Das, Adv. with\n                                              Mr. Raja Basu Chowdhury, Adv.\n                                                        ..for the appellant\n                                                 Mr. Sanjay Saha, Adv. with\n                                            Mr. Subhamay Bhattacharya, Adv.\n                                                       ..for the respondent<\/pre>\n<p>         Let there be an order in terms of prayer (a) of the application.<\/p>\n<p>         Mr.   Saha    Roy,   learned    Advocate    appearing    for   the<\/p>\n<p>respondent\/award-holder does not want to file any affidavit-in-<\/p>\n<p>opposition. He submits that the statement and averment made in the<\/p>\n<p>application for interim relief is reproduction of the statements and<\/p>\n<p>averments made in the supplementary affidavit filed before the learned<\/p>\n<p>Trial Judge as regards the cause for non-filing of the application within<br \/>\n<span class=\"hidden_text\">                                     2<\/span><\/p>\n<p>the prescribed period of limitation. Before the Learned Trial Judge<\/p>\n<p>statement was made on oath that the petitioner&#8217;s father was treated in<\/p>\n<p>Velore. When document was asked for by the Learned Trial Judge,<\/p>\n<p>supplementary affidavit was filed wherein it was stated that his father<\/p>\n<p>was not treated in Velore, he was shifted to Mumbai. Now, in the stay<\/p>\n<p>petition it is stated that the petitioner&#8217;s father was neither treated in<\/p>\n<p>Velore nor in Mumbai and those statement before the learned Trial<\/p>\n<p>Judge are now abandoned and it appears in this petition that the<\/p>\n<p>petitioner&#8217;s father was treated all along in Kolkata.<\/p>\n<p>         We find that this kind of frequently changing stand with regard<\/p>\n<p>to the explanation of delay always generates suspicion in the mind of<\/p>\n<p>the Court to accept the story. We therefore find, as rightly submitted by<\/p>\n<p>Mr. Saha Ray, the Learned Trial Judge was not unjustified to refuse to<\/p>\n<p>condone the delay howsoever time is sought.\n<\/p>\n<p>         We, going by the reasoning of the Learned Trial Judge, do not<\/p>\n<p>think that the Learned Trial Judge passed any improper order. But, we<\/p>\n<p>are of the view that dismissal on that ground does not destroy the<\/p>\n<p>petitioner&#8217;s right altogether and it is always open to the litigant to come<\/p>\n<p>up with true and correct fact later on with supporting document before<\/p>\n<p>the Court. The real explanation is the illness of the father, who later lost<\/p>\n<p>his voice despite treatment, the documents are annexed to support the<\/p>\n<p>case of treatment. The venue of the treatment was not correctly<br \/>\n<span class=\"hidden_text\">                                       3<\/span><\/p>\n<p>disclosed before the Court, hence the case of illness was rendered<\/p>\n<p>unbelievable and unacceptable altogether.\n<\/p>\n<p>         Therefore, we think that when the real story has been brought<\/p>\n<p>at a later stage we cannot destroy the right of the appellant for good to<\/p>\n<p>challenge the order under Section 34 of the Arbitration and Conciliation<\/p>\n<p>Act, 1996.\n<\/p>\n<p>         Mr.   Saha,   of   course,       while   opposing   strenuously   this<\/p>\n<p>application expressed doubt whether this kind of submission can be<\/p>\n<p>accepted by Court or not. We think that considering the health of the<\/p>\n<p>father of the petitioner, who lost his voice unfortunately, we accept that<\/p>\n<p>explanation of illness. Therefore, we set aside the impugned judgment<\/p>\n<p>and order and condone the delay.\n<\/p>\n<p>         This order, however, is passed subject to payment of cost<\/p>\n<p>assessed at Rs.10,000\/- to be paid to the contesting respondent within<\/p>\n<p>a fortnight from the date of receipt of a copy of this order. Once this cost<\/p>\n<p>is paid, the aforesaid order will revive, failing which, this order will<\/p>\n<p>stand recalled and the application in the appeal will stand dismissed.<\/p>\n<p>         In the event costs is paid, the Hon&#8217;ble Trial Judge will proceed<\/p>\n<p>with the hearing of the matter on merit as affidavits are completed in<\/p>\n<p>this matter. We desire that the application should be heard out within a<\/p>\n<p>period of three months from the date of communication of this order.<br \/>\n<span class=\"hidden_text\">                                           4<\/span><\/p>\n<p>               Leave is granted to the parties to take proper direction, as they<\/p>\n<p>      will be advised and it will be open for the Learned Trial Judge to<\/p>\n<p>      consider such prayer.\n<\/p>\n<p>               The appeal and the application both stand disposed of<\/p>\n<p>      dispensing with all formalities.\n<\/p>\n<p>               Urgent certified photocopy of this order be made available to<\/p>\n<p>      the parties, if applied for, upon compliance with all requisite formalities.<\/p>\n<p>                                              (SENGUPTA, J.)<\/p>\n<p>                                    (SYAMAL KANTI CHAKRABARTI, J.)<\/p>\n<p>AKGoswami\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Calcutta High Court M\/S.
