SHAH\n\t\t\n\t\n\n \n\nDate\n: 30\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 226 of the Constitution of India,<br \/>\npetitioners, who belong to weaker section of the society and who are<br \/>\nallotted respective plots in question from the land which has been<br \/>\ndeclared as excess vacant land under the provisions of the Gujarat<br \/>\nAgricultural Land Ceiling Act, have prayed for an appropriate writ,<br \/>\ndirection or order directing respondent Nos.1 to 3 to hand over the<br \/>\npeaceful and vacant possession of the land allotted to the<br \/>\npetitioners.\n<\/p>\n<p>2.\tIn<br \/>\nresponse to the notice issued by this Court, Ms. Jirga Jhaveri,<br \/>\nlearned Assistant Government Pleader has appeared on behalf of the<br \/>\nState authorities and Shri Virat Popat, learned advocate has appeared<br \/>\non behalf of the private respondent.  An affidavit-in-reply is filed<br \/>\non behalf of respondent No.3 affirmed by Mamlatdar, Vav submitting<br \/>\nthat actual and peaceful possession of the plots in question which<br \/>\nare allotted to the petitioners shall be handed over to the<br \/>\npetitioners within a period of one week from today.\n<\/p>\n<p>3.\tIn<br \/>\nview of the above and in view of the fact that one civil suit filed<br \/>\nby the private respondent herein is pending, Shri Virat Popat,<br \/>\nlearned advocate appearing on behalf of private respondent does not<br \/>\ninvite any further reasoned order.\n<\/p>\n<p>4.\tIn<br \/>\nview of the affidavit-in-reply filed by respondent No.3 submitting<br \/>\nthat the peaceful and vacant possession of the plots in question<br \/>\nshall be allotted to the petitioners within a period of one week from<br \/>\ntoday, present Special Civil Application is disposed of by directing<br \/>\nthe concerned respondents to act as stated herein above and hand over<br \/>\nthe peaceful and vacant possession of the plots to the respective<br \/>\npetitioners which are allotted to them pursuant to the order dated<br \/>\n04.05.1993 out of the land which is declared as excess surplus land<br \/>\nunder the provisions of the Gujarat Agricultural Land Ceiling Act.\n<\/p>\n<p>5.\tWith<br \/>\nthis, present Special Civil Application is disposed of.
