On July 1, 1968,  appeals\nwere filed in the High Court by the appellant (cornplainant)\nbut the High Court held that they were barred by art. 114 of\nthe  Limitation Act, 1963.  In appeal to this Court, it\t was\ncontended  that\t the  appeals were filed not  under  s.\t 417\nCr.P.C, but under s. 624B of the Companies Act.\nHELD:(1) Section 404, Cr.P.C., provides that no\t appeal\nshall  lie  from  any order of a criminal  court  except  as\nprovided by the Code or by any other law for the time  being\nin  force.  But s. 624B does not confer any right of  appeal\nfrom  an  order of acquittal passed by a criminal  court  in\nrespect of an offence under the Companies Act.\tIt only em-\npowersthe Central Government to present appeals\t through\npersons mentioned in that section. [1861 E-G]\n(2)  Section 417, Cr.P.C.. provides right of appeal in cases\nof  acquittal and if the order of acquittal is passed  in  a\ncase  instituted upon complaint, an application for  special\nleave  to appeal from such order should be filed  within  60\ndays from the date of the order of acquittal, and under art.\n114 of the Limitation Act, 1963, the appeal should be  filed\nwithin 30 days from the date of the grant of special  leave.\nThe  appeals  were not rightly entertained  in\tthe  present\ncase,  because\t(a) there was no application  for  grant  of\nspecial leave under s. 417(3), Cr.P.C., (b) the appeals were\nincompetent  without  grant of special leave; and  (c)\tthey\nwere barred by limitation. [860 G-H; 861 H; 862 A-D]\n\n\n\nJUDGMENT:\n<\/pre>\n<p>CRIMINAL  APPELLATE JURISDICTION: Criminal Appeals Nos.\t 248<br \/>\nto 251 of 1968.\n<\/p>\n<p>Appeals from the judgment an order dated August 13, 1968  of<br \/>\nthe Calcutta High Court in Criminal Appeals Nos. 425 to\t 428<br \/>\nof 1968.\n<\/p>\n<p>L.M.  Singhvi and S. P. Nayar, for the appepant\t (in  all<br \/>\nthe appears).\n<\/p>\n<p>The respondent did not appear.\n<\/p>\n<p>The Judgment of the Court was delivered by<br \/>\nRay, J. These appeals are by certificate from the,  judgment<br \/>\ndated 13 August, 1968 of the High Court at Calcutta  holding<br \/>\nthat<br \/>\n8 60<br \/>\nthe  memorandum of appeals from an order of, acquittal\twere<br \/>\nbarred by Article 114 of the Limitation Act, 1963.<br \/>\nThe appeals were directed against orders of acquittal passed<br \/>\nby  the\t Presidency Magistrate, Calcutta on 4  April,  1968.<br \/>\nThe  four  petitions of appeal were presented  in  the\tHigh<br \/>\nCourt on 1 July, 1968 by the learned Advocate authorised  by<br \/>\nthe,  Vakalatnama  executed by the  Assistant  Registrar  of<br \/>\nCompanies,  West  Bengal described as the appellant  in\t all<br \/>\nthe_ petitions.\n<\/p>\n<p>The  Assistant\tRegistrar of Companies,\t West  Bengal  filed<br \/>\npetitions   of\tcomplaint  before  the\t Chief.\t  Presidency<br \/>\nMagistrate,    Calcutta\t   alleging   that    the    certain<br \/>\nofficers\/directors  of the Standard Paint Works (P) Ltd.  of<br \/>\n44  Beadon  Row, Calcutta mentioned therein were  guilty  of<br \/>\noffence for non-compliance with provisions contained in\t the<br \/>\nCompanies  Act, 1956 by reason of default in  filing  Annual<br \/>\nReturn of the Company together with the Annual Accounts\t and<br \/>\nBalance\t sheet.\t Section 210 of the Companies  Act  requires<br \/>\nannual\taccounts  and balance, sheet of the  company  to  be<br \/>\nfiled  within  the time mentioned in the  section.   If\t any<br \/>\nperson\tbeing  a director of the company fails to  take\t all<br \/>\nreasonable  steps to comply with the provisions\t of  section<br \/>\n210,  he  shall, in respect of each offence.  be  punishable<br \/>\nwith imprisonment for a term which may extend to six months,<br \/>\nor  with  fine which may extend to one thousand\t rupees,  or<br \/>\nwith  both.   The  complainant in filing  the  petitions  of<br \/>\ncomplaint prayed for exemption of personal appearance  under<br \/>\nproviso\t to  section 247 of the Code of\t Criminal  Procedure<br \/>\nread with section 621(1)A of the Companies Act.<br \/>\nThe Presidency Magistrate passed the orders of acquittal  in<br \/>\nall the cases.\n<\/p>\n<p>Section\t 417  of the Code of Criminal  Procedure  speaks  of<br \/>\nappeal\t in   case  of\tacquittal.    Sub-section   (3)\t  of<br \/>\nthat:section is as follows<br \/>\n\t      &#8220;If  such an order of acquittal is  passed  in<br \/>\n\t      any  case instituted upon complaint  and\tthe.<br \/>\n\t      High  Court, on an. application made to it  by<br \/>\n\t      the   complainant.  in  this  behalf,   grants<br \/>\n\t      special  leave  to appeal from  the  order  of<br \/>\n\t      acquittal, the complainant may present such an<br \/>\n\t      appeal to the High Court&#8221;.\n<\/p>\n<p>Section\t 417 (4) of the Code of Criminal, Procedure states<br \/>\nthat  no application under sub-section (3) for the grant  of<br \/>\nspecial leave to appeal from an order of acquittal shall  be<br \/>\nentertained  by the High Court after the expiry of  60\tdays<br \/>\nfrom  the date of the order of acquittal.  No 8\t application<br \/>\nwas  made to the High Court in cornpiance with\tsection\t 417<br \/>\n(3) of the Code of Criminal Procedure.\n<\/p>\n<p><span class=\"hidden_text\">\t\t\t    861<\/span><\/p>\n<p>On  behalf  of the appellant it was contended  both  in\t the<br \/>\nHigh,  Court  and  in  this  Court  that  the  appeals\twere<br \/>\npreferred  under  section 624B of the Companies\t Act,  1956.<br \/>\nSection 624B is as follows<br \/>\n\t      &#8220;Notwithstanding\tanything  contained  in\t the<br \/>\n\t      Code of Criminal Procedure, 1898, the  Central<br \/>\n\t      Government  may,\tin any case arising  out  of<br \/>\n\t      this  Act,  direct any company  prosecutor  or<br \/>\n\t      authorise\t any other person either by name  or<br \/>\n\t      by virtue of his office, to present an  appeal<br \/>\n\t      from an order of acquittal passed by any Court<br \/>\n\t      other   than  a  High  Court  and\t an   appeal<br \/>\n\t      presented\t by such prosecutor or other  person<br \/>\n\t      shall be deemed to have been validly presented<br \/>\n\t      to the appellate Court.&#8221;.\n<\/p>\n<p>The contention on behalf of the appellant that the right of<br \/>\nappeal is conferred by section 624B of the Companies Act  is<br \/>\nunacceptable.\tSection\t 624B  only speaks  of\tthe  Central<br \/>\nGovernment directing or authorising any person to present an<br \/>\nappeal from the order of acquittal.\n<\/p>\n<p>Section 417(1) of the Code of Criminal Procedure enacts that<br \/>\nin  case  of acquittal the State Government may\t direct\t the<br \/>\nPublic\tProsecutor to present an appeal to the\tHigh  Court.<br \/>\nSection\t 624B  of  the Companies Act  empowers\tthe  Central<br \/>\nGovernment  to present appeals through persons mentioned  in<br \/>\nthat  section.\t Presentation  of  appeal  by  the   Central<br \/>\nGovernment  is a similar provision to section 417(1) of\t the<br \/>\nCode of Criminal Procedure.\n<\/p>\n<p>Chapter\t XXXI of the Code of Criminal Procedure relates\t to,<br \/>\nappeals.   Appeal  is a creature of statute.  The  right  to<br \/>\nappeal\tis  governed by the Code  of  Criminal\tProcedure.-,<br \/>\nSection 404 of the Code of Criminal Procedure states that no<br \/>\nappeal\tshall lie from any judgment or order of\t a  Criminal<br \/>\nCourt  except  as  provided  for by  the  Code\tof  Criminal<br \/>\nProcedure  or by any other law for the time being in  force.<br \/>\nSection 624B of the Companies Act does not confer any  right<br \/>\nof  appeal  from  any order passed by a\t Criminal  Court  in<br \/>\nrespect of any offence under the provisions of the Companies<br \/>\nAct.   The right to appeal to the High Court in the  present<br \/>\ncases of acquittal is governed by section 417 of the Code of<br \/>\nCriminal Procedure.\n<\/p>\n<p>Article\t 114  of the Limitation Act,  1963  requires  appeal<br \/>\nunder sub-section (3) of section 417 of the Code of Criminal<br \/>\nProcedure  to be filed within 30 days from the date  of\t the<br \/>\ngrant  of  special leave.  No application for the  grant  of<br \/>\nspecial leave to appeal from an order of acquittal was\tmade<br \/>\nwithin 60 days from that order of acquittal.  The orders  of<br \/>\nacquittal were passed on 4 April, 1968.\n<\/p>\n<p><span class=\"hidden_text\">862<\/span><\/p>\n<p>  The  petitions of appeal were presented on 1\tJuly,  1968.<br \/>\nThe  appeals were rightly not entertained by the High  Court<br \/>\nbecause first there was no application for grant of  special<br \/>\nleave-under   section  417(3)  of  the\tCode   of   Criminal<br \/>\nProcedure;  secondly, the appeals were\tincompetent  without<br \/>\ngrant  of  special leave, and thirdly these were  barred  by<br \/>\nlimitation.    An  appeal  under  section   417(3)   against<br \/>\nacquittal  is  competent only when there is  special  &#8216;leave<br \/>\ngranted\t by the High Court.  On obtaining special leave\t the<br \/>\nappeal\tis thereafter filed within 30 days of the  grant  of<br \/>\nleave  to  escape the mischief of the period  of  limitation<br \/>\nunder Article 114 ,.of the Limitation Act, 1963.<br \/>\nA  provision  in the Companies Act which  confers  right  of<br \/>\nappeal\tis  section 483.  It speaks of appeals\tfrom  orders<br \/>\nmade and the decisions given in the matter of winding up  of<br \/>\nthe  companies by the Court and it enacts that such  appeals<br \/>\nshall lie to the same Court to which, in the same manner  in<br \/>\nwhich,\tand  subject to the same  ,conditions  under  which,<br \/>\nappeals lie from any order or decision of the Court in cases<br \/>\nwithin its ordinary jurisdiction.  Section 624B is not\tsuch<br \/>\na  section  which can be said to be conferring a  right of<br \/>\nappeal.\t Section 624B only mentions as to the person through<br \/>\nwhom appeal is presented.\n<\/p>\n<p>The appeals therefore fail and are dismissed.<br \/>\nV.P.S.\t\t\tAppeals dismissed.\n<\/p>\n<p><span class=\"hidden_text\">863<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Asstt.
