Singh, Senior Advocate.\n      For the State                     : APP.\n                                        -----------\n<\/pre>\n<p>06\/    03.11.2010                   Heard         learned           Counsel           for        the<\/p>\n<p>                          petitioner and learned Counsel for the State.<\/p>\n<p>                                    Earlier        prayer           for    bail           of    this<\/p>\n<p>                          petitioner        was    rejected          on    20th      of    August,<\/p>\n<p>                          2009 in Cr. Misc. No. 22111 of 2009.<\/p>\n<p>                                    The     case    relates          to    murder         of    S.P.<\/p>\n<p>                          Munger      and       three     constables            by    suspected<\/p>\n<p>                          extremists.\n<\/p>\n<p>                                    Submission          is    that        the     petitioner&#8217;s<\/p>\n<p>                          name has come during investigation only on<\/p>\n<p>                          the     basis      of     suspicion             and     except         his<\/p>\n<p>                          confessional statement before police there is<\/p>\n<p>                          no material against the petitioner. There is<\/p>\n<p>                          no      independent            corroboration               from        any<\/p>\n<p>                          independent regarding petitioner&#8217;s complicity<\/p>\n<p>                          in the offence. Other persons under similar<\/p>\n<p>                          circumstances           have       been    admitted         to       bail.<\/p>\n<p>                          Reliance        has     been       placed       on      order        dated<\/p>\n<p>                          12.04.2010        in    Cr.    Misc.        No.10595        of       2010,<\/p>\n<p>                          09.07.2010 in Cr. Misc. No. 22990 of 2010 and<\/p>\n<p>                          27.07.2010        in    Cr.    Misc.       No.    25277         of   2010<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>whereby Sunil Kumar @ Sunil @ Barka Sunil @<\/p>\n<p>Lambu, Raj Kumar Das and Bachandeo Yadav have<\/p>\n<p>been admitted to bail respectively.<\/p>\n<p>         Learned              Counsel    for     the     State      has<\/p>\n<p>submitted that the case of the petitioner is<\/p>\n<p>similar to the case of others who have been<\/p>\n<p>granted bail.\n<\/p>\n<p>         A report has been called for and from<\/p>\n<p>the report it appears that the petitioner is<\/p>\n<p>not being produced so charges has also not<\/p>\n<p>been    framed       as        yet.     The    petitioner      is    in<\/p>\n<p>custody since 19.01.2009.\n<\/p>\n<p>         Considering the facts and circumstances<\/p>\n<p>of the case, let the above named petitioner<\/p>\n<p>be released on bail on furnishing bail bond<\/p>\n<p>of     Rs.   10,000\/-            (ten     thousand)       with      two<\/p>\n<p>sureties       of        the    like     amount       each    to    the<\/p>\n<p>satisfaction             of    the     learned    1st    Additional<\/p>\n<p>Sessions       Judge\/court              concerned,       Munger      in<\/p>\n<p>connection      with           Sessions       Trial     No.   584    of<\/p>\n<p>2009    arising          out     of     Haweli    Kharagpur        P.S.<\/p>\n<p>Case No. 4 of 2005 subject to the following<\/p>\n<p>conditions:\n<\/p>\n<blockquote><p>                     (i) That one of the bailors will<\/p>\n<p>         be a close relative of the petitioner<\/p>\n<p>         who        will        give     an    affidavit       giving<br \/>\n<span class=\"hidden_text\">         3<\/span><\/p>\n<p>genealogy as to how he is related with<\/p>\n<p>the    petitioner      and     the    other      bailor<\/p>\n<p>shall be the brother of the petitioner.<\/p>\n<\/blockquote>\n<p>The Magistrate concerned shall verify<\/p>\n<p>the documents of the petitioner and the<\/p>\n<p>bailors properly so that there is no<\/p>\n<p>confusion about their identity later.<\/p>\n<p>The    bailor    will        also    undertake       to<\/p>\n<p>inform the Court if there is any change<\/p>\n<p>in the address of the petitioner.<\/p>\n<p>        (ii)    That     the    affidavit         shall<\/p>\n<p>clearly state that the petitioner is<\/p>\n<p>not accused in any other case and if he<\/p>\n<p>is he shall not be released on bail.<\/p>\n<p>        (iii)That the bailor shall also<\/p>\n<p>state on affidavit that he will inform<\/p>\n<p>the court concerned if the petitioner<\/p>\n<p>is    implicated    in    any       other   case    of<\/p>\n<p>similar nature after his release in the<\/p>\n<p>present case and thereafter the court<\/p>\n<p>below will be at liberty to initiate<\/p>\n<p>the proceeding for cancellation of bail<\/p>\n<p>on the ground of misuse.\n<\/p>\n<p>        (iv)    That     the    petitioner         will<\/p>\n<p>give    an     undertaking          that    he     will<\/p>\n<p>receive the police papers on the given<br \/>\n<span class=\"hidden_text\">                     4<\/span><\/p>\n<p>            date and be present on date fixed for<\/p>\n<p>            charge and if he fails to do so on two<\/p>\n<p>            given dates and delays the trial in any<\/p>\n<p>            manner, his bail will be liable to be<\/p>\n<p>            cancelled for reasons of misuse.<\/p>\n<p>                    (v)That the petitioner will be<\/p>\n<p>            well represented on each date and if he<\/p>\n<p>            fails   to   do   so   on   two   consecutive<\/p>\n<p>            dates, his bail will be liable to be<\/p>\n<p>            cancelled.\n<\/p>\n<p>                (Shyam kishore Sharma, J.)<br \/>\nkksinha\/-<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Pankaj Ram @ Pratap Ram vs State Of Bihar on 3 November, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
