\tRULE.\n<\/p>\n
\tMr. M.R. Mengdey, learned Additional Public Prosecutor waives
\n\tservice of rule on behalf of the respondent.\n<\/p>\n
\tThis is
\n\ta petition for anticipatory bail under section 438 of the Code of
\n\tCriminal Procedure is by the  petitioners in connection with a
\n\tcriminal complaint being C.R. No. I-254 of 2007 registered with
\n\tMorbi City Police Station for offences punishable under sections 306
\n\tand  114 of the Indian Penal Code.\n<\/p>\n
\tHeard
\n\tMr.A.M. Dagli, earned advocate for the petitioners and Mr.M.R.
\n\tMengdey, learned Additional Public Prosecutor for the State.\n<\/p>\n
\tHaving
\n\theard the learned advocates appearing on behalf of the respective
\n\tparties and considering the statement of the girl recorded on
\n\t19\/10\/2007, this court is of the prima facie opinion that no role
\n\thas been attributed to the petitioners and the main allegation is
\n\tagainst the original accused No.1 ?  Kamlesh Keshubhai Solanki, the
\n\tapplicants are entitled to anticipatory bail.\n<\/p>\n
\tFor the
\n\tforegoing reasons, the petition is allowed.  In the event of arrest
\n\tof the petitioners in connection with C.R. No.I-254 of 2007
\n\tregistered with Morbi City Police Station,  they  shall be released
\n\ton bail on each of them executing a bond of Rs.10,000\/- [Rupees Ten
\n\tThousand Only] with one surety of the like amount on the following
\n\tconditions that they  shall:\n<\/p>\n
\t[a]\tco-operate
\nwith the investigation and make \tthemselves available for
\ninterrogation whenever and \twherever required.\n<\/p>\n
\t[b]\tshall
\nremain present at the concerned Police Station \ton 8\/9\/2008 between
\n9.00 AM to 3.00 PM;\n<\/p>\n
\t[c]\tshall
\nnot hamper the investigation in any manner nor \tshall directly or
\nindirectly make any inducement, \tthreat or promise to any person
\nacquainted with the \tfacts of the case so as to dissuade them from
\n\tdisclosing such facts to the Court or to any police \tofficer;\n<\/p>\n
\t[d]\tat
\nthe time of execution of bond, furnish their \tresidential address to
\nthe Investigating Officer and \tthe Court concerned and shall not
\nchange the \tresidence till the final disposal of the case or till
\n\tfurther orders;\n<\/p>\n
\t[e]\tnot
\nleave India without the permission of the Court \tand, if holding a
\npassport, they shall surrender the \tsame before the Trial Court
\nwithin a week; and,<\/p>\n
\t[f]\tnot
\nobstruct or hamper the police investigation and \tnot play mischief
\nwith the evidence collected or yet to \tbe collected by the police.\n<\/p>\n
\tIt would
\n\tbe open to the Investigating Officer to file an application for
\n\tremand if he considers it proper and just; and the competent Court
\n\twould decide it on merits.\n<\/p>\n
\tThis
\n\torder will hold good, if the petitioners are  arrested at any time
\n\twithin 90 days from today.  The order for release on bail will
\n\tremain operative only for a period of ten days from the date of
\n\ttheir arrest. Thereafter, it will be open to the petitioners to make
\n\ta fresh application for being enlarged on bail in usual course,
\n\twhich, when it comes up before the competent Court, will be decided
\n\tin accordance with law, having regard to all the attending
\n\tcircumstances and the materials available at the relevant time,
\n\twithout being influenced by the fact that anticipatory  bail was
\n\tgranted.\n<\/p>\n
\tRule is
\n\tmade absolute.  Direct Service is permitted.\n<\/p>\n
