Since this is very old<br \/>\nmatter, the same is taken up for hearing today.\n<\/p>\n<p>3.\tThe<br \/>\nrespondent workman was serving as Driver in Ahmedabad Division of the<br \/>\npetitioner Corporation. A chargesheet was issued to the respondent<br \/>\nalleging that while on duty one pedestrian was knocked down and later<br \/>\non he succumbed to the injuries. After conducting departmental<br \/>\ninquiry  a punishment was imposed upon the respondent withholding of<br \/>\nannual increments for a period of three years with future cumulative<br \/>\neffect. The respondent filed an appeal  before the appellate<br \/>\nauthority who reduced the punishment to withholding of annual<br \/>\nincrement for a period of two years with cumulative effect. Against<br \/>\nthe said order Reference (IT) No.208 of 1989 came to be instituted<br \/>\nwherein the Tribunal reduced the punishment  to withholding of two<br \/>\nincrements with non-cumulative effect.\n<\/p>\n<p>4.\tHeard<br \/>\nthe learned Advocate for the petitioner and perused the documents on<br \/>\nrecord. During the service of  31 years  there were only two lapses<br \/>\non the part of the respondent. The Tribunal had taken into consider<br \/>\nall the aspects of the matter and reached to a conclusion that<br \/>\nwithholding increments with future effect is harsh. I am also of the<br \/>\nview that the looking to the negligence the punishment imposed by the<br \/>\nTribunal is just and proper. In any case keeping in mind the lapse of<br \/>\n17 years it would not be appropriate to disturb the findings of the<br \/>\nIndustrial Tribunal at this stage.
