JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThis<br \/>\nAppeal preferred under clause 15 of the Letters Patent arises from<br \/>\nthe order dated 5th March 2008 made by the learned Single<br \/>\nJudge in above Special Civil Application No.4129\/2008.\n<\/p>\n<p>\tThe<br \/>\nmatter at dispute is the constructed property, possession of which<br \/>\nthe appellant was directed to handover to the respondent no.1.\n<\/p>\n<p>\tIn<br \/>\nthe Civil Revision Application No.965\/2000, the appellant gave an<br \/>\nundertaking and agreed to handover the possession on or before 10th<br \/>\nNovember 2000. Till the date neither the order is implemented nor the<br \/>\nundertaking is respected. Instead, the appellant has filed Regular<br \/>\nCivil Suit No.278\/2000 to retain the possession of the suit premises.<br \/>\nIn the meanwhile, the construction in question was destroyed in the<br \/>\nearthquake on 26th January 2001. The appellant has not<br \/>\nhanded over the possession either of the constructed property or the<br \/>\nopen land.\n<\/p>\n<p>\tIn<br \/>\nview of the breach of the undertaking given by the appellant, by<br \/>\norder made by the trial Court below application Exh.38 under  Order<br \/>\n39  Rule 2A CPC, the appellant is directed to undergo simple<br \/>\nimprisonment for three months. The challenge to the said order in the<br \/>\nabove writ petition has failed. Hence, the present Appeal.\n<\/p>\n<p>\tThe<br \/>\nAppeal deserves to be dismissed on the grounds of maintainability and<br \/>\nalso on merits. It is apparent that the appellant has not respected<br \/>\nthe undertaking given by him to this Court.\n<\/p>\n<p>\tNo<br \/>\ncase for interference is made out. The Appeal is dismissed. Civil<br \/>\nApplication stands disposed of.
