \/>\noverlooked this aspect of the matter whiie imposing sentence\u00bb in<\/p>\n<p>my considered view, this is an illegality commmed <\/p>\n<p>below vimich rmuirw to be corrected by this Court   <\/p>\n<p>the revisional power under Section Mr &#8216;reed\u00abwii#i ores&#8221;<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>17. Accordingly. Crimir;raI..xF\u00a7ei;ision  in<br \/>\npart.
