Petitioner\n                                       Versus\n                The State of Jharkhand and others     ..       ...     ....    .Respondents\n                                    ------\n<\/pre>\n<pre>                CORAM:         HON'BLE THE ACTING CHIEF JUSTICE\n                                    ------\n\n                       Order No. 05                                    Dated 15th July, 2011\n\n<\/pre>\n<p>                       The complaint has been filed by the respondent &#8211; Naresh Prasad Mahto<\/p>\n<p>                for alleged offences committed under Sections 409, 420, 467, 468, 471 read<\/p>\n<p>                with 120(B) of the Indian Penal Code against five accused with the allegation<\/p>\n<p>                that he deposited Rs.50000\/- through the agent accused No.1 Dhiraj Kumar<\/p>\n<p>                Shrivastava with Sahara India Branch at Jamtara on 31.8.2004 for a period of 15<\/p>\n<p>                months and the said amount was not refunded to the petitioner even after<\/p>\n<p>                maturity of the said fixed deposit. It is alleged that in place of the petitioner the<\/p>\n<p>                said agent of Sahara India withdrew the maturity amount.<\/p>\n<p>                       The petitioner being the Regional Manager of Sahara India has<\/p>\n<p>                challenged the prosecution and it has been submitted today that the matter has<\/p>\n<p>                been settled between the parties and payment has been made to the complainant<\/p>\n<p>                by the Company i.e. Sahara India and not by the agent Dhiraj Kumar. Learned<\/p>\n<p>                counsel for the complainant has also submitted that he has received the amount<\/p>\n<p>                from Sahara India and not from the agent Dhiraj Kumar.<\/p>\n<p>                       It appears that the dispute was of civil nature and the matter has been<\/p>\n<p>                compromised between the parties. In totality of the facts of the case and in view<\/p>\n<p>                of the compromise between the parties, the proceeding initiated in pursuance of<\/p>\n<p>                the complaint sent to the police under Section 156(iii) Cr.P.C. which was<\/p>\n<p>                registered as Jamtara PS Case No.1895 of 2009 (G.R.
