SINHA, J.\n<\/p>\n<p>1.\tThe short question involved in this appeal, is the interpretation of<br \/>\nthe provisions of the Punjab National Bank (Officers) Service<br \/>\nRegulations, 1979 vis-`-vis Punjab National Bank (Employees) Pension<br \/>\nRegulations, 1995 (in short Pension Regulations), which arises out of a<br \/>\njudgment and order of the High Court of Delhi at New Delhi passed in<br \/>\nLPA No. 336 of 2002.\n<\/p>\n<p>2.\tRespondent herein was an employee of the New Bank of India.<br \/>\nOn or about 4th September, 1993 the said Bank was amalgamated with<br \/>\nthe appellant bank.  A charge sheet was issued against the respondent on<br \/>\n19th August, 1993.  He reached the age of superannuation on 30th<br \/>\nNovember, 1994.  Appellant, however, relying on or on the basis of<br \/>\nRegulation 20 (3) (iii) of the National Bank (Officers) Service<br \/>\nRegulations, 1979, continued the departmental proceedings against him.<br \/>\nThe same was completed after his retirement on 1st August, 1995.  An<br \/>\norder of punishment was passed by the disciplinary authority dismissing<br \/>\nthe respondent from service on 22nd Mach, 1996, directing :-\n<\/p>\n<p>Provisions of Regulation 20(3)(iii) of Punjab<br \/>\nNational Bank Officers Service Regulations, 1979<br \/>\nwere invoked vide letter dated 23.11.1994 and it was<br \/>\ninter alia made clear to Shri Kalra that though he will<br \/>\ncease to be in service of the bank on 30.11.1994 (on<br \/>\nattaining the age of superannuation) but the<br \/>\ndisciplinary proceedings initiated against him will<br \/>\ncontinue as if he was in service until the disciplinary<br \/>\nproceedings are completed and final orders is passed<br \/>\nin respect thereof and that he will not be entitled for<br \/>\npayment of retirement benefits till the proceedings are<br \/>\nconcluded and final order is passed thereon except his<br \/>\nown contribution to CPF.  The payment of terminal<br \/>\nbenefits to Shri Kalra, if any, will be made keeping in<br \/>\nview the above order of dismissal.<\/p>\n<p>3.\tAn appeal preferred thereagainst by the respondent before the<br \/>\nappellate authority was dismissed by an order dated 6th March, 1997<br \/>\nstating:-\n<\/p>\n<p>The Board carefully considered the grounds of<br \/>\nappeal preferred by Shri M.L. Kalra along with<br \/>\nrecords of the case and after detailed discussions<br \/>\nobserved that the petitioner has not brought out any<br \/>\ncase based on the merits, which warrants interference<br \/>\nwith the decisions of the Disciplinary Authority.  As<br \/>\nsuch, the Board decided to confirm the punishment of<br \/>\nMajor penalty of Dismissal from service which shall<br \/>\nbe a disqualification for future employment imposed<br \/>\non Shri M.L. Kalra by the Disciplinary Authority.<br \/>\nShri M.L. Kalra be informed accordingly.<\/p>\n<p>4.\tIn the meanwhile, the respondent was paid his provisional pension<br \/>\nin terms of Regulation 46 of Pension Regulations from the date of<br \/>\nsuperannuation till the date of dismissal i.e. 22nd March, 1996.\n<\/p>\n<p>5.\tRespondent claimed that he was entitled to payment of the said<br \/>\nprovisional pension till 6th March, 1997 i.e. till the disposal of his appeal<br \/>\nby the appellate authority.  On the said premise a writ petition was filed<br \/>\nby him.  A learned Single Judge of the High Court by an order dated 22nd<br \/>\nFebruary, 2002 directed that the arrears of provisional pension also be<br \/>\npaid for the period during which the appeal was pending.   An intra-court<br \/>\nappeal filed by the appellant had been dismissed by a Division Bench of<br \/>\nthe High Court by reason of the impugned judgment.\n<\/p>\n<p>\tThe High Court in support of its order relied on a decision of this<br \/>\nCourt in <a href=\"\/doc\/632769\/\">State of Maharashtra  vs.  Chandrabhan Tale<\/a> : (1983) 3 SCC\n<\/p>\n<p>387.  <\/p>\n<p>6.\tMr. Amarendra Sharan, learned Additional Solicitor General, in<br \/>\nsupport of the appeal submitted that the order of disciplinary proceeding<br \/>\nculminated in an order passed by the disciplinary authority and in that<br \/>\nview of the matter, the said order cannot be taken into consideration for<br \/>\nthe purpose of payment of provisional pension.\n<\/p>\n<p>7.\tMr. Ambhoj Kumar Sinha, learned counsel appearing on behalf of<br \/>\nthe respondent, on the other hand, submitted that a retired person cannot<br \/>\nbe directed to be dismissed and a distinction exists between a disciplinary<br \/>\nproceeding and a departmental proceeding.  As the Regulation 46, it was<br \/>\nurged, refers to departmental proceedings, the appellant was entitled to<br \/>\npayment of provisional pension till the date of determination of the<br \/>\nappeal.\n<\/p>\n<p>\tRegulations 42, 45 and 46 of the Pension Regulations if read<br \/>\nconjointly, the learned counsel contended, would clearly show that the<br \/>\ndelinquent employee was entitled to payment of provisional pension<br \/>\nsubject of course to an order which may be passed by the disciplinary<br \/>\nauthority only for withholding or revision thereof.\n<\/p>\n<p>8.\tClause (b) of sub-regulation (2) of Regulation 22 of the Pension<br \/>\nRegulations postulates that the delinquent employee would be entitled to<br \/>\nreceive pension if he is permitted to retire or retires on attaining the age<br \/>\nof compulsory retirement while under suspension.\n<\/p>\n<p>\tTerms and conditions of the services of an officer of the appellant-<br \/>\nBank are governed by the Punjab National Bank (Officers) Service<br \/>\nRegulations, 1979 ;  Regulation 20(3) (iii) whereof reads as under:-\n<\/p>\n<p>20.\tTermination of Service<\/p>\n<p>(3) (iii) The officer against whom disciplinary<br \/>\nproceedings have been initiated will cease to be in<br \/>\nservice on the date of superannuation but the<br \/>\ndisciplinary proceedings will continue as if he was in<br \/>\nservice until the proceedings are concluded and final<br \/>\norder is passed in respect thereof.  The concerned<br \/>\nofficer will not receive any pay and\/or allowance after<br \/>\nthe date of superannuation.  He will also not be<br \/>\nentitled for the payment of retirement benefits till the<br \/>\nproceedings are completed and final order is passed<br \/>\nthereon except his own contribution to CPF. \t<\/p>\n<p>9,\tIn this case we are not concerned with the legality or validity of the<br \/>\norder of dismissal passed against the respondent.  The issue before us is a<br \/>\nshort one.\n<\/p>\n<p>10.\tOn reading the two Regulations conjointly, the question which<br \/>\narises for consideration is as to whether a departmental proceeding can be<br \/>\nsaid to be a disciplinary proceeding.  We do not find any distinction in<br \/>\nthe said term in the context of the present dispute.\n<\/p>\n<p>11.\tRegulation 22 of Pension Regulations reads as under :-\n<\/p>\n<p>22.\tForfeiture of service:-\n<\/p>\n<p>(1)\tResignation or dismissal or removal or<br \/>\ntermination of an employee from the service of the<br \/>\nbank shall entail forfeiture of his entire past service and<br \/>\nconsequently shall not qualify for pensionary benefits;<br \/>\n(2)\tAn interruption in the service of a Bank<br \/>\nemployee entails forfeiture of his past service, except in<br \/>\nthe following cases, namely:-\n<\/p>\n<p>(a)\tauthorized leave of absence;\n<\/p>\n<p>(b)\tsuspension, where it is immediately followed by<br \/>\nreinstatement, whether in the same or a different<br \/>\npost, or where the bank employee dies or is<br \/>\npermitted to retire or is retired on attaining the<br \/>\nage of compulsory retirement while under<br \/>\nsuspension;\n<\/p>\n<p>(c)\ttransfer to non-qualifying service in an<br \/>\nestablishment under the control of the<br \/>\nGovernment or Bank if such transfer has been<br \/>\nordered by a competent authority in the public<br \/>\ninterest;\n<\/p>\n<p>(d)\tjoining time while on transfer from one post to<br \/>\nanother.\n<\/p>\n<p>(3)\tNotwithstanding anything contained in sub-<br \/>\nregulation (2), the appointing authority may, by order,<br \/>\ncommute retrospectively the periods of absence without<br \/>\nleave as extraordinary leave.\n<\/p>\n<p>(4)(a)\tIn the absence of a specific indication to the<br \/>\ncontrary in the service record, an interruption<br \/>\nbetween two spells of service rendered by a bank<br \/>\nemployee shall be treated as automatically<br \/>\ncondoned and the pre-interruption service treated<br \/>\nas qualifying service;\n<\/p>\n<p>(b)\tNothing in clause (a) shall apply to interruption<br \/>\ncaused by resignation, dismissal or removal from<br \/>\nservice or for participation in a strike:\n<\/p>\n<p>\tProvided that before making an entry in the<br \/>\nservice record of the Bank employee regarding<br \/>\nforfeiture of past service because of his participation in<br \/>\nstrike, an opportunity of representation may be given to<br \/>\nsuch bank employee.<\/p>\n<p>12.\tWhen an order of dismissal or removal is passed, clause (1) of<br \/>\nRegulation 22 would apply.  Clause (2) will have application only when<br \/>\nan interruption in service takes place.\n<\/p>\n<p>13.\tServices of an employee can be validly terminated only once.<br \/>\nOnly because an appeal has been provided against an order of dismissal<br \/>\nfrom services, the same ipso facto would not mean that the same would<br \/>\nremain under animated suspension.\n<\/p>\n<p>14.\tThe issue is covered by large number of decisions of this <a href=\"\/doc\/354935\/\">Court.  In<br \/>\nSyndicate Bank Ltd. vs. K.R.V. Bhat<\/a> : [1968] 1 SCR 327 this Court held<br \/>\nthat an order of dismissal or discharge can be passed only once<br \/>\nirrespective of when the finality in relation thereto is reached and all that<br \/>\nthe appellate authority considers is whether the order of dismissal<br \/>\nrequires to be sustained or modified.\n<\/p>\n<p>\t<a href=\"\/doc\/794955\/\">In P.H. Kalyani  vs.  M\/s. Air France Calcutta<\/a> : [1964] 2 SCR 104<br \/>\nthis Court observed that the operation of order of punishment made by<br \/>\nthe employer does not depend on its confirmation by the Court.\n<\/p>\n<p>16.\tWe may also notice that in a recent judgment this Court, in<br \/>\n<a href=\"\/doc\/1461990\/\">Ramesh Chandra Sharma  vs. Punjab National Bank and<\/a> another: 2007<br \/>\n(8) SCALE 240, upon taking into consideration both the provisions of the<br \/>\nService Regulations as also the Pension Regulations, opined :-\n<\/p>\n<p>17.\tWhere a proceeding is initiated for withholding<br \/>\nor withdrawal of pension, Regulation 43 of the<br \/>\nPension Regulations would be attracted.  But<br \/>\nprovisions of the said Regulation if read in its entirety<br \/>\nclearly go to show that an officer would not qualify<br \/>\nfor pensionary benefits, if inter alia, he is dismissed<br \/>\nfrom service.\n<\/p>\n<p>\tRegulation 48 empowers the Bank to recover<br \/>\npecuniary loss caused to it from the pensionary<br \/>\nbenefits.  Regulation 20(3)(iii) of the Discipline and<br \/>\nAppeal Regulations must be read in conjunction with<br \/>\nthe Pension Regulations.  Where the employees are<br \/>\npension optees, Regulation 48(1) shall apply.  In any<br \/>\nevent, if an officer is removed or dismissed from<br \/>\nservice under Regulation 4 of the (Discipline &amp;<br \/>\nAppeal) Regulations, the Bank need not take recourse<br \/>\nto Regulation 48 of the Pension Regulations as<br \/>\nRegulation 22 thereof would be attracted.\n<\/p>\n<p>\tWe are, therefore, of the opinion that the High<br \/>\nCourt committed a manifest error in passing the<br \/>\nimpugned judgment.<\/p>\n<p>17.\tThe decision of this Court in Chandrabhan Tale (supra) was<br \/>\nrendered in an absolute different fact situation.  Therein the question<br \/>\nwhich arose for consideration was as to whether subsistence allowance is<br \/>\npayable even during the pendency of the appeal.  In the facts and<br \/>\ncircumstances of that case, it was held that the subsistence allowance<br \/>\nshould be granted.  We do not think that any ratio was laid down therein.<br \/>\nUpon dismissal from services, the employee ceases to be in employment<br \/>\nwith effect from the date when the original order had been passed and not<br \/>\nfrom the date of the order of the appellate authority subject, of course, to<br \/>\nthe condition that the original order is affirmed.\n<\/p>\n<p>18.\tReliance has been placed by the learned counsel for the respondent<br \/>\non <a href=\"\/doc\/1710747\/\">Union of India and others  vs.  J. Ahmed<\/a> : (1979) 2  SCC 286.  We do<br \/>\nnot find any application of the said decision in the instant case which is<br \/>\nmerely an authority for the proposition as to what would constitute a<br \/>\nmisconduct.\n<\/p>\n<p>19.\tFor the reasons abovementioned the impugned judgment cannot be<br \/>\nsustained and it is set aside accordingly.   The Appeal is allowed.  But in<br \/>\nthe facts and circumstances of the case, there will be no order as to costs.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Punjab National Bank vs M.L.
