The petitioner is the sole<\/p>\n<p>accused. He faces allegations under Section 420 I.P.C.               The<\/p>\n<p>crime has been registered on the basis of a private complaint<\/p>\n<p>filed before the learned Magistrate and referred by the learned<\/p>\n<p>Magistrate to the police under Section 156(3) Cr.P.C.<\/p>\n<p>Investigation is in progress.               The petitioner apprehends<\/p>\n<p>imminent arrest.     The crux of the allegations is that the<\/p>\n<p>petitioner had sold a vehicle with a hire purchase liability. He<\/p>\n<p>could not discharge the liability obliging the hire purchase<\/p>\n<p>company to initiate action personally against the original owner.<\/p>\n<p>      2.   In the result, this petition is allowed.             Following<\/p>\n<p>directions are issued under Section 438 Cr.P.C in favour of the<\/p>\n<p>petitioner.\n<\/p>\n<p>      i)   Petitioner   shall      surrender          before the learned<\/p>\n<p>Magistrate having jurisdiction at 11 a.m on 26\/09\/2007.<\/p>\n<p>      ii)  He shall be released on regular bail on condition that<\/p>\n<p>he executes a bond for Rs.50,000\/-(Rupees fifty thousand only)<\/p>\n<p><span class=\"hidden_text\">B.A.No.5685\/07                   2<\/span><\/p>\n<p>with two solvent sureties each for the like sum to the satisfaction<\/p>\n<p>of the learned Magistrate.\n<\/p>\n<p>      iii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 3 p.m on 27\/09\/2007 and 28\/09\/2007 and thereafter on all<\/p>\n<p>Mondays and Fridays between 10 a.m and 12 noon for a period<\/p>\n<p>of two months and subsequently as and when directed by the<\/p>\n<p>investigating officer in writing to do so.<\/p>\n<p>      (iv) If the petitioner does not appear before the learned<\/p>\n<p>Magistrate as directed in clause (i), directions issued above shall<\/p>\n<p>thereafter stand revoked and the police shall be at liberty to<\/p>\n<p>arrest the petitioner and deal with him in accordance with law,<\/p>\n<p>as if these directions were not issued at all.<\/p>\n<p>      (v)   If he were arrested prior to 26\/09\/2007, he shall be<\/p>\n<p>released from custody on his executing a bond for Rs.50,000\/-<\/p>\n<p>(Rupees fifty thousand only) without any sureties, undertaking to<\/p>\n<p>appear before the learned Magistrate on 26\/09\/2007.<\/p>\n<p>                                             (R.BASANT, JUDGE)<br \/>\njsr<\/p>\n<p><span class=\"hidden_text\">B.A.No.5685\/07    3<\/span><\/p>\n<p><span class=\"hidden_text\">B.A.No.5685\/07    4<\/span><\/p>\n<p>       R.BASANT, J.\n<\/p>\n<p>         CRL.M.CNo.\n<\/p>\n<p>            ORDER<\/p>\n<p>21ST DAY OF MAY2007<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Anilkumar E.R. vs State Of Kerala on 19 September, 2007 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 5685 of 2007() 1.
