Justice K.T.SANKARAN\n\n Dated :07\/10\/2008\n\n O R D E R\n            KURIAN JOSEPH &amp; K.T.SANKARAN, JJ.\n              -----------------------------------------\n                    W.P(Crl)No.336 of 2008\n              -----------------------------------------\n           Dated this the 7th day of October, 2008\n\n                              JUDGMENT\n<\/pre>\n<p>Kurian Joseph,J.\n<\/p>\n<p>      The writ petition is filed with the following prayer:-<\/p>\n<blockquote><p>               a)    Issue a writ of Habeas Corpus to the<br \/>\n          respondents, particularly respondents 4 to 6, to produce<br \/>\n          the body of Sri.Manu Sam Jose before this Hon&#8217;ble Court<br \/>\n          and to ensure his release so as to enable him to freely<br \/>\n          move about.\n<\/p><\/blockquote>\n<p>Petitioner claims to be the friend of the alleged detenu. Even<\/p>\n<p>going by the allegations in the writ petition, the alleged detenu is<\/p>\n<p>with his parents and relatives. It is also seen that the detenu<\/p>\n<p>himself has used the telephone of his parents to speak to the<\/p>\n<p>petitioner. Learned Government Pleader Sri.Mohammed Anzar,<\/p>\n<p>on written instruction from the Circle Inspector of Police,<\/p>\n<p>Kozhencherry, submits that Sri.Manu Sam Jose is not in the<\/p>\n<p>illegal custody of any person. He is living as a free person with<\/p>\n<p>his parents. His own statement has been recorded by the Circle<\/p>\n<p>Inspector of Police to the effect that he is a free person.<\/p>\n<p>Therefore, we do not find any merit in the writ petition. The<\/p>\n<p>alleged detenu, who is an Engineering graduate, aged 22 years,<\/p>\n<p>W.P(Crl)No.336 of 2008<br \/>\n<span class=\"hidden_text\">                                  -:2:-<\/span><\/p>\n<p>is living with his parents out of his own free will.
