RAMKUMAR, J.\n\n                           - - - - - - - - - - - - - - - - -\n\n                  BAIL APPLICATION NO.405  OF 2007\n\n               - - - - - - - - - ----------------------- - - - - - -\n\n             DATED THIS THE 30th DAY OF JANUARY, 2007\n\n\n                                     O R D E R\n<\/pre>\n<p>         Petitioner   who   is   the   accused   in   Crime   No.255\/06   of   Kasaba<\/p>\n<p>Police   Station   for   offences   punishable   under   sections   403,   406,   409,<\/p>\n<p>463,   464,   465   and   470   IPC,   seeks   anticipatory   bail.     Subsequently<\/p>\n<p>offences  punishable   under   sections   420   and   468  IPC   have  also   been<\/p>\n<p>added.\n<\/p>\n<\/p>\n<p>       2.     Learned Public Prosecutor opposed the application.<\/p>\n<p>       3.     Anticipatory bail cannot be granted in a case of this nature,<\/p>\n<p>where custodial interrogation of the petitioner is inevitable.  However,<\/p>\n<p>I   am   inclined   to   permit   the   petitioner   to   surrender   before   the<\/p>\n<p>Investigating   Officer   for   custodial   interrogation   and   then   to   have   his<\/p>\n<p>application   for   regular   bail   disposed   of   on   merits.     Accordingly,   the<\/p>\n<p>petitioner  shall surrender before  the Investigating Officer  on any day<\/p>\n<p>between   01.02.2007   and   03.02.2007   for   the   purpose   of   custodial<\/p>\n<p>interrogation   and   recovery   of   incriminating   materials,   if   any.     The<\/p>\n<p>petitioner   shall   thereafter   be   produced   before   the   Magistrate   having<\/p>\n<p>jurisdiction   on   the   same   day.
