Shekhawat,                 Advocate,         for\n                   the petitioner.\n\n                   Mr. Jai Parkash               Sharma,       Advocate,\n                   respondent No.1.\n\n                   Mr.    Narender    Sura,    Assistant\n                   Advocate   General,    Haryana,   for\n                   respondent No.2.\n\n\n                                .      .     .\n\nAJAI LAMBA, J (Oral)\n\n                  This     petition        has      been     filed       under\n\nSection     482      Cr.P.C.         for     quashing        Order       dated\n\n<\/pre>\n<p>22.4.2003 passed by the Chief Judicial Magistrate,<\/p>\n<p>Rewari, summoning the petitioner and order passed by<\/p>\n<p>the Revisional Court dated 17.9.2004 (Annexure P-3).<\/p>\n<p>                  The      only        allegation           against            the<\/p>\n<p>petitioner is contained in Para 6 of the complaint<\/p>\n<p>and is to the following effect:-\n<\/p>\n<blockquote><p>                  &#8220;That the accused by conniving with each other and with<br \/>\n                  illegal intention and with a view to fulfil the common<br \/>\n                  object, came to village Jatuwas after 5.00 O&#8217;Clock in the<br \/>\n                  evening on 24.1.2001 and threatened Hukam Chand, father<br \/>\n                  of the complainant and his mother Leela Devi and his wife<br \/>\n                  Murti Devi that they would demolish the house of the<br \/>\n                  complainant and if they raised any obstruction, they would<br \/>\n Crl. Misc. No. M-47800 of 2004                                           [2]<\/p>\n<p>                  be crushed under the Jeep. On the spot, all the accused after<br \/>\n                  conniving, got the house of the complainant demolished<br \/>\n                  illegally by using hammers and in this demolition accused<br \/>\n                  No.3 to 5 demolished the house of the complainant as per<br \/>\n                  the instructions of accused No.1and 2. Accused No.6 took<br \/>\n                  out his pistol and threatened that nobody should come near<br \/>\n                  them and if anybody comes near them or causes obstruction<br \/>\n                  in the demolition of the house, he would shoot him.<br \/>\n                  Accused No.7 was showing his lathi&#8230;.&#8221;<\/p><\/blockquote>\n<p>                  In nutshell, as against the petitioner<\/p>\n<p>who    has     been     arrayed         as     accused        No.6      in        the<\/p>\n<p>complaint, allegation is that all the accused after<\/p>\n<p>conniving        got      the      house        of      the       complainant<\/p>\n<p>demolished illegally by using hammers and in this<\/p>\n<p>demolition, as per instructions of accused Nos.1 and<\/p>\n<p>2, accused No.6 (petitioner) took out his pistol and<\/p>\n<p>threatened that nobody should come near them and if<\/p>\n<p>anybody comes near them or causes obstruction in the<\/p>\n<p>demolition of the house, he would shoot him. Accused<\/p>\n<p>Nos.1 and 2 in the complaint are Block Development &amp;<\/p>\n<p>Panchayat       Officer,         Rewari      Block,     and      Bimla       Rani,<\/p>\n<p>Sarpanch, Gram Panchayat, Jatuwas, District Rewari.<\/p>\n<p>                  Learned         counsel        for       the       petitioner<\/p>\n<p>contends      that     the       petitioner,         who    was      posted        as<\/p>\n<p>Assistant Sub Inspector at that point in time, was<\/p>\n<p>on duty under orders of his senior officers to give<\/p>\n<p>assistance       to    the       Block       Development         &amp;   Panchayat<\/p>\n<p>Officer for removal of unauthorised construction. In<\/p>\n<p>this regard, reference has been made to Annexures<\/p>\n<p>P-4, P-5 and P-6.\n<\/p>\n<p>                  Learned counsel has further pointed<\/p>\n<p>out that the respondent-complainant has no regard<\/p>\n<p>for     law      in    so        much     as      after        unauthorized<br \/>\n Crl. Misc. No. M-47800 of 2004                                        [3]<\/p>\n<p>construction had been removed on 24.1.2001, the<\/p>\n<p>encroachment was made during the same night and<\/p>\n<p>FIR had to be lodged. FIR has been placed on<\/p>\n<p>record as Annexure P-7.\n<\/p>\n<p>                   The     other       argument       of     the     learned<\/p>\n<p>counsel       is    that       the     petitioner       was      acting        in<\/p>\n<p>discharge of his official duties and cognizance<\/p>\n<p>could be taken only after taking sanction of the<\/p>\n<p>authorities.\n<\/p>\n<p>                   I have considered the issue.\n<\/p>\n<p>                   It     is      not       in   dispute         that          the<\/p>\n<p>allegations against the petitioner are only to<\/p>\n<p>the effect noticed above. Gist of the allegations<\/p>\n<p>indicates that the petitioner was acting on the<\/p>\n<p>asking      of     the     Block        Development          &amp;    Panchayat<\/p>\n<p>Officer who has been arrayed as accused No.1 in<\/p>\n<p>the complaint.\n<\/p>\n<p>                   Perusal        of     Annexure        P-4      indicates<\/p>\n<p>that vide Memo No.5264 dated 16.1.2007, the Block<\/p>\n<p>Development &amp; Panchayat Officer asked the Station<\/p>\n<p>House Officer, Police Station, Sector 3 (Model<\/p>\n<p>Town), Rewari as under:-\n<\/p>\n<blockquote><p>                         &#8220;On the aforementioned subject, you are requested<br \/>\n                   that kindly grant police help at 10.00 AM on 17.1.2000 to<br \/>\n                   remove the illegal encroachment of Rajnder son of Hukam<br \/>\n                   and Mahender son of Hukam Chand from the plots of Sh.<br \/>\n                   Guggan Singh son of Jagat Ram etc. in village Jatuwas, so<br \/>\n                   that the possession may be given.&#8221;\n<\/p><\/blockquote>\n<pre>                   On     the        same    memo,        there       is        an\n\nendorsement          by     the       Inspector\/         Station        House\n Crl. Misc. No. M-47800 of 2004                                      [4]\n\n\n\n<\/pre>\n<blockquote><p>Officer, Police Station, Model Town, Rewari to<\/p>\n<p>the effect that &#8220;ASI Jagat Singh to comply with&#8221;\n<\/p><\/blockquote>\n<p>i.e. petitioner.\n<\/p>\n<pre>                  Annexure         P-5     is    a   rapt    entered      at\n\nSerial      No.16        in      Police    Station,         Model     Town,\n\n<\/pre>\n<p>Rewari, to the effect that the Block Development<\/p>\n<p>&amp;     Panchayat         Officer     had     come      to     the    police<\/p>\n<p>station and as per order dated 16.1.2001, the<\/p>\n<p>possession         of      plots    allotted         to    Harijans       was<\/p>\n<p>required       to     be      restored      and      encroachment         was<\/p>\n<p>required to be removed. The petitioner alongwith<\/p>\n<p>Ram      Nath,       Head         Constable;          Niaz     Mohammed,<\/p>\n<p>Constable        and       Hawa    Singh,       Constable      left       for<\/p>\n<p>Jatuwas for help with the Block Development &amp;<\/p>\n<p>Panchayat Officer.\n<\/p>\n<pre>                  Annexure         P-6     is    a   Rapt    entered      at\n\nSerial       No.17         in     the     police          station     which\n\n<\/pre>\n<p>indicates that at about 5.30 P.M., the petitioner<\/p>\n<p>alongwith other officials returned after giving<\/p>\n<p>police       help       in       village        Jatuwas.      The     Block<\/p>\n<p>Development &amp; Panchayat Officer had done his job<\/p>\n<p>at the spot.\n<\/p>\n<p>                  Considering               the            facts          and<\/p>\n<p>circumstances that flow from the Annexures, it<\/p>\n<p>becomes evident that the petitioner was directed<\/p>\n<p>by the Inspector\/ Station House Officer, Sector &#8211;<\/p>\n<p>3, Rewari, to comply with order Annexure P-4. In<br \/>\n Crl. Misc. No. M-47800 of 2004                                           [5]<\/p>\n<p>compliance of the order, the petitioner left the<\/p>\n<p>police station as is reflected from Annexure P-5<\/p>\n<p>and after completing the task returned back to<\/p>\n<p>the police station as is made out from a perusal<\/p>\n<p>of order, Annexure P-6. It is not in dispute that<\/p>\n<p>no injury had been caused by the petitioner to<\/p>\n<p>any person.\n<\/p>\n<p>                   The        only        logical      conclusion              that<\/p>\n<p>flows from perusal of the documents is that the<\/p>\n<p>petitioner was discharging his official duties.<\/p>\n<p>The encroachment was required to be removed under<\/p>\n<p>orders passed by a competent authority. It was on<\/p>\n<p>an application made by the Block Development &amp;<\/p>\n<p>Panchayat          Officer         that     police      help       was     given<\/p>\n<p>seemingly not only to protect the officer who was<\/p>\n<p>required to execute the job but also to ensure<\/p>\n<p>that     obstruction             is    removed        and    the     original<\/p>\n<p>owners       are     put      in      possession.       This       being        the<\/p>\n<p>factual       position,            I    find     that       the     complaint<\/p>\n<p>against        the     petitioner               has    been       filed         for<\/p>\n<p>malafide       reasons.            Even    if    all    the       allegations<\/p>\n<p>made in the complaint are accepted, no offence<\/p>\n<p>can     be    said       to      have      been       committed       by        the<\/p>\n<p>petitioner.          The      petitioner          was       bound    by        his<\/p>\n<p>official commitment to protect the officials and<\/p>\n<p>also ensure that work of removal of encroachment<\/p>\n<p>was carried out. In my considered opinion, the<br \/>\n Crl. Misc. No. M-47800 of 2004                                       [6]<\/p>\n<p>complainant          being       aggrieved     by    the       removal       of<\/p>\n<p>encroachment          was        agitated    and     so        as   to     put<\/p>\n<p>pressure        on     the       authorities,        has        filed      the<\/p>\n<p>complaint. It becomes evident that it is only so<\/p>\n<p>as to harass the petitioner that the complaint<\/p>\n<p>has been filed. Continuance of such proceedings<\/p>\n<p>would result in demoralising the public servant<\/p>\n<p>who has merely performed his official function.<\/p>\n<p>So as to prevent abuse of process of Court by the<\/p>\n<p>complainant,          the        prayer   made      in    the       petition<\/p>\n<p>deserves to be allowed.\n<\/p>\n<p>                  On the other count also, I find that<\/p>\n<p>cognizance could be taken by the Magistrate only<\/p>\n<p>after      grant      of     sanction.        The    petitioner            was<\/p>\n<p>discharging          his    official        duties       and    under      the<\/p>\n<p>circumstances,              sanction         was     required              from<\/p>\n<p>appropriate authorities before taking cognizance.<\/p>\n<p>This having not been done, the proceedings as<\/p>\n<p>against the petitioner are required to be quashed<\/p>\n<p>as they are rendered without jurisdiction.<\/p>\n<p>                  In view of the above, this petition<\/p>\n<p>is allowed.
