Sections  25  and\t28A-\nRedetermination\t  of   the   amount   of   compensation-When\npermissible.\n\n\n\nHEADNOTE:\n     The petitioners, after a lapse of more than three years\nfrom the  date of the High Court Judgment, filed the present\npetitions for  enhancement of  the rate\t of compensation  to\n17.50 per  square yard\ton the ground that the Supreme Court\nin two\tcases decided on April 1, 1982 had enhanced the rate\nof compensation to Rs.17.50 per square yard for the adjacent\nland acquired.\tCounsel for the petitioners' con tended that\nthe Court  should not  be unduly  technical and\t deprive the\ncitizens of their legitimate claims in view of the change in\nlaw by\tthe introduction  of sections 25 and 28A in the Land\nAcquisition Act\t by the\t Land Acquisition  (Amendment)\tAct,\n1984.\n     Dismissing the petitions,\n     HELD: There  is no\t reason to  grant special  leave  in\nthese cases  which are\thopelessly barred  by  time.  Merely\nbecause the Supreme Court in the two cases enhanced the rate\nof compensation\t to Rs.17.50  per  square  yard,  could\t not\nfurnish a ground for condonation of delay under section 5 of\nthe Limitation Act. [663D-E]\n     2.1 Section  28A of  the Act in terms does not apply to\nthe case of the petitioners for more than one reason. In the\nfirst place, they do not belong to that class of society for\nwhose benefit  the provision  is intended  and\tmeant,\ti.e.\ninarticulate and poor people who by reason of their\n661\npoverty and  ignorance have  failed to take advantage of the\nright of  A reference to the civil court under section 18 of\nthe Land  Acquisition Act,  1894. The  petitioners  had\t all\napplied for  reference under  section 18  of the Act and the\ncivil court  by adopting  a different basis for computation,\nnamely, treating  the land  to be  potential building  site,\nsubstantially  enhanced\t  the  amount  of  compensation.  On\nappeal, there  was further enhancement by the High Court and\nthe petitioners\t have withdrawn\t large sums of money at each\nstage. Evidently,  the petitioners  felt satisfied  with the\nenhanced amount of compensation as awarded by the High Court\n@ Rs.  12.25 per  square yard because they did not apply for\ngrant of  special leave\t under Art.  136 of the Constitution\nfor more than three years. [662H; 663A-E]\n     2.2 There\tis also\t no provision  in the Act apart from\nsection 28A for reopening of an award which has become final\nand conclusive.\t If the\t conditions laid down in the section\nwere satisfied,\t the petitioners  could have  availed of the\nremedy provided under section 28A of the Act. In that event,\nsection 25  would ensure  to their  benefit. Any  other view\nwould lead  to disasterous  consequences not intended by the\nLegislature. [663E-G]\n     <a href=\"\/doc\/1749252\/\">Madras Port  Trust v.  Hymanshu  International<\/a>  by\t its\nProprietor v.Venkatadri\t (dead) by  Lrs., [1979]  4 SCC 176,\ndistinguished.\n\n\n\nJUDGMENT:\n<\/pre>\n<p>     CIVIL APPELLATE  J URlSDICTION:  Special Leave Petition<br \/>\n(Civil) No.13379 of 1983 etc.<br \/>\n     From the  judgment and  order  dated  8.5.1980  of\t the<br \/>\nPunjab and Haryana High Court in R.F.A. No.2030 of 1978.\n<\/p>\n<p>     S.N. Kacker and S.K. Sabharwal for the Petitioners. F<br \/>\n     K.G. Bhagat,  I.S. Goel  and C.V.\tSubba  Rao  for\t the<br \/>\nRespondents.\n<\/p>\n<p>     The order of the Court was delivered by<br \/>\n     SEN, J. In these special leave petitions which are much<br \/>\nbelated the  only question  was\t whether  the  Court  should<br \/>\nentertain the  petitions despite the delay and grant special<br \/>\nleave merely  because this  Court in  Paltu Singh  &amp; Anr. v.<br \/>\nState of  Haryana and Nand Kishore &amp; ors. v.State of Haryana<br \/>\n&amp; Ors.(Civil  Appeals Nos.  1251  and  1252  of\t 1982,\tboth<br \/>\ndecided on  April 1, 1982) enhanced the rate of compensation<br \/>\nfor<br \/>\n<span class=\"hidden_text\">662<\/span><br \/>\nthe adjacent  land acquired to Rs.17.50 per square yard. The<br \/>\npetition of Mewa Ram is barred by l079 days, that of Pat Ram<br \/>\nby 1146\t days and  of Ram  Sarup by  1098 days. We heard the<br \/>\nmatter\tthrice\t on  the  question  whether  there  was\t any<br \/>\nsufficient cause  for condonation  of delay under s.5 of the<br \/>\nLimitation Act,\t 1963. We  were not satisfied that there was<br \/>\nany cause  much less  sufficient cause within the meaning of<br \/>\ns.5 of\tthe Limitation\tAct for\t condonation of\t delay.\t The<br \/>\npetitioners then  took\ttime  to  file\tfurther\t and  better<br \/>\naffidavits explaining  the unexplained,\t inordinate delay in<br \/>\nmoving the Court.\n<\/p>\n<p>     At\t the  resumed  hearing\tShri  S.N.  Kacker,  learned<br \/>\ncounsel for  the petitioners, confines his submission to the<br \/>\nchange in  law by  the introduction of ss. 25 and 28A by the<br \/>\nLand Acquisition  (Amendment) Act, 1984 (Act 68 of 1984) and<br \/>\nplaces particular  emphasis to\tPara (ix) of the objects and<br \/>\nReasons, to the effect:\n<\/p>\n<blockquote><p>\t  &#8220;Considering that  the right\tof reference  to the<br \/>\n\t  civil court  under s. 18 of the Act is not usually<br \/>\n\t  taken advantage of by inarticulate and poor people<br \/>\n\t  and is usually exercised only by the comparatively<br \/>\n\t  affluent   landowners\t  and\tthat   this   causes<br \/>\n\t  considerable inequality  in the payment of compen-<br \/>\n\t  sation for  the same or similar quality of land to<br \/>\n\t  different interested\tparties, it  is proposed  to<br \/>\n\t  provide an  opportunity to  all aggrieved  parties<br \/>\n\t  whose land  is covered under the same notification<br \/>\n\t  to seek re-determination of compensation, once any<br \/>\n\t  one of  them has  obtained orders  for payment  of<br \/>\n\t  higher compensation  from the\t reference court un-<br \/>\n\t  der s. 18 of the Act. &#8220;<\/p><\/blockquote>\n<p>     The learned  counsel contends  on the  strength of\t the<br \/>\nprovisions contained in ss. 25 and 28A that the Court should<br \/>\nnot be\tunduly technical  and deprive  the citizens of their<br \/>\nlegitimate claims. In support of his submission he relies on<br \/>\ncertain observations made by this Court in <a href=\"\/doc\/1749252\/\">Madras Port Trust<br \/>\nv. Hymanshu  International<\/a> by  its Proprietor  V. Venkatadri<br \/>\n(dead) by  Lrs., [1979] 4 SCC 176 to the effect that plea of<br \/>\nlimitation by  the  Government\tto  defeat  just  claims  of<br \/>\ncitizens should\t not be\t countenanced. We  are\tafraid,\t the<br \/>\ncontention cannot prevail.\n<\/p>\n<p>     Shri Kacker,  learned counsel for the petitioners, with<br \/>\nhis usual  fairness, accepts  that s.  28A in terms does not<br \/>\napply to  the case  of the  petitioners for  more  than\t one<br \/>\nreason. In the first place, they do not belong to that class<br \/>\nof society for whose benefit the provision is in-\n<\/p>\n<p><span class=\"hidden_text\">663<\/span><\/p>\n<p>tended and  meant i.e.\tinarticulate and  poor people who by<br \/>\nreason of  their poverty  and ignorance\t have failed to take<br \/>\nadvantage of the right of reference to the civil court under<br \/>\ns.18 of the Land Acquisition Act, 1894. On the contrary, the<br \/>\npetitioners belong  to an  affluent class,  and they are not<br \/>\npersons who  have been\tdeprived of property without payment<br \/>\nof compensation.  The petitioners had all applied for refer-<br \/>\nence under s.18 of the Act and the civil court by adopting a<br \/>\ndifferent basis\t for computation,  namely. treating the land<br \/>\nto be  potential building  site, substantially\tenhanced the<br \/>\namount\tof   compensation.  On\tappeal.\t there\twas  further<br \/>\nenhancement  by\t  the  High   Court.  The  petitioners\thave<br \/>\nwithdrawn large\t sums of  money at each stage. For instance,<br \/>\nthe  petitioner\t Mewa  Ram  withdrew  on  February  6,\t1976<br \/>\nconsequent upon\t the award of the Land Acquisition Collector<br \/>\nRs.1,19,000, an\t additional sum\t of Rs.28,938.20p.  On March<br \/>\n23, 1978  after\t the  judgment\tof  the\t learned  Additional<br \/>\nDistrict Judge,\t and Rs.2,75, l05.42p. after the judgment of<br \/>\nthe High  Court between\t December 11,  1981 and February 13,<br \/>\n1982. The  judgment  of\t the  High  Court  not\thaving\tbeen<br \/>\nappealed from  has admittedly  become final.  Evidently, the<br \/>\npetitioners felt  satisfied  with  the\tenhanced  amount  of<br \/>\ncompensation as\t awarded by  the High  Court @\tRs.12.25 per<br \/>\nsquare yard  because they did not apply for grant of special<br \/>\nleave under Art. 136 of the Constitution for more than three<br \/>\nyears. Merely  because this  Court in the two cases of Paltu<br \/>\nSingh and  Nand Kishore enhanced the rate of compensation to<br \/>\nRs.17.50 per  square yard,  could not  furnish a  ground for<br \/>\ncondonation of delay under s. 5 of the Limitation Act.\n<\/p>\n<p>     Furthermore, there\t is no\tprovision in  the Act  apart<br \/>\nfrom s. 28A for reopening of an award which has become final<br \/>\nand conclusive.\t No  doubt  s.\t28A  now  provides  for\t the<br \/>\nredetermination of  the amount\tof compensation provided the<br \/>\nconditions  laid   down\t therein  are  fulfilled.  For\tsuch<br \/>\nredetermination,  the\tforum  is   the\t Collector  and\t the<br \/>\napplication has\t to be\tmade before  him within\t thirty days<br \/>\nfrom the  date of  the award, and the right is restricted to<br \/>\npersons who had not applied for reference under s. 18 of the<br \/>\nAct. If\t these conditions  were satisfied,  the\t petitioners<br \/>\ncould have  availed of\tthe remedy  provided under s. 28A of<br \/>\nthe Act. In that event, s. 25 would ensure to their benefit.<br \/>\nAny other  view would  lead to\tdisasterous consequences not<br \/>\nintended by the Legislature.\n<\/p>\n<p>     The decision  in Madras  Port Trust&#8217;s  case is  clearly<br \/>\ndistinguishable. The  question involved\t there was as to the<br \/>\nright of  refund of  the amount\t of wharfage,  demurrage and<br \/>\ntransit charges which admittedly<br \/>\n<span class=\"hidden_text\">664<\/span><br \/>\nbecame exigible.  The Court  granted special  leave  on\t the<br \/>\ncondition that the Madras Port Trust would refund the amount<br \/>\nirrespective of the result of the appeal. At the hearing the<br \/>\nCourt declined\tto go into the question whether the claim of<br \/>\nthe trader  for such  refund was  barred by  s. 1 l() of the<br \/>\nMadras Port Trust Act. 1905. and added:\n<\/p>\n<blockquote><p>\t  &#8220;The plea  of limitation  based on this section is<br \/>\n\t  one  which   the  court  always  looks  upon\twith<br \/>\n\t  disfavour and\t it is\tunfortunate  that  a  public<br \/>\n\t  authority like  the  Port  Trust  should,  in\t all<br \/>\n\t  morality and\tjustice, take  up  such\t a  plea  to<br \/>\n\t  defeat a just claim of the citizen.&#8221;\n<\/p><\/blockquote>\n<p>The Court then said:\n<\/p>\n<blockquote><p>\t  &#8220;It is  high\ttime  that  governments\t and  public<br \/>\n\t  authorities adopt the practice of not relying upon<br \/>\n\t  technical  pleas  for\t the  purpose  of  defeating<br \/>\n\t  legitimate claims  of citizens and do what is fair<br \/>\n\t  and just to the citizens. &#8221;\n<\/p><\/blockquote>\n<p>This is\t mere expression of a hope and does not lay down any<br \/>\nuniversal  rule\t  of  application  that\t the  Government  is<br \/>\nprevented from\tpleading limitation  as a  bar. On the other<br \/>\nhand, the  Court itself\t observed in the Madras Port Trust&#8217;s<br \/>\ncase that  &#8216;if a government or a public authority takes up a<br \/>\ntechnical plea,\t the Court  has to decide it and if the plea<br \/>\nis  well-founded   it  has  to\tbe  upheld  by\tthe  Court&#8217;.<br \/>\nObviously, the\tpetitioners cannot plead their own laches as<br \/>\na ground sufficient for condonation of delay.\n<\/p>\n<p>     There is  no reason  for us  to grant  special leave in<br \/>\nthese cases which are hopelessly barred by time and there is<br \/>\nno justification for condonation of inordinate delay.\n<\/p>\n<p>     The special  leave petitions  are accordingly dismissed<br \/>\nwith costs.\n<\/p>\n<pre>M.L.A.\t\t\t\t\tPetitions dismissed.\n<span class=\"hidden_text\">665<\/span>\n\n\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Mewa Ram (Deceased) By His L.Rs. &#8230; vs State Of Haryana Through The &#8230; on 26 August, 1986 Equivalent citations: 1987 AIR 45, 1986 SCR (3) 660 Author: A Sen Bench: Sen, A.P.
