Kamla Arya &amp; Anr Versus State &amp; Ors.\n<\/p>\n<p>4- 10464\/2010 (3830\/10) Virendra Singh Versus State &amp; Ors.\n<\/p>\n<pre>\t               Date of Order     :::        02\/08\/2010\n\n\t\t                   Hon'ble Mr. Justice Ajay Rastogi \n\nSarva Shri Mukesh Poonia, Kartar S.Faujdar,\n&amp; Sanjay Mehla, for petitioners \n\n<\/pre>\n<p>\t\tCounsel jointly submit that instant petitions relate to transfer of Teachers, who are members of Rajasthan Panchayati Raj Service Rules, 1996 and have been transferred under the Scheme of Rationalization introduced by the Government within same Panchayat Samiti from one institution to the other.\n<\/p>\n<p>\t\tIt has been informed that in the light of judgment dt.13\/07\/2010 delivered at main seat Jodhpur in Badur Ram Khileri Vs. State &amp; Ors (S.B.Civil Writ Petition-5784\/2010 &amp; 69 other connected writ petitions), State Government vide order dt.22\/07\/2010 has taken decision to withdraw such transfers of Primary School Teachers\/petitioners who have been transferred within Panchayat Samiti.\n<\/p>\n<p>\t\tIn the light of the decision taken by the respondent-State, (supra), instant writ petitions alongwith stay petitions as per Schedule appended herewith relating to transfer of petitioners within Panchayat Samiti by State Government, stand allowed and their respective transfers are hereby quashed &amp; set aside and the respondent-State is directed that all such petitioners who are affected on being transferred within same Panchayat Samiti may now be restored to their respective position without any further delay.
