Justice K.T.SANKARAN\n\n Dated :21\/08\/2009\n\n O R D E R\n                          K.T.SANKARAN, J.\n                  ---------------------------------------------\n                         B.A.No.4701 of 2009\n                  ---------------------------------------------\n              Dated this the 21st day of August, 2009\n\n\n\n                                 ORDER\n<\/pre>\n<p>        This is an application for bail under Section 439 of the<\/p>\n<p>Code of Criminal Procedure. The petitioner is the accused in<\/p>\n<p>Crime No.575 of 2009 of Valapattanam Police Station.<\/p>\n<p>      2.   The offences alleged against the petitioner are under<\/p>\n<p>Sections 354, 506(i), 509 and 328 of the Indian Penal Code.<\/p>\n<p>      3.   The incident occurred on 31.7.2009. The petitioner<\/p>\n<p>was arrested on 4.8.2009 and he was remanded to judicial<\/p>\n<p>custody. It is submitted by the learned Public Prosecutor that the<\/p>\n<p>investigation was completed and the charge was laid on<\/p>\n<p>7.8.2009.\n<\/p>\n<p>      4.   Taking into account the facts and circumstances of the<\/p>\n<p>case, the duration of the judicial custody undergone by the<\/p>\n<p>petitioner, the nature of the offence and the fact that the charge<\/p>\n<p>was laid, I am of the view that bail can be granted to the<\/p>\n<p>petitioner.\n<\/p>\n<p>      The petitioner shall be released on bail on his executing<\/p>\n<p><span class=\"hidden_text\">BA No.4701\/2009                   2<\/span><\/p>\n<p>bond for Rs.25,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the Judicial Magistrate of the First<\/p>\n<p>Class-II, Kannur, subject to the following conditions:<\/p>\n<p>a)   The petitioner shall appear before the Station House<br \/>\n     Officer, Valapattanam Police Station on every Monday<br \/>\n     between 9 A.M. and 11 A.M., for a period of two months;<\/p>\n<p>b)   The petitioner shall not try to influence the prosecution<br \/>\n     witnesses or tamper with the evidence;<\/p>\n<p>c)   The petitioner shall not commit any offence or indulge in<br \/>\n     any prejudicial activity while on bail;<\/p>\n<p>d)   In case of breach of any of the conditions mentioned above,<br \/>\n     the bail shall be liable to be cancelled.<\/p>\n<p>     The Bail Application is allowed as above.<\/p>\n<p>                                              K.T.SANKARAN,<br \/>\n                                                  JUDGE<br \/>\ncsl<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Keeri Aneesh vs The Station House Officer on 21 August, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4701 of 2009() 1.
