Goswami for the applicant submitted that the<br \/>\n\tapplicant had applied for the loan and amount has not been<br \/>\n\trecovered, for which, FIR has been filed. However, he submitted that<br \/>\n\tthe applicant is ready to make the statement that amount of<br \/>\n\tRs.50,000\/- shall be deposited before his release and Rs.1,50,000\/-<br \/>\n\twithin three months thereafter<\/p>\n<p>Learned<br \/>\n\tA.P.P., Mr.Shukla submitted that the applicant has submitted bogus<br \/>\n\tdocuments including the Village Form No.7\/12 in respect of some<br \/>\n\tother land and, thereafter, committed an offence.\n<\/p>\n<p>Having<br \/>\n\theard learned counsel appearing for the respective parties and<br \/>\n\thaving regard to the nature of offence, role attributed and<br \/>\n\tconsidering the statement with regard to repayment of the amount,<br \/>\n\tthe present application deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.22\/2010<br \/>\n\tregistered with Mandavi Police Station, District : Kutch on his<br \/>\n\texecuting a bond of Rs.5,000\/- (Rupees Five Thousand Only) with one<br \/>\n\tsolvent surety of the like amount to the satisfaction of the lower<br \/>\n\tCourt and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the<br \/>\nchargesheet is filed.\n<\/p>\n<p>(f)\tdeposit<br \/>\nRs.50,000\/- (Rupees Fifty Thousand) in the bank before his release,<br \/>\nfor which, receipt shall be produced and Rs.1,50,000\/- (Rupees One<br \/>\nLac &amp; Fifty Thousand) within three months after the release.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
