However, before this<br \/>\n\tCourt proceeds for dictation of order, it has been stated on behalf<br \/>\n\tof the applicant of Company Application No.353\/09 and the said<br \/>\n\tfactum is confirmed on behalf of the OL  that full amount as was<br \/>\n\trequired to be paid by the offerer together with the accrued<br \/>\n\tinterest as per the earlier order of this Court has been deposited<br \/>\n\tand paid.    It has been further stated that in response to the last<br \/>\n\torder passed by this Court on 24.02.2010, another affidavit dated<br \/>\n\t09.03.2010 has been filed on behalf of the respondent Nos.6 to 10 in<br \/>\n\tCompany Application No.353\/09, whereby the respondent Nos.6 to 10<br \/>\n\thave relinquished their rights, title and interest in the land<br \/>\n\tsituated in Block Nos.316, 317, 340, 341, 342 of village Chharodi<br \/>\n\twhich were acquired by the said respondents as per the Sale Deeds<br \/>\n\tfrom the Company in liquidation.  It was also submitted by the<br \/>\n\tlearned counsel for the offerer Mr. Soparkar that the total area if<br \/>\n\tthe aforesaid Sale Deed are set at naught would come to 162989 sq.<br \/>\n\tmtr., whereas the area which has been sold pursuant to the<br \/>\n\tadvertisement and of which the offer is confirmed by this Court is<br \/>\n\tadmeasuring 113612.50,  therefore, the question also will be<br \/>\n\trequired to be considered for the actual measurement and the<br \/>\n\tadditional area as it may be found proper by this Court.\n<\/p>\n<p>At<br \/>\n\tthis stage, Mr. Shah for the applicant of Company Application<br \/>\n\tNo.13\/10 reiterated his offer for purchasing the land which has been<br \/>\n\tofferred to the offerer, client of Mr. Soparkar and he contended<br \/>\n\tthat the applicant of Company Application No.13\/10 still is<br \/>\n\tmaintaining the offer of Rs.14.25 Crore for the land in question and<br \/>\n\the is also ready for inter se bidding with the offerer or any other<br \/>\n\tas this Court may find it proper.\n<\/p>\n<p>As<br \/>\n\tthe Court time is over, order reserved.\n<\/p>\n<p> (JAYANT<br \/>\nPATEL, J.)<\/p>\n<p>*bjoy<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Vimal vs Official on 1 April, 2010 Author: Jayant Patel,&amp;Nbsp;
