MC No.89 of 2010-C\n<\/p>\n<p>                &#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;&#8212;-<br \/>\n                   Dated 28th January 2010<\/p>\n<p>                              Order<\/p>\n<p>      This is a petition filed under Section 482 of the<\/p>\n<p>Code of Criminal Procedure, seeking to have all further<\/p>\n<p>proceedings and FIR in Crime No.995 of 2009, pending<\/p>\n<p>before the Cheranelloor Police Station, quashed. The<\/p>\n<p>petitioners are accused in the above said crime for<\/p>\n<p>having committed the offences punishable under<\/p>\n<p>Ss.498A and 304B read with S.34 IPC.\n<\/p>\n<p>      2. Jisma, the daughter of the 1st respondent was<\/p>\n<p>married to the first petitioner. She died and there was an<\/p>\n<p>allegation that it was due to the cruelty meted out to her<\/p>\n<p>by the inmates of the family of the first petitioner. Based<\/p>\n<p>on the complaint filed by the first respondent, Crime<\/p>\n<p>No.995\/09 was registered. A copy of the F.I.R. is<\/p>\n<p>produced as Annexure A. It is stated that later, due to<\/p>\n<p>the intervention of some well-wishers, the matter was<\/p>\n<p><span class=\"hidden_text\">Cr. MC No.89\/10                  2<\/span><\/p>\n<p>settled between the parties. The first respondent, the<\/p>\n<p>father of the lady, who was the defacto complainant, has<\/p>\n<p>stated that he had no further complaint in the matter and<\/p>\n<p>the matter was settled.\n<\/p>\n<p>      3. I also heard the learned counsel appearing for<\/p>\n<p>the first respondent, who submitted that the matter has<\/p>\n<p>been settled between the parties and that no further<\/p>\n<p>grievance subsists in the matter.\n<\/p>\n<p>      4.   True,   the   offences   disclosed    are   not<\/p>\n<p>compoundable as offences are those punishable under<\/p>\n<p>Ss.498A and 304B read with S.34 IPC.        But, on going<\/p>\n<p>through the allegations, it is found that the allegation of<\/p>\n<p>commission of offence punishable under S.304B may<\/p>\n<p>not be established. Considering the fact that the matter<\/p>\n<p>is concerning the personal rights of the parties, it is felt<\/p>\n<p>that holding the trial will be only a futile exercise.<\/p>\n<p>Accordingly, this petition is allowed. The FIR in Crime<\/p>\n<p>No.995 of 2009, pending before the Cheranelloor Police<\/p>\n<p><span class=\"hidden_text\">Cr.
