SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/07\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tRULE.\n<\/p>\n<p> So far as Civil Application<br \/>\nNo. 7362\/2010 is concerned, Shri Parth Bhatt, learned advocate<br \/>\nappearing for Shri Sanjay Mehta, learned advocate waives service of<br \/>\nnotice of rule on behalf of the opponent-original defendant.\n<\/p>\n<p>2.\tHeard<br \/>\nthe learned advocates appearing on behalf of the respective parties<br \/>\non interim relief.\n<\/p>\n<p>3.\tHaving<br \/>\nheard the learned advocates appearing on behalf of the respective<br \/>\nparties on interim relief and considering the fact that the Appeal<br \/>\nfrom Order against the order passed by the learned trial Court below<br \/>\nNotice of Motion is admitted  and considering the nature of<br \/>\ncontroversy between the parties, it appears that if the interim<br \/>\nrelief in terms of paragraph 4(B) in Civil Application No. 7362\/2010<br \/>\nis not granted, Appeal from Order would become infructuous and if<br \/>\nultimately any decree is passed, it will not be possible  for the<br \/>\napplicant-original plaintiff to recover the amount from the<br \/>\nopponent-original defendant.  Hence, interim relief in terms of<br \/>\nparagraph 4(B) in Civil Application No. 7362\/2010 is granted and<br \/>\nthere shall be interim relief in Civil Application No. 7362\/2010 till<br \/>\nfinal disposal of   Appeal from Order No. 107\/2010.\n<\/p>\n<p>4.\tIn<br \/>\nthe facts and circumstances of the case, Registry is directed to<br \/>\nnotify Appeal from Order No. 107\/2010 for final hearing on<br \/>\n30\/08\/2010.\n<\/p>\n<p>5.\tWith<br \/>\nthis, Civil Application No. 7362\/2010 is allowed.  Rule is made<br \/>\nabsolute to the aforesaid extent.\n<\/p>\n<p> CIVIL<br \/>\nAPPLICATION No. 4014\/2010<\/p>\n<p>\tIn<br \/>\nview of the order passed in Civil Application No. 7362\/2010, no order<br \/>\nin Civil Application No. 4014\/2010.
