 petitioner had demanded dowry and<\/p>\n
harassed,.heir-,,.aind that he has failed to maintain her. The<\/p>\n
2″\u00bb-i..__”i.earned Triai Judge has taken note of the ailegations made<\/p>\n
   vt_h_efpetition filed under Section 125 of the Cr.P.C., that<\/p>\n
 petitioner had harassed her and deprived her basic<\/p>\n
Cnecessities in iife. However, while fixing the quantum, the<\/p>\n
learned Triai Judge did not accept that the petitioner is<\/p>\n
having income of Rs.8,000\/–. Considering the probability of<\/p>\n

the respondent earning, Rs.1,000\/– is ordered towards
\npast maintenance and Rs.1,500\/- towards future<\/p>\n

he did not avail an opportunity to defend  Learnedi ”<\/p>\n
counsel would submit that there is’\u00bb.1no:_pro3of\u00ab’of’ iAncon\u00a7e”‘s–..aF=id’<\/p>\n
petitioner is actually joblessf He hardly earns to <\/p>\n
150 \/~ per day from distributing:news,pape’r  rinorning.
\nTherefore, he needs an\ufb01opiportunvllity-to”establish that he<\/p>\n
has no income.   V<\/p>\n
S’, Per’contra-,..:l’earried*~.counsel for the respondent has<\/p>\n
opposed  petitioner  ground that the petitioner is<\/p>\n
 earning’ l7.s.8,OV'(Jf}.\/V:–:,v_ whereas the respondent is suffering<\/p>\n
 wi’thout_vAre.sou’rice. The Trial court has awarded very less<\/p>\n
lamlougntxf ‘=~5:;!’.l’b”mits that the amount of maintenance<\/p>\n
. ordered”fis””very low and hence interference is not<\/p>\n
if’H–.nece.s.savrv. However, considering the fact that the<\/p>\n
-l  ptetitiolner did not lead evidence and he should be given an<\/p>\n
 opportunity to establish his case, appropriate order has to<\/p>\n

of the Family Court at Mysore, is set   0′<\/p>\n

to the husband to establish that  ahcor.5\u00a2. <\/p>\n
