Justice V.GIRI\n\n Dated :03\/07\/2009\n\n O R D E R\n                               V.GIRI,J.\n                       -------------------------\n                  W.P ( C) No. 16647 of 2009\n                       --------------------------\n                  Dated this the 3rd July,2009\n\n                         J U D G M E N T\n<\/pre>\n<p>     Petitioner, a trust, has established a Medical<\/p>\n<p>College, which is yet to be recognized by the Medical<\/p>\n<p>Council of India. Initially, the competent authority of the<\/p>\n<p>Government of Kerala had issued Essentiality Certificate<\/p>\n<p>in relation to the petitioner&#8217;s institution for 100 seats, as<\/p>\n<p>evidenced by Exhibit-P1.          Based on the same, the<\/p>\n<p>University had granted an affiliation, as evidenced by<\/p>\n<p>Exhibit-P2. The Medical Council inspected the facilities<\/p>\n<p>in December 2008 and found deficit in the facilities.<\/p>\n<p>     2.    Petitioner,     apparently           addressed the<\/p>\n<p>inadequacies pointed out by the Medical Council. A fresh<\/p>\n<p>inspection was conducted in May 2009 and it was found<\/p>\n<p>that the facilities are still inadequate for an intake of 100<\/p>\n<p>seats.\n<\/p>\n<p>     3.    In the meanwhile at the petitioners instance,<\/p>\n<p>the Government of Kerala had issued an Essentiality<\/p>\n<p>W.P ( C) No. 16647 of 2009<br \/>\n<span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>certificate for 150 seats, as evidenced by Exhibit-P4 which<\/p>\n<p>has been forwarded to the Medical Council of India. This<\/p>\n<p>writ petition has been filed praying for a direction to the<\/p>\n<p>Medical Council of India to reinspect the petitioner&#8217;s<\/p>\n<p>college, for the purpose of granting an approval for the<\/p>\n<p>year 2009.\n<\/p>\n<p>      4.    The Medical Council has filed a statement,<\/p>\n<p>contending that inspection conducted twice revealed that<\/p>\n<p>the facilities offered by the petitioner are inadequate even<\/p>\n<p>for an intake of 100 seats. A time schedule which was fixed<\/p>\n<p>as per the regulations contemplates      the Medical Council<\/p>\n<p>giving    its recommendations qua any institution on or<\/p>\n<p>before the 15th of June 2009,<\/p>\n<p>      5.    Today, Mr.Alexabnder Thomas, learned standing<\/p>\n<p>counsel for the 3rd respondent       brings to my notice a<\/p>\n<p>communication issued by the Government of India<\/p>\n<p>requiring    the    Medical    Council    to   inspect  new<\/p>\n<p>Medical\/Dental colleges including cases of increase of<\/p>\n<p>seats in existing colleges for the purpose of giving its<\/p>\n<p>recommendation to the Central Government. The last date<\/p>\n<p>W.P ( C) No. 16647 of 2009<br \/>\n<span class=\"hidden_text\">                                 3<\/span><\/p>\n<p>for   doing   so    has   been    extended   to   8.7.2009.<\/p>\n<p>Recommendations are to reach the Central Government<\/p>\n<p>latest by 10\/7\/2009. Pursuant thereto petitioner&#8217;s college<\/p>\n<p>has been again inspected on 2.7.2009.
