learned Counsel appearing for second respo1’1de.nt’.-<\/p>\n
7. Srisathyapal. learned Counsel”a{\u00a7pearirig for’*<\/p>\n
the appellant would contend <\/p>\n

\nunder the heading  which is on the
\nlower side and A seheksi .fo’1-.  if compensation.\n<\/p>\n
He would    noticed the
\nevidence ._o–fl which was to the effect that
\nthe total to the extent of 1 1%, ought<\/p>\n
to  gra1’1te-devcornpensation towards loss of future<\/p>\n
\u00bbi:r’1\u00ab<:Qn1e.'A.Ml'~f_o"n; awarding of this said compensation has<\/p>\n
if prejudice to the appellant. He would<\/p>\n
Q also cc3ntei'1d that compensation awarded under the<\/p>\n
 other headings requires to be enhanced, since the same<\/p>\n

8. Per contra Sri.D.S.Sridha1′. learned Counsel
\nappearing for respondent. No.2 would submit.___ that<\/p>\n
Tribunal has taken into consideration all t.he.:niaft.el1=ilal<\/p>\n
evidence placed before it and has  <\/p>\n
compensation and same does n;ot”‘ca:1 for int.e’rfereriee at<\/p>\n
the hands of this Court. He would difaw  Aattenvti;o’nof.cL<\/p>\n
this Court to Para 16 of  to<\/p>\n
contend that Tribunal wasMju–s:tifi’e-d in not awarding
\ncompensation for loss’0~of0’f’futu1–‘ev since no<\/p>\n
material wa;sCpljaeed;1._byL the”‘claii11a.n.t that he was not<\/p>\n
 thellavocation which he was
\nhitherto  the date of accident.\n<\/p>\n
Accordingly seeks for dismissal of the appeal.<\/p>\n
  heard the learned Counsel for the<\/p>\n
parties,’  following point arises for my consideration:<\/p>\n
2 ,. ‘illlfhether the compensation awarded by
\nthe Tribunal in MVC.No.3264\/2005 dated<\/p>\n
 08.11.2006 is just and reasonable or it<\/p>\n
requires to be niodified\/enhanced’? If so. to<\/p>\n
what extent?”\n<\/p>\n
10. The Tribunal while rejecting theleilaijrn <\/p>\n
appellant for not awarding thereolnipens\u00e9ationi <\/p>\n
heading loss of future income has (fame tort}leonclusionr,<\/p>\n
that when there is no restrictlion of’.rnov–en12e-nt of the<\/p>\n
right forearm and there   rarove that<\/p>\n
petitioner had  the maxillary<\/p>\n
region and    is no permanent<\/p>\n

2.rrtCorrrp:ound fracture lower l\/3″” ulna with closed<\/p>\n
  Head injury<\/p>\n
l  radial styloid fracture right side<\/p>\n
9<\/span><\/p>\n
and subsequently the claimant: has undergone surgery<\/p>\n
on 28.03.2005 for debridement with ORIF <\/p>\n
and radius by K-wire and Doctor has  <\/p>\n
permanent disability to the right””u-ppery  ardund<\/p>\n

 Doetor’s evidence clearly goes to show that<\/p>\n
disa.bility’to}t.he right upper limb is to the extent of 20%<\/p>\n
 of fracture of bilateral Le-fort-Ii and also<\/p>\n
 _ contend compound fracture lower l\/3″‘ ulna which is to<\/p>\n
  right hand. When the profession or avocation of<\/p>\n
\u20ac:,:%\/,..\n<\/p>\n
claimant is fabrication work, the use of right hand is<\/p>\n
foremost. and the evidence of the Doctor xivhichtjtootthe<\/p>\n
effect that on account of the said injury, <\/p>\n
would find it difficult to lift weight and..11s:e.gVthe: 1.,_1pi);\u20ac'”i-..<\/p>\n
limb freely cannot be doubted;\n<\/p>\n

\nhas not if the basis of the
\nfinding”  of the finding having
\nbeen   as aforesaid. the disability<\/p>\n
of the_ clai4n;a_nt..i’.s to  assessed on the basis of the<\/p>\n
 V’  .ava-ilabiee e’vidence.l”by taking the said disability.<\/p>\n
 1l’l}lf–‘l;2}.~: lperusal of the Trial Court records would<\/p>\n
 shoyvg  when wound certificate and discharge<\/p>\n
if ll..j’jw\u00bbsAu’frri-rnary are read together with the evidence of the<\/p>\n
‘  Doctor it would show that particular limb disability is to<\/p>\n
\ufb01g\/.\n<\/p>\n
the extent of 20%. Thus the whole body disability<\/p>\n
would be around 6.66% i.e.. 1\/31″ of particular limb<\/p>\n
disability which can be rounded off <\/p>\n
accordingly disability to the whole body <\/p>\n
arrived at 7%.\n<\/p>\n
12. The Tribunal l\ufb01avirig taken’ fii’1\u00abc.0.mle at-6′<\/p>\n
Rs.5,000\/w and the said  “riot being

\nsafely held that__  is at

–.:l”c’\u00a7._lCll’L’3ptil”Ig the multiplier of 15 and taking into<\/p>\n
~\u00bbvc:’or1siderai,io1o1 the disability at 7% the comper1sa_tion<\/p>\n
that becomes payable to the claimant under the heading
\nloss of future income would be Rs.63.0OO\/A nan1e__1y 7%<\/p>\n
of 5,000 = 350 x 12 x 15 = 63,000. A(:c<)rdi.n:'gi"y.<a<\/p>\n
compensation of Rs.63,000\/~ is awarded?"  <\/p>\n

\nto be:7awar heading and accordingly it<\/p>\n
is so awarded.  _ V<\/p>\n
15. The claimani has undergone surgery twice<\/p>\n
 andi'”co~rr1.:pensation awarded under the heading<\/p>\n
in”ci_den’t’aIncharges is Rs.5.000\/~ which according to this<\/p>\n
 .CVo_urt.’=—is on the lower side and hence a further<\/p>\n
“g_com’f:)ensation of Rs.5,000\/– is awarded under the<\/p>\n
” ~–‘heading food. nourishment. attendant charges and<\/p>\n
incidetltal charges in addition to what. has been<\/p>\n
awarded by the Tribunal.\n<\/p>\n
