         The complainant in S.T.No.146\/98 on the file of<\/p>\n
the Chief Judicial Magistrate, Kozhikode, is the<\/p>\n
appellant herein.\n<\/p>\n
         2.   The firm represented by its Power of<\/p>\n
Attorney, filed a complaint alleging that the accused had<\/p>\n
issued Ext.P1 cheque for an amount of Rs.30,676\/-; that<\/p>\n
the cheque, on presentation, was dishonoured stating<\/p>\n
“exceeds arrangement”. A notice was sent, which was<\/p>\n
not replied to. Thereafter the complaint was filed.<\/p>\n
         3. The court below found that the issuance of<\/p>\n
the cheque and the service of notice, as contemplated by<\/p>\n
the statute have all been proved by the complainant,<\/p>\n
but nevertheless proceeded to acquit the accused on the<\/p>\n
ground that PW.1, who is stated to be Power of<\/p>\n
Attorney, has not proved his authority to represent the<\/p>\n
complainant or the lodge the complaint on the date on<\/p>\n
which it was lodged. On this basis, the accused was<\/p>\n
CRL.A.No.888 of 2001<\/p>\n
                            :: 2 ::\n<\/p>\n
\nacquitted under Section 255(1) of the Code of Criminal<\/p>\n
Procedure. Hence this appeal by the complainant.<\/p>\n
         4.   Notice was sent to the accused on this<\/p>\n
appeal. After sending notice for several times, service of<\/p>\n
notice was ordered by affixture. There was no<\/p>\n
appearance on behalf of the accused, though service of<\/p>\n
notice has been completed.\n<\/p>\n
         5. I heard learned counsel for the appellant.<\/p>\n
         6. The fact that the cheque was signed and<\/p>\n
issued by the accused and that the cheque was returned<\/p>\n
because of insufficiency of funds in the account and that<\/p>\n
a demand notice had been issued and served on the<\/p>\n
accused are matters found in favour of the complainant<\/p>\n
by the court below. Paragraph 7 of the judgment reads<\/p>\n
as follows:\n<\/p>\n
           “Exhibit   P1 cheque     contains even    the<\/p>\n
      business seal of the accused. There is no specific<\/p>\n
      case for the accused during evidence stage that<\/p>\n
      either his signature was forged or that the<\/p>\n
      contents in the cheque were fraudulently filled up.<\/p><\/blockquote>\n
      The mutually contradictory stand taken by the<\/p>\n
      accused during the evidence stage and in the 313<\/p>\n
CRL.A.No.888 of 2001<\/p>\n
                            :: 3 ::\n<\/p>\n
\n     statement is also eloquent of the hollowness of his<\/p>\n
     case. The accused has not been able to give<\/p>\n
     satisfactory evidence regarding the possession of<\/p>\n
     his   signed   cheque     with  the   complainant.<\/p>\n
     Excepting the bald suggestion that the account<\/p>\n
     books relating to the transaction are not produced,<\/p>\n
     which in the nature of the case I feel unnecessary,<\/p>\n
     accused has not adduced satisfactory evidence to<\/p>\n
     rebut   the   statutory    presumption    regarding<\/p>\n
     consideration. The complaint regarding the non-<\/p>\n
     receipt of the notice does not also appear to be<\/p>\n
     convincing so long as the accused has no case that<\/p>\n
     the address shown in exhibit P4 notice is incorrect.<\/p>\n
     With all these the ultimate fate of the complaint<\/p>\n
     will mainly depend upon the authority of PW1 to<\/p>\n
     represent the firm and give evidence.”<\/p>\n
         7.  Thereafter, the court below proceeded to<\/p>\n
hold that Ext.P8 Power of Attorney, which is seen to<\/p>\n
have been executed on 7.10.1994, cannot confer power<\/p>\n
on PW.1 in such a manner as to enable him to file a<\/p>\n
complaint in 1998. The court below did not accept the<\/p>\n
Notarised Photostat copy of the Power of Attorney,<\/p>\n
which was produced along with the complaint. The said<\/p>\n
Power of Attorney is seen to have been executed by the<\/p>\n
partners of the firm on 7.10.1994. The court below has<\/p>\n

\nnoted that except for the production of a notarised<\/p>\n
Photostat   copy,   no    attempt  was   made   by   the<\/p>\n
complainant to show that the original of the same was<\/p>\n
irretrievably lost or that such a Power of Attorney had<\/p>\n
actually been executed.     It is the correctness of this<\/p>\n
view, which has been challenged in this appeal.<\/p>\n
         8. I am inclined to agree with the submissions<\/p>\n
made by the learned counsel for the appellant. Firstly,<\/p>\n
the notarised copy of the Power of Attorney was<\/p>\n
produced along with the complaint. It is mentioned as<\/p>\n
item No.5 in the list of documents. PW.1 is the Power of<\/p>\n
Attorney examined on behalf of the complainant. There<\/p>\n
is nothing to show that PW1 lacks competence to<\/p>\n
represent the complainant. His evidence was tendered<\/p>\n
on 10.12.1999.     The Notarized copy of the Power of<\/p>\n
Attorney, produced along with the complaint, was not<\/p>\n
marked and no reason is readily discernible from the<\/p>\n
records as regards this.     But I find it noteworthy to<\/p>\n
mention that Ext.P8 Power of Attorney, which was later<\/p>\n
CRL.A.No.888 of 2001<\/p>\n
                           :: 5 ::\n<\/p>\n
\ntendered before the court, makes reference to the 1994<\/p>\n
Power of Attorney and asserts adequate power with<\/p>\n
PW.1. There was no tenable reason not to accept the<\/p>\n
version of PW.1 that the original of the said Power of<\/p>\n
Attorney, Notarized copy of which was produced along<\/p>\n
with the complaint was actually lost. If that be so, the<\/p>\n
existence of adequate power with PW.1 to have<\/p>\n
represented the complainant firm when the complaint<\/p>\n
was lodged in 1991, should not have been disputed or<\/p>\n
doubted by the court below.\n<\/p>\n
        9. All the others aspects, which would go to<\/p>\n
show that the accused is guilty, have been discussed and<\/p>\n
found   in   favour   of  the     complainant. In  these<\/p>\n
circumstances, I am of the view that the order of<\/p>\n
acquittal is unsustainable.\n<\/p>\n
        Accordingly, the appeal is allowed. The order<\/p>\n
of acquittal is set aside. The accused is convicted for<\/p>\n
the offence under Section 138 of the Act.         He is<\/p>\n
sentenced to pay a fine of Rs.32,000\/-, in default of<\/p>\n
CRL.A.No.888 of 2001<\/p>\n
                             :: 6 ::\n<\/p>\n
\nwhich he shall undergo simple imprisonment for a<\/p>\n
period of three months.         The accused is granted 4<\/p>\n
months’ time to pay the fine.        The court below shall<\/p>\n
proceed to take appropriate steps to see that the<\/p>\n
sentence is executed. As and when the fine amount is<\/p>\n
deposited, an amount of Rs.31,000\/- (Rupees Thirty One<\/p>\n
thousand only) shall be paid out of the same to the<\/p>\n
complainant as compensation under Section 357 of the<\/p>\n
Code of Criminal Procedure.\n<\/p>\n<\/p>\n
