Justice K.T.SANKARAN\n\n Dated :13\/01\/2010\n\n O R D E R\n                           K.T.SANKARAN, J.\n              ------------------------------------------------------\n                        B.A. NO. 6344 OF 2009\n              ------------------------------------------------------\n             Dated this the 13th day of January, 2010\n\n\n                                 O R D E R\n<\/pre>\n<p>       The petitioner has filed this Bail Application under Section 438<\/p>\n<p>of the Code of Criminal Procedure seeking for anticipatory bail. It is<\/p>\n<p>stated that the petitioner is an accused in Case No.394 of 2008,<\/p>\n<p>pending before the Chief Metropolitan Magistrate, Kolkata.             The<\/p>\n<p>petitioner states that he had not received any summons. It is stated<\/p>\n<p>that non-bailable warrant was issued by the Court. The petitioner<\/p>\n<p>apprehends arrest in execution of the non-bailable warrant.<\/p>\n<p>       2. A Division Bench of this Court in <a href=\"\/doc\/658859\/\">Madhusoodan v. Supdt.<\/p>\n<p>of    Police<\/a> ((1992(2) KLT 83) held that the Court within whose<\/p>\n<p>jurisdiction the person who apprehends arrest resides can grant an<\/p>\n<p>order under Section 438 of the Code of Criminal Procedure, though<\/p>\n<p>the offence was committed within the territorial jurisdiction of another<\/p>\n<p>High Court.     Learned counsel for the petitioner submits that the<\/p>\n<p>offence alleged against the petitioner is under Section 420 of the<\/p>\n<p>Indian Penal Code.\n<\/p>\n<p>B.A. NO. 6344 OF 2009<\/p>\n<p>                                    :: 2 ::\n<\/p>\n<p>       3. In the facts and circumstances of the case, I am of the view<\/p>\n<p>that the only relief that can be granted to the petitioner is to issue a<\/p>\n<p>direction not to arrest the petitioner in execution of the non-bailable<\/p>\n<p>warrant issued by the Chief Metropolitan Magistrate, Kolkata in Case<\/p>\n<p>No.394 of 2008, for a period of one month from today, so as to<\/p>\n<p>enable the petitioner to move the appropriate court for appropriate<\/p>\n<p>reliefs.\n<\/p>\n<\/p>\n<p>       4.
