SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 05\/10\/2010 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>1.\t\tThe<br \/>\npresent application has been preferred by the applicants herein &#8211;<br \/>\noriginal respondent Nos.1 to 3 of Special Civil Application No.11099<br \/>\nof 2008 for modification of the order dated 18\/12\/2009 passed by this<br \/>\nCourt so as to include the words &#8220;criminal proceedings&#8221;<br \/>\nin the operative part of the order where it refers to civil<br \/>\nproceedings in Para 4 of the aforesaid order.\n<\/p>\n<p>2.\t\tMs.Megha<br \/>\nJani, learned advocate appearing on behalf of the applicants has<br \/>\nsubmitted that if this Court is not inclined to modify the order<br \/>\ndated 18\/12\/2009 passed by this Court in Special Civil Application<br \/>\nNo.11099 of 2008, in that case, it may be clarified that the criminal<br \/>\nproceedings pending between the parties may be decided and disposed<br \/>\nof in accordance with law and on merits and without in any way being<br \/>\ninfluenced by the order dated 18\/12\/2009 passed by this Court in<br \/>\nSpecial Civil Application No.11099 of 2008.\n<\/p>\n<p>3.\t\tHaving<br \/>\nheard Ms.Megha Jani, learned advocate appearing on behalf of the<br \/>\napplicants and Mr.Tattvam Patel, learned advocate appearing on behalf<br \/>\nof the original petitioners and looking to the controversy in the<br \/>\nmain petition, there is no necessity to modify the order dated<br \/>\n18\/12\/2009 passed by this Court, as prayed for.\n<\/p>\n<p>4.\t\tThis<br \/>\nCourt passed an order in the main Special Civil Application by<br \/>\nobserving that in case it is found that by the proposed division of<br \/>\nthe land in question, there is no breach of provisions of Prevention<br \/>\nof Fragmentation Act, in that case, necessary division\/s be made by<br \/>\nthe Settlement Commissioner. However, the same shall be without<br \/>\nprejudice to the rights and contentions of the respective parties in<br \/>\nthe civil proceedings inclusive of First Appeal pending before this<br \/>\nCourt, in which, disputes with respect to title is pending.\n<\/p>\n<p>5.\t\tIn<br \/>\nthe criminal proceedings, the Court is not likely to decide the<br \/>\ndispute with respect to title. It is to be noted that even the order<br \/>\ndated 18\/12\/2009 passed by this Court in Special Civil Application<br \/>\nNo.11099 of 2008 is based on consensus between the learned advocates<br \/>\nappearing on behalf of the respective parties under the instructions<br \/>\nreceived from their respective clients. However, it is made clear<br \/>\nthat this Court has not expressed any opinion on merits with respect<br \/>\nto criminal proceedings pending between the parties and it was not<br \/>\nsubject matter of the petition. Therefore, Criminal Court to decide<br \/>\nand dispose of the same in accordance with law and on merits and<br \/>\nwithout in any way being influenced by the order dated 18\/12\/2009<br \/>\npassed by this Court in Special Civil Application No.11099 of 2008.\n<\/p>\n<p>\t\tWith<br \/>\nthis, the present application is disposed of.
