Justice V.K.MOHANAN\n\n Dated :29\/08\/2008\n\n O R D E R\n                   C.N.RAMACHANDRAN NAIR, J.\n                         -------------------------\n                       W.P.(C) No.8349 of 2005\n                     ---------------------------------\n             Dated, this the 29th day of August, 2008\n\n                            J U D G M E N T\n<\/pre>\n<p>      Challenge is against recovery of motor vehicles tax due for a<\/p>\n<p>stage carriage bearing Registration No.KL-01 B 4113. Petitioner&#8217;s<\/p>\n<p>case is that vehicle was sold to one Mr.Asokan Thampi, who is no<\/p>\n<p>more.    Legal representative is impleaded in the writ petition as<\/p>\n<p>additional respondent. Learned Government Pleader submitted that<\/p>\n<p>vehicle is repossessed by financier. If vehicle is in arrears of tax, it<\/p>\n<p>can be attached, and the same should be released only if the<\/p>\n<p>financier clears the arrears. In any case, since petitioner was the<\/p>\n<p>registered owner of the vehicle during the period 01\/01\/1999 to<\/p>\n<p>30\/06\/2000, recovery can be made from petitioner by virtue of<\/p>\n<p>Section 3(3) of the Motor Vehicles Taxation Act.
