KRISHNAN, J.\n                  ...........................................\n                   R.P.(F.C).No.349 OF 2007\n                  .............................................\n           Dated this the 25th day of February, 2010.\n\n                               O R D E R\n<\/pre>\n<p>     This   revision is preferred               against the order of the<\/p>\n<p>Family Court, Ernakulam in M.C.No.83\/2006.                      The wife and<\/p>\n<p>two minor children moved against the revision petitioner for<\/p>\n<p>maintenance and the family court on a consideration of the<\/p>\n<p>materials granted them maintenance at the rate of Rs.750\/=<\/p>\n<p>each.    The finding on the question of                        entitlement of<\/p>\n<p>maintenance to the wife as well the quantum awarded to<\/p>\n<p>all are under challenge in this revision.<\/p>\n<p>     2. Heard the learned counsel appearing for both sides.<\/p>\n<p>It has to be stated that the matrimonial relationship is totally<\/p>\n<p>almost broken down and there are four cases pending with<\/p>\n<p>respect to the matrimonial disputes.                 The court found that<\/p>\n<p>the wife may not be able to live with such a husband and<\/p>\n<p>held that she is entitled to maintenance. It is a finding on fact<\/p>\n<p>which does not suffer from any serious infirmity.<\/p>\n<p>     3. Now the learned counsel for the revision petitioner<\/p>\n<p>would submit that he had effected a divorce on the wife. If<\/p>\n<p><span class=\"hidden_text\">                               : 2 :<\/span><br \/>\nR.P.(F.C).No.349 OF 2007<\/p>\n<p>it is so, it is for him to move the appropriate court and it<\/p>\n<p>is not the subject matter of the revision at all. It is also<\/p>\n<p>submitted by the learned counsel for the wife that he had<\/p>\n<p>remarried.         That  is also the matter which has to be<\/p>\n<p>separately placed before the competent court. So the only<\/p>\n<p>question that survives for determination is regarding the<\/p>\n<p>quantum of maintenance.           The learned counsel for the<\/p>\n<p>respondents very strongly urges before me that this Court<\/p>\n<p>shall not interfere with the meagre amount of maintenance<\/p>\n<p>ordered by the family court. I cannot disagree with her<\/p>\n<p>when the learned counsel submits that the amount ordered is<\/p>\n<p>extremely reasonable.      But the purport under Section 125<\/p>\n<p>of Cr.P.C is to consider the capacity of the husband also in<\/p>\n<p>fixing the quantum of maintenance and if it is not done, the<\/p>\n<p>order for maintenance will not have the desired result.<\/p>\n<p>Here the husband is a driver by profession in a Government<\/p>\n<p>Department. He would contend that he is having a carry<\/p>\n<p>home salary of Rs.3,350\/=. The court found that the salary<\/p>\n<p>after deduction taken into consideration for fixing the<\/p>\n<p>maintenance is Rs.3490\/=. One of the daughters is staying<\/p>\n<p><span class=\"hidden_text\">                             : 3 :<\/span><br \/>\nR.P.(F.C).No.349 OF 2007<\/p>\n<p>in an orphanage. The court       found that no evidence is<\/p>\n<p>adduced to prove that money is spent for her boarding and<\/p>\n<p>lodging there.   The husband would contend that he has to<\/p>\n<p>look after his mother besides an unmarried sister. It is true<\/p>\n<p>that there is social responsibility for the man. But that<\/p>\n<p>social responsibility does not ipso facto give him the right<\/p>\n<p>to abandon his wife and children. Therefore it is desirable<\/p>\n<p>to take into consideration the total materials available.  He<\/p>\n<p>is a driver by profession in a Government department. He<\/p>\n<p>has to work     long trips. He may have to take food from<\/p>\n<p>outside considering the nature of his avocation. He has to<\/p>\n<p>pay    some amount to his mother as well.\n<\/p>\n<p>      4. So taking into consideration      all these     facts,<\/p>\n<p>reasonable order of maintenance would be Rs.700\/= to the<\/p>\n<p>wife and Rs.600\/= each to the children. I make it clear that<\/p>\n<p>if there is change of circumstance, the parties can move for<\/p>\n<p>enhancement as well for cancellation.\n<\/p>\n<p>       5. Therefore the revision is disposed of by modifying<\/p>\n<p>the order of maintenance payable by the husband to the wife<\/p>\n<p>at Rs.700\/= and Rs.600\/= each to the children payable<\/p>\n<p><span class=\"hidden_text\">                           : 4 :<\/span><br \/>\nR.P.(F.C).No.349 OF 2007<\/p>\n<p>from the date of petition.   The mother is authorized to<\/p>\n<p>withdraw the amount on behalf of the minor children.<\/p>\n<p>    Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                 M.N.
