(Oral)\n<\/pre>\n<p>          Krishan Lal, tenant, preferred a petition under Section 9 of the<\/p>\n<p>Haryana Urban (Control of Rent and Eviction) Act, 1973 (hereinafter<\/p>\n<p>referred to as &#8220;the Act&#8221;), in which he prayed that he is tenant in the<\/p>\n<p>building owned by Nirmal Kumar. Details and description of the building<\/p>\n<p>were given in the head note of the petition. It was stated therein that the<\/p>\n<p>premises have been taken on rent at a monthly rent of Rs.155\/- along<\/p>\n<p>with taxes. It was stated in the application that the house lack civic<\/p>\n<p>amenities and public hygiene, therefore, a flush with water facility be<\/p>\n<p>provided as petitioner was having open latrine on the roof which is not<\/p>\n<p>cleaned daily. It was further stated therein that potable water is not<\/p>\n<p>available and the drinking water is to be brought from outside. It was<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                           2<\/span><\/p>\n<p>further stated that on the eastern side of the house in question, a<\/p>\n<p>sewerage line and water pipe has already been laid and all the nearby<\/p>\n<p>houses are having facilities.       Registered notice was issued to the<\/p>\n<p>landlord calling upon him to provide the above said amenities. When<\/p>\n<p>the landlord had not responded then the petition was filed in the Court<\/p>\n<p>seeking the above said relief.\n<\/p>\n<p>          Landlord appeared. He filed reply and took a preliminary<\/p>\n<p>objection that the application is not maintainable. However, relationship<\/p>\n<p>of landlord and tenant was admitted. It was stated that house in question<\/p>\n<p>was an old construction and the same was required to be re-built and no<\/p>\n<p>facility as stated by the tenant have been provided by the Municipal<\/p>\n<p>Corporation and the house was required by him for the use and<\/p>\n<p>occupation of his brother.\n<\/p>\n<p>          Learned Rent Controller had framed the following issues:-<\/p>\n<blockquote><p>                    1.           Whether the petitioner is entitled to the<\/p>\n<p>                                 facilities as claimed by him? OPP<\/p>\n<\/blockquote>\n<blockquote><p>                    2.           Whether the petitioner has no locus standi<\/p>\n<p>                                 to file the present petition? OPR<\/p>\n<\/blockquote>\n<blockquote><p>                    3.           Whether the petition of the petitioner is not<\/p>\n<p>                                 maintainable in the present form? OPR<\/p>\n<\/blockquote>\n<blockquote><p>                    4.           Relief.\n<\/p><\/blockquote>\n<p>          Tenant had examined PW.2 Amir Chand Taneja who proved<\/p>\n<p>site plan Ex.P1 to show that the sewerage and water pipe line are<\/p>\n<p>passing in the street in front of the house in question. He further stated<\/p>\n<p>that these amenities have not been provided in the demised premises.<\/p>\n<p>          Landlord himself appeared as RW.1. He stated that when the<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                           3<\/span><\/p>\n<p>tenancy was created, these facilities were not available in the locality<\/p>\n<p>and now the petitioner has no right to claim the same and the<\/p>\n<p>construction of the house is very old and the same requires<\/p>\n<p>reconstruction.\n<\/p>\n<p>         Learned Rent Controller believed the evidence led by the<\/p>\n<p>tenant that there is open latrine on the roof and the amenities have<\/p>\n<p>reached near the house in question. Learned Rent Controller further<\/p>\n<p>held that sewerage and tap water facilities are essential amenities which<\/p>\n<p>are required by every person. Therefore, tenant is entitled to the same<\/p>\n<p>at the expenses to be incurred by him for providing such amenities and<\/p>\n<p>such expenses incurred by the tenant would be deducted from the rent<\/p>\n<p>payable by him to the respondent. In the relief clause, the following<\/p>\n<p>conclusion was drawn by learned Rent Controller:-<\/p>\n<blockquote><p>                   &#8220;14.       In view of my findings given herein above<\/p>\n<p>                   on issue No.1 since the respondent has already<\/p>\n<p>                   refused to provide the sewerage and tap water<\/p>\n<p>                   facilities to the petitioner, the petitioner is entitled to<\/p>\n<p>                   have the said amenities in the demised premises at<\/p>\n<p>                   the expenses to be incurred by him for providing<\/p>\n<p>                   amenities and the expenses incurred by him would<\/p>\n<p>                   be deducted from the rent payable by him to the<\/p>\n<p>                   respondent. Soon after the amenities have been<\/p>\n<p>                   provided the petitioner shall immediately send the<\/p>\n<p>                   details of the expenses incurred by him to the<\/p>\n<p>                   respondent\/landlord,     so    that   said   amount        is<\/p>\n<p>                   deducted from rent as per Section 9 of Haryana<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                       4<\/span><\/p>\n<p>                    Urban Control of Ren and Eviction Act. Present<\/p>\n<p>                    petition is allowed accordingly. Memo of costs be<\/p>\n<p>                    prepared and file be consigned to the record room<\/p>\n<p>                    after due compliance&#8221;.<\/p><\/blockquote>\n<p>          Aggrieved against the same, landlord filed an appeal. Learned<\/p>\n<p>Appellate Authority held that the tenant appearing as PW.1 has not<\/p>\n<p>specified as to when he occupied the premises. It took into<\/p>\n<p>consideration a reference in the cross-examination that the tenant<\/p>\n<p>started residing in the premises about 25 years ago and at that time<\/p>\n<p>also water and sewerage lines were existing in the locality. Taking this<\/p>\n<p>fact into consideration, learned Appellate Court held that since at the<\/p>\n<p>time of inception of tenancy, these amenities were available, and were<\/p>\n<p>not provided now the tenant is precluded from the prayer that such<\/p>\n<p>amenities ought to be provided. Learned Appellate Authority also relied<\/p>\n<p>upon the cross-examination of PW.2 Amir Chand Taneja to hold that if<\/p>\n<p>on the ground floor latrine is to be constructed then Chabutra and<\/p>\n<p>enclosure is to be demolished as there is no place for construction of<\/p>\n<p>latrine on the ground floor and also main hole of the sewerage line is<\/p>\n<p>about 25&#8242; to 30&#8242; away from the house in question. It also took into<\/p>\n<p>consideration that tenant has not obtained any estimate of expenses<\/p>\n<p>likely to be incurred on the construction of latrine. It also took into<\/p>\n<p>consideration that the rent is only Rs.155\/- per month and if the order of<\/p>\n<p>learned Rent Controller is upheld then for times to come, landlord will<\/p>\n<p>be deprived of the rent.\n<\/p>\n<p>          To controvert this part of the findings of learned Appellate<\/p>\n<p>Court, Mr. Mani Ram Verma, Advocate, appearing for the petitioner,<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                         5<\/span><\/p>\n<p>states that he is ready to incur all expenses without any reimbursement<\/p>\n<p>from the landlord.\n<\/p>\n<p>          At this stage, Mr. A.K.Goel, Advocate, appearing for the<\/p>\n<p>landlord has made three fold submissions. He has stated that the<\/p>\n<p>building is very old and it has become unfit for human habitation.<\/p>\n<p>Secondly, it has been submitted that the premises are required for<\/p>\n<p>personal use and occupation. It has been submitted that tenant wanted<\/p>\n<p>to construct latrine on the ground floor and if same is permitted, it will<\/p>\n<p>change the character of the building.\n<\/p>\n<p>          Repelling these arguments, Mr. Verma, in his all eloquence,<\/p>\n<p>has submitted that on ground of personal necessity and building being<\/p>\n<p>unfit for human habitation, eviction petition has been earlier filed by the<\/p>\n<p>landlord and the landlord lost in that litigation    before learned Rent<\/p>\n<p>Controller and Appellate Authority. He further submits that now again<\/p>\n<p>the landlord has filed another petition for eviction on the ground          of<\/p>\n<p>personal necessity and for enhancement of rent. Mr. Verma has further<\/p>\n<p>stated that since the sewerage pipe is to be taken on first floor and in<\/p>\n<p>the modern time, sufficient technology is available he will make the<\/p>\n<p>bathroom on first floor and take sewerage line there, where there is a<\/p>\n<p>provision of latrine.\n<\/p>\n<p>          In view of the submissions made by Mr. Verma that he will<\/p>\n<p>incur the entire expenses at his own and will construct the latrine at first<\/p>\n<p>floor, there is nothing that learned counsel for the landlord could say<\/p>\n<p>contrary to dislodge the submissions made by Mr. Verma. Landlord will<\/p>\n<p>be within his rights to pursue his remedy to seek eviction of tenant on<\/p>\n<p>the ground of personal necessity or enhancement of rent for which he<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                        6<\/span><\/p>\n<p>has already initiated the proceedings. Section 9 of the Act reads as<\/p>\n<p>under:-\n<\/p>\n<blockquote><p>                  &#8220;9.       Landlord to provide certain amenities &#8211;<\/p>\n<p>                  (1)       If the amenities of electricity, sewerage or<\/p>\n<p>                  tap water supply have been made available in any<\/p>\n<p>                  locality by the State Government or a local authority,<\/p>\n<p>                  the tenant of the building or rented land of such<\/p>\n<p>                  locality shall be entitled to the enjoyment thereof<\/p>\n<p>                  subject to the provisions hereinafter contained.<\/p>\n<p>                  (2)       If the landlord at the written request of the<\/p>\n<p>                  tenant fails to agree in writing to provide all or any of<\/p>\n<p>                  the amenities within a period of thirty days or fails to<\/p>\n<p>                  provide the same within a period of ninety days of<\/p>\n<p>                  such request, the tenant may apply to the Controller<\/p>\n<p>                  for that purpose. The Controller may, on such<\/p>\n<p>                  application by the tenant and after such enquiry as<\/p>\n<p>                  he may deem fit, permit the tenant to have such<\/p>\n<p>                  amenity at the cost of the landlord on such<\/p>\n<p>                  conditions as he may deem proper. The tenant shall<\/p>\n<p>                  be entitled to deduct the expenses incurred by him<\/p>\n<p>                  in providing the amenity from the rent payable to the<\/p>\n<p>                  landlord till the full amount is realized.<\/p>\n<\/blockquote>\n<blockquote><p>                            Provided that the rate of deduction of such<\/p>\n<p>                  expenses shall not exceed fifty per centum of the<\/p>\n<p>                  amount of rent.\n<\/p><\/blockquote>\n<blockquote><p>                            Provided further that the Controller may<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                      7<\/span><\/p>\n<p>                  reject the application if he is satisfied that such an<\/p>\n<p>                  order will cause undue hardship to the landlord,<\/p>\n<p>                  keeping in view his source of income, or       would<\/p>\n<p>                  involve expenditure incommensurate with the benefit<\/p>\n<p>                  sought to be achieved.\n<\/p><\/blockquote>\n<blockquote><p>                  (3)       The Controller may fix the extent and<\/p>\n<p>                  specifications of the amenity as far as possible<\/p>\n<p>                  keeping in view the circumstances of the case and<\/p>\n<p>                  also the estimated cost thereof.\n<\/p><\/blockquote>\n<blockquote><p>                  (4)       After the amenity has been provided, the<\/p>\n<p>                  tenant shall immediately thereafter send the details<\/p>\n<p>                  of the expenses incurred by him to the landlord.<\/p>\n<p>                  (5)       In case of dispute as regards the quantum<\/p>\n<p>                  of the amount spent for providing the amenity, the<\/p>\n<p>                  same shall be decided by the Controller after<\/p>\n<p>                  enquiry on an application made to him.<\/p>\n<p>                  (6)       The landlord shall be entitled to enhance<\/p>\n<p>                  the rent of the building or the rented land to the<\/p>\n<p>                  extent of eight per centum per annum of the amount<\/p>\n<p>                  spent for providing such amenity from the date the<\/p>\n<p>                  amenity is provided.\n<\/p><\/blockquote>\n<blockquote><p>                            Provided that where the tenant has initially<\/p>\n<p>                  incurred the expenses for providing such amenity,<\/p>\n<p>                  the enhancement of rent shall not be allowed till the<\/p>\n<p>                  amount spent by the tenant has been realized&#8221;.<\/p><\/blockquote>\n<p>         The request made by the tenant is in consonance with the<br \/>\n<span class=\"hidden_text\"> Civil Revision No. 4136 of 2007                                        8<\/span><\/p>\n<p>object of Section 9 for which the same was enacted. In the modern<\/p>\n<p>times, civic amenities and public hygiene cannot be denied to the tenant<\/p>\n<p>on the ground that he must yield to pressure and vacate the premises.<\/p>\n<p>Potable water is essential for day-to-day living so is the      sewerage.<\/p>\n<p>Therefore, the findings of learned Rent Controller are justified and are in<\/p>\n<p>consonance with the modern days&#8217; needs. Therefore, the findings of<\/p>\n<p>learned Rent Controller are upheld. The judgment of learned Appellate<\/p>\n<p>Authority is set aside. Taking into consideration submissions and prayer<\/p>\n<p>made by Mr. Verma, counsel for tenant as noticed above, the judgment<\/p>\n<p>of learned Rent Controller is modified to the extent that the sewerage<\/p>\n<p>pipe shall be taken to the first floor where there is provision for the<\/p>\n<p>latrine and all expenses incurred by the tenant for laying the water pipe<\/p>\n<p>and sewerage pipe shall be borne by tenant himself and will not be<\/p>\n<p>reimbursed by the landlord.\n<\/p>\n<p>          With these observations, the present revision petition is<\/p>\n<p>disposed off.\n<\/p>\n<\/p>\n<p>                                            (Kanwaljit Singh Ahluwalia)<br \/>\n                                                                 Judge<br \/>\nDecember 2, 2008<br \/>\n&#8220;DK&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Krishan Lal vs Nirmal Kumar on 2 December, 2008 Civil Revision No. 4136 of 2007 1 In the High Court of Punjab and Haryana, at Chandigarh.
