Once the Assessing Officer framed the scrutiny<br \/>\nassessment, such order was taken in revision by the Commissioner<br \/>\nunder section 263 of the Act. After issuing notice and hearing the<br \/>\nassessee, the Commissioner recorded his reasons for revising the<br \/>\norder passed by the Assessing Officer on the ground that the same is<br \/>\nerroneous and prejudicial to the interest of Revenue.\n<\/p>\n<p>3.0\tThe<br \/>\nissue was carried in appeal by the assessee before the Tribunal. The<br \/>\nTribunal struck down the order observing that from the record it<br \/>\nemerges that there were several letters issued by the Assessing<br \/>\nOfficer raising queries which were complied by the assessee. The<br \/>\nassessee was required to file fund flow statement date-wise for the<br \/>\nborrowed amount either with interest or without interest and the<br \/>\ndate-wise amounts advanced by the assessee. The assessee was also<br \/>\nrequired to file a copy of any banakhat or agreement for proposed<br \/>\npurchase of the land for which money was claimed to have been<br \/>\nadvanced to the assessee. It was eventually thereafter the Assessing<br \/>\nOfficer held that the interest expenditure claimed by the assessee<br \/>\ncannot be denied since the assessee had several interest with funds<br \/>\notherwise available. On this issue, the Commissioner formed a<br \/>\ndifferent opinion. However, the Tribunal on facts as well as on the<br \/>\nground that in the notice itself issued by the CIT (Appeals) certain<br \/>\naspects were not included, found that the order was not sustainable.<br \/>\nThe Tribunal recorded that the CIT (Appeals) observed that no<br \/>\nevidence was adduced to show that the advances received from Chennai<br \/>\nparties were utilized interest free loans, however, this issue has<br \/>\nnot been considered by the CIT (Appeals) in the show cause notice.<br \/>\nInter alia on this ground, the Tribunal was pleased to set aside the<br \/>\norder of the Commissioner passed under section 263 of the Income Tax<br \/>\nAct, 1961.\n<\/p>\n<p>4.0\tWe<br \/>\nare broadly in agreement with the Tribunal. The issue is based<br \/>\nprimarily on facts.
