Setty Gangadhuja Swamy and others<\/p>\n<p>(Civil Appeals Nos.4413-4414 of<\/a> 2003), SLP(C).No.21472-<\/p>\n<p>73\/2005 (filed by Dr.Anoop) and the decision of this Court in<\/p>\n<p><a href=\"\/doc\/1464149\/\">Indira v. State of Kerala (WP<\/a>(C).No.2483, 7039, 17317 of<\/p>\n<p>2005 and connected cases), in suppression of certain earlier<\/p>\n<p>orders regarding the guidelines for issuing community<\/p>\n<p>certificates to the children borne to inter-caste married<\/p>\n<p>couple of which one of the parents is Scheduled<\/p>\n<p>Caste\/Scheduled Tribe, for educational and employment<\/p>\n<p>benefits, on 20.11.2008, the first respondent State issued<\/p>\n<p>W A.No.566 of 2010.\n<\/p>\n<p><span class=\"hidden_text\">                            -: 2 :-<\/span><\/p>\n<p>Ext.P5 order. Assailing the second condition in Ext.P5, the<\/p>\n<p>appellants preferred WP(C).No.10778\/2009 seeking the<\/p>\n<p>following main relief:\n<\/p>\n<blockquote><p>                &#8220;Issue a writ of certiorari or any other<br \/>\n          appropriate writ, direction or order calling<br \/>\n          for the files leading to the issuance of Ext.P5<br \/>\n          Government Order and quash the 2nd<br \/>\n          condition imposed therein in the matter of<br \/>\n          issuing caste certificate declaring it as<br \/>\n          illegal and unconstitutional.&#8221;<\/p><\/blockquote>\n<p>     2.   The learned Single Judge by the judgment<\/p>\n<p>impugned dismissed the writ petition holding that Ext.P5<\/p>\n<p>order was issued incorporating the declaration made by this<\/p>\n<p>Court and hence unsustainable. Now this appeal.<\/p>\n<p>     3.   We heard the learned counsel appearing for the<\/p>\n<p>appellants and the Government Pleader.<\/p>\n<p>     4.   Though the second condition in Ext.P5 order as<\/p>\n<p>such is assailed, the learned counsel for the appellants<\/p>\n<p>submitted that the appellants are not aggrieved of the<\/p>\n<p>condition in full, but a portion of the condition that before<\/p>\n<p>issuing the certificate, the authorised officer shall ensure<\/p>\n<p>W A.No.566 of 2010.\n<\/p>\n<p>                           -:  3 :-\n<\/p>\n<p>the economic and educational disability alone is assailed.<\/p>\n<p>According to the learned counsel, it is in a way introducing<\/p>\n<p>creamy layer system for issuing community certificate<\/p>\n<p>regarding the status of the Scheduled Caste\/Scheduled<\/p>\n<p>Tribe. On the other other, the learned Government Pleader<\/p>\n<p>submitted that once cross marriage occurs communal<\/p>\n<p>stigma goes and all children borne to those parents are not<\/p>\n<p>automatically entitled to the benefits available to Scheduled<\/p>\n<p>Caste\/Scheduled Tribe children and in the event the parties<\/p>\n<p>to intercaste marriages are affluent and well educated they<\/p>\n<p>are not entitled to the special privileges available to the<\/p>\n<p>Scheduled Caste\/Scheduled Tribe and the State has the<\/p>\n<p>liberty to restrict such benefits to actual deserving persons<\/p>\n<p>and the intent of the condition challenged is only to that<\/p>\n<p>extent. It was also submitted by the learned Government<\/p>\n<p>Pleader that to uplift those who are downtrodden for years,<\/p>\n<p>reservation and other concession for education and<\/p>\n<p>employment are provided and the Government in its<\/p>\n<p>W A.No.566 of 2010.\n<\/p>\n<p>                            -: 4  :-\n<\/p>\n<p>wisdom, taking into account of the cross marriages with<\/p>\n<p>persons belonging to upper caste and affluent families and<\/p>\n<p>their  children    lodging    claims  for  educational    and<\/p>\n<p>employment benefits as against really deserving persons<\/p>\n<p>and defeating them, imposed such condition and it would no<\/p>\n<p>way affect the really eligible parties. It was also submitted<\/p>\n<p>that the appellants were not at all denied certificate in view<\/p>\n<p>of the conditions assigned. We find merit in the submission<\/p>\n<p>made by the learned Government Pleader. The appellants,<\/p>\n<p>who had engaged in cross marriages, have no case that the<\/p>\n<p>conditions imposed in the order impugned had any way<\/p>\n<p>affected their rights or of any deserving children or that any<\/p>\n<p>direction given by this Court or the Apex Court in any of the<\/p>\n<p>decision referred was violated. But, the grievance is that<\/p>\n<p>certain other additional conditions are imposed.       In the<\/p>\n<p>above circumstance, at present, there is no room for any<\/p>\n<p>grievance to the appellants. However, we find that in the<\/p>\n<p>event the appellants apprehend that in future, Ext.P5 would<\/p>\n<p>W A.No.566 of 2010.\n<\/p>\n<p><span class=\"hidden_text\">                            -: 5 :-<\/span><\/p>\n<p>affect their rights adversely, they are at liberty to represent<\/p>\n<p>to the first respondent who shall consider the same on<\/p>\n<p>merits and issue appropriate orders\/modification. We find<\/p>\n<p>no reason to interfere with the judgment impugned. The<\/p>\n<p>appeal is devoid of merit.       Accordingly it is dismissed<\/p>\n<p>reserving the right to approach the State for any<\/p>\n<p>modification of Ext.P5.
