Mr. A. J. Desai, learned APP, waives service of notice of Rule on
\nbehalf of the respondent-State.\n<\/p>\n

\nMr.M. J. Buddhbhatti, learned advocate for the applicant and
\nMr.Desai, learned APP for the respondent-State.\n<\/p>\n
3.0\tThis
\napplication is successive application seeking regular bail under
\nsection 439 of the Code of Criminal Procedure, 1973 preferred by
\napplicant in connection with the offence registered with Saher Kotda
\nPolice Station, bearing I-CR No.86 of 2011 for the offence punishable
\nunder sections 306, 498(A) and 114 of Indian Penal Code.\n<\/p>\n
4.0\tMr.Buddhbhatti,
\nlearned advocate for the applicants has submitted that the applicant
\nhas been falsely implicated in the offence. He submitted that the
\nmarriage span is of 10 years and during these years no such complaint
\nhas ever been filed. He has also submitted that there is small kid
\naged about 2 years amongst the four children of the applicant and no
\none else in the family except the old parents of the applicant and,
\ntherefore, the applicant may be released on bail on any strict
\nconditions to look after his children. The learned advocate for the
\napplicant emphasized that the allegations levelled against the
\napplicant are general in nature and other co-accused has been
\nreleased on bail by this Court vide order dated 22.06.2011 passed in
\nCriminal Misc. Application No.8111 of 2011, and, therefore, present
\napplicant may also be released on bail.\n<\/p>\n
5.0\tThe
\napplication is opposed by Mr.Desai, learned APP, who has submitted
\nthat the applicant has committed the alleged offence which is serious
\nin nature and that therefore the application deserves to be rejected.\n<\/p>\n
6.0\tHaving
\nheard the learned counsel for both the sides and considering the
\nfacts and circumstances of the case as well as the documents and
\nother material produced on record of this case, the gravity of the
\noffence, the quantum of punishment, the allegations against the
\napplicant, the manner in which the applicant is allegedly involved in
\nthe case as per the allegation of the prosecution coupled with the
\nfact that co-accused has been released by this Court and there are
\nfour children to be looked after by the applicant since there is no
\none in the family to look after the children of the applicant except
\nthe old parents of the applicant, and that now the investigation is
\nover and charge sheet is filed, I am of the view that the applicant
\ndeserves to be released on bail, and therefore, I am inclined to
\nallow this application and release the applicant.\n<\/p>\n
7.0\tHence,
\nthis application is allowed. It is directed that the present
\napplicant in connection with I-CR No.86 of 2011 registered with Saher
\nKotda Police Station be released on bail, in respect of the offences
\nalleged against him in this application, on his executing and
\nfurnishing bond of Rs.10,000\/- (Rupees: Ten Thousand Only) with two
\nsolvent sureties of like amount, by the concerned Police Officer, and
\non condition that he shall:-\n<\/p>\n
\t(a)\tnot
\ntake undue advantage of or abuse the liberty;\n<\/p>\n
\t(b)\tnot
\nact in manner injurious to the interest of the\tprosecution;\n<\/p>\n
\t(c)\tmaintain
\nlaw and order;\n<\/p>\n
\t(d)\tnot
\nleave the State of Gujarat without prior permission of \tthe Sessions
\nCourt concerned;\n<\/p>\n
(e)\tfurnish
\nthe address of his residence at the time of execution of bond and
\nshall not change the residence without prior permission of the
\nSessions Court\/this Court;\n<\/p>\n
(f)\tsurrender
\nhis passport, if any, to the lower court within 4 days from the date
\nof this order;\n<\/p>\n
(g)\tmark
\nhis presence at Saher Kotda Police Station, initially on 5th
\nSeptember, 2011 and thereafter once a week i.e on every Monday
\nbetween 11.00 a.m. to 3.00 p.m.;\n<\/p>\n
(h)\tnot
\nenter the revenue limit of  Meghaninagar till the trial is over and
\nfor 6 months shall not enter limit of Ahmedabad City without prior
\npermission of the Sessions Court, but for making his presence and
\nattending the Court in connection with this case the applicant will
\nbe free to enter the limits for a period to the extent necessary and
\nwill leave the limits of district immediately after the case is
\nadjourned;\n<\/p>\n
8.0\tThe
\nauthorities will release the applicant only if he is not required in
\nany other offence for the time being.\n<\/p>\n
9.0\tIf
\nbreach of any of the above condition is committed the Sessions Judge
\nconcerned will be free to issue warrant or take any appropriate
\naction in the matter.\n<\/p>\n
10.0\tBail-bond
\nbefore the lower Court having jurisdiction to try the case.\n<\/p>\n
11.0
\n At the trial, the trial Court shall not be influenced by the
\nobservations, which are purely, prima facie, tentative and
\npreliminary nature and have been made only for the purpose of
\nexamining prayer for bail pending the trial. The Court shall arrive
\nat its own conclusion independently on the basis of the evidence and
\nother aspects of the case.\n<\/p>\n
12.0\tRule
\nis made absolute to the aforesaid extent.\n<\/p>\n
