Justice C.K.ABDUL REHIM\n\n Dated :12\/05\/2009\n\n O R D E R\n                             V.GIRI &amp;\n                    C.K.ABDUL REHIM, JJ.\n               --------------------------------------------\n                       W.A.No.1010 of 2009\n              ---------------------------------------------\n               Dated this the 12th day of May, 2009.\n\n\n                           JUDGMENT\n<\/pre>\n<p>C.K.ABDUL REHIM, J.\n<\/p>\n<p>             The writ petition is filed challenging Ext.P11 order of<\/p>\n<p>the appellate authority through which the penal bill imposed upon<\/p>\n<p>the petitioner under Section 126 of the Electricity Act, 2003 is<\/p>\n<p>confirmed. The appellant submits that as per Ext.P7 report of the<\/p>\n<p>Electrical Inspector issued after testing of the energy meter, will<\/p>\n<p>clearly reveal that there is no theft committed in the case.      The<\/p>\n<p>remarks of the testing authority in Ext.P7 reads as follows:<\/p>\n<blockquote><p>              &#8220;The conditions of the seals and screws were<\/p>\n<p>       as shown in para 1. The meter was tested in the<\/p>\n<p>       received condition and seen that the meter is having<\/p>\n<p>       a positive error. The counter was working properly<\/p>\n<p>       and no irregularity or evidence for tempering, as<\/p>\n<p>       recorded in the site mahassar was noticed.&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>             2. In the circumstances, the sustainability of the<\/p>\n<p>proceedings imposing penalty need be examined in the writ<\/p>\n<p>petition, afresh based on Ext.P7.        Therefore insistence for part<\/p>\n<p>payment imposed by the Single Judge will work out in causing<\/p>\n<p>prejudice to the petitioner. Hence, we are inclined to interfere with<\/p>\n<p>the interim order passed in the writ petition on 20.3.2009, which is<\/p>\n<p>W.A.No.1010 of 2009<\/p>\n<p>                               :: 2 ::\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>impugned in this writ appeal, to the extent it imposes condition for<\/p>\n<p>payment of Rs.20,000\/-.\n<\/p>\n<p>            In the result, the writ appeal is allowed and the order<\/p>\n<p>impugned is modified deleting the condition for payment of<\/p>\n<p>Rs.20,000\/- imposed therein.
