Justice ANTONY DOMINIC\n\n Dated :16\/06\/2009\n\n O R D E R\n                    ANTONY DOMINIC,J.\n                ---------------------\n                W.P.(C).No.14143 OF 2009\n              ------------------------\n            Dated this the 16th day of June, 2009.\n\n                         JUDGMENT\n<\/pre>\n<p>     The prayer in this writ petition is to quash Exts.P2 and<\/p>\n<p>P10 and to direct the respondents not to take further<\/p>\n<p>proceedings pursuant to the impleadment of the petitioner<\/p>\n<p>in the arbitration proceedings.\n<\/p>\n<p>     2. The petitioner&#8217;s wife was the Manager of the<\/p>\n<p>Ettumanoor Branch of the 4th respondent. In August 2003,<\/p>\n<p>she was placed under suspension, on allegation of<\/p>\n<p>misconducts and the arbitration      was also raised by the<\/p>\n<p>Bank against the petitioner&#8217;s wife. At that stage, by Ext.P1<\/p>\n<p>agreement executed by the petitioner in favour of the Bank,<\/p>\n<p>he undertook to make good the dues which the petitioner&#8217;s<\/p>\n<p>wife owned to the Bank. Accordingly, petitioner was made a<\/p>\n<p>party to arbitration proceedings and by, by Ext.P2, the 2nd<\/p>\n<p>respondent authorized       attachment of the petitioner&#8217;s<\/p>\n<p><span class=\"hidden_text\">WP(c).No.14143\/09               2<\/span><\/p>\n<p>property. Ext.P3 objection was filed by the petitioner before<\/p>\n<p>the 2nd respondent and this court in Ext.P4 judgment in WP(c).<\/p>\n<p>No.30178\/04 filed by the petitioner, directed consideration of<\/p>\n<p>the objections. Accordingly, objections were considered and<\/p>\n<p>by Ext.P5 the 2nd respondent declined        to lift the order of<\/p>\n<p>attachment.\n<\/p>\n<p>       3. Ext.P5 order was called in question before this court<\/p>\n<p>in WP(c).No.1208\/05. That writ petition was disposed of by<\/p>\n<p>Ext.P6 judgment relegating the petitioner to seek appellate<\/p>\n<p>remedy. Accordingly, the petitioner filed Ext.P7 appeal before<\/p>\n<p>the first respondent, which again was directed to be<\/p>\n<p>considered as per Ext.P8 judgment rendered by this court in<\/p>\n<p>WP(c).No.29918\/05 filed by the petitioner. The appeal was<\/p>\n<p>heard and the Tribunal dismissed the appeal by Ext.P10 order.<\/p>\n<p>It is in these circumstances this writ petition is filed.<\/p>\n<p>       4. The contention raised before me is that the Arbitrator<\/p>\n<p>has no power to implead a stranger to the proceedings and<\/p>\n<p>pass an order of attachment before judgment. According to<\/p>\n<p><span class=\"hidden_text\">WP(c).No.14143\/09                 3<\/span><\/p>\n<p>the Senior Counsel for the petitioner, in the absence of any<\/p>\n<p>clear statutory provision conferring power in this behalf, the<\/p>\n<p>Arbitrator could not have           passed Ext.P2 order.        The<\/p>\n<p>contention raised by the counsel for the petitioner is clearly<\/p>\n<p>answered by the Division Bench of this court in Thankam R.<\/p>\n<p>Pillai V. Arbitrator(1996(1)KLT 225), where it has been held as<\/p>\n<p>follows;\n<\/p>\n<blockquote><p>                &#8220;All powers which are not specifically denied by<\/p>\n<p>                the statute or the statutory rules should be<\/p>\n<p>                vouchsafed to a Tribunal so that it may<\/p>\n<p>                effectively exercise its judicial function. A<\/p>\n<p>                Tribunal in its wider connotation, embraced<\/p>\n<p>                every adjudicatory organ including an Arbitrator.<\/p>\n<p>                A &#8220;Tribunal&#8221; literally means a seat of justice. May<\/p>\n<p>                be, justice is dispensed by a quasi-judicial body,<\/p>\n<p>                an arbitrator, a commission, a court or other<\/p>\n<p>                adjudicatory organ created by the State. The<\/p>\n<p>                Arbitrator functioning under the Act is a quasi-<\/p>\n<p><span class=\"hidden_text\">WP(c).No.14143\/09                 4<\/span><\/p>\n<p>                judicial adjudicatory body falling within the term<\/p>\n<p>                &#8221; tribunal&#8221;<\/p><\/blockquote>\n<p>      5. Following this judgment, in <a href=\"\/doc\/1639170\/\">Paul V. Asst. Registrar<\/a><\/p>\n<p>(1998(2)KLT 449), a learned judge of this court has also held<\/p>\n<p>that the preposition that emerges from the above decision is<\/p>\n<p>that all the powers which are not specifically denied by the<\/p>\n<p>statute or the statutory rules should be vouchsafed to a<\/p>\n<p>Tribunal.\n<\/p>\n<p>      In view of the above decision I see no reason to interfere<\/p>\n<p>with the order impugned.
